abc7 news reporter chris nguyen has the story. >> reporter: outside the u.s.n services office in santa clara, duck nguyen hangs on to his daughter and his freedom. >> i am not a bad person i just made a mistake in the past. >> reporter: the 35-year-old san jose resident reported for an interview with authorities expecting to be detained and possibly deported. however the meeting was canceled by the agency at the last minute. he says it's now the second time this has happened. >> don't know what the next step is going to be. it is pretty hard because i came, you know, planning to do anything for the future, unless i know what happen to me. >> reporter: as a refugee, nguyen legally came to america when he was 12. however he was convicted of voluntary manslaughter in high school after prosecutors say he served as a getaway driver for a friend who stabbed another person to death. nguyen said he didn't know what his friend had done but still took responsibility. he served about 12 years in prison, another two years in i.c.e. detention before being released in 2012.

(robin) a shooter is still on the loose... after a man was shot several times while he was diving on highway 24. it happened yersterday morning around 6:30. the 20-year-old victim was approaching highway 13 when he noticed a blue sedan next to his car....that's when he says he heard several gunshots. the victim managed to get onto highway 13 where he pulled over and called police. he told investigators that he got a good look at the man firing the gun but didn't recognize him. <"we don't have a motive for the shooting. the victim stated that he didn't recognize that vehicle. he 'tdn recognize the driver"> (robin) the victim was taken to a local hospital for his injuries. this is the fourth freeway shooting in oakland this year. i'm kate larson in for chris nguyen this morning. we are going to start with a look at weather with meteorologist lisa argen. we had some sprinkles this morning but that's not sticking around, right? >> right. kate is heavier in the east bay and south bay as this front progressively shifts from the north to the south. here's live doppler 7 and our storm impact scale. this is a 1 throughout the morning hours. we're looking at rain throughout the east wbay, the south bay, te peninsula and winds are still breezy. over the past three hours look how it has quickly shifted to the east and the south. where it's raining there's pretty something downpours in the hills east of fremont, union city, newark. further to the north it's lighter in san ramon. from 680 through pleasant hill just some mist and drizzle. back onto the peninsula, 280 is wet and back towards half moon bay down towards portola valley so we'll look for the system to continue to push from the north to the south taking the rain out of here throughout the morning hours. 3 to 8
