authorities say that 68 year old nguyen van nguyen was under the influence of alcohol when he crashed this car on friday in santa rosa, killing a 31 year old police officer. prosecutors say jessica avila munoz was on her way to pick up her 13 year old daughter from school when nguyen ran a red light and slammed into her. munoz later died at the hospital. police say the driver has four prior misdemeanor duis. legal analyst stephen clark says this murder charge is the most serious way that a da sends a message for dui drivers that if you continue to do this and someone is killed, you will face a murder charge. no longer just a misdemeanor. >> it's likely that this man, if he's convicted of second degree murder, will not get out of prison. it carries a 15 to life term, and also the other conduct involved felony dui. so it's not likely that he will be released from prison anytime soon. >> munoz had just started working as a sonoma county juvenile correctional counselor last year. her coworkers are, of course, very saddened by her death. and as for the suspect, he's in jail without bail an

nbc investigative reporter candice nguyen has the new details. last month, we told you oakland failed to meet a critical deadline to fix its 911 problems or lose state funding. but the state has since changed its tune all the while. oakland's 911 callers are still hanging on the line. in our last report in july, we confirmed with opd the state softened their approach but did not mandate the police department with any improvement, benchmarks or goals as the problem persisted. according to state data from the summer, oakland's average answer times for 911 was 50s, the worst in california by far. and that's a four second improvement since last year. still more than triple the state and national standard of answering within 15 seconds. when someone calls. just this month, i've talked to oakland 911 callers who tell me they waited 4 or 5 minutes for a dispatcher to pick up. in one case, during an active home intruder incident. this week, california office of emergency services director nancy ward wrote this letter to opd's new police chief, floyd mitc

but nguyen allegedly ran a red light, hitting her honda and pushing it into a prius unos was trapped inside her car with major injuries. she was rescued a but died at the hospital. no one was also taken to the hospital where police say he showed signs of intoxication. according to the police know and what has 4 prior arrests for dui and a suspended license. he now faces several charges, including felony dui and manslaughter. and the chp arrested a suspect in connection to a violent road rage incident. the highway patrol says armando martinez followed a driver who allegedly cut him off on the road last week. martinez is accused of then using a window punch and folding knife to assault the victim and vandalized their car. investigators say martinez also found the victim on social media and started making criminal threats. chp says the alleged assault victim mastic pictures of the suspect which ultimately help investigators make an arrest. one person is dead in a fire. captain is recovering from injuries tonight after a mobile home catches fire in mountain view. the fire happened this m

abc news reporter emma nguyen has the latest. >> the joyful celebration of the 650th anniversary of the german city of solingen, marred by violence. just before 10 p.m. friday night, a suspect began randomly attacking people with a knife at the city's festival of diversity. the festival's organizer taking to the stage warning people to keep calm as special forces worked to secure the area. at least three people killed, including a 67 year old man, a 56 year old man and a 56 year old woman. several other victims injured, four seriously. the city's mayor saying last night our hearts were torn apart as he visited the site of the attack, where people have begun leaving flowers in honor of the victims. authorities provided an update on the investigation saturday afternoon. they say several knives were found on the scene and announced the arrest of a 15 year old for failure to report planned crimes. investigators say they're looking into whether another suspect may have discussed the planned attack with the teenager. police are asking for the public's help, urging witnesses to contact them wi

his name is jan van nguyen. he's 68 years old, and authorities say he was under the influence of alcohol when he crashed into that car. prosecutors say 31 year old jessica avila munoz was driving that car and on her way to pick up her 13 year old daughter from school. when winn ran a red light and slammed into her. munoz later died at the hospital. now the focus is on winn, who police say has four prior misdemeanor duis. here's legal analyst stephen clark. >> what the da is saying is that this man was warned several times during his prior dui that if he got behind the wheel and killed somebody when he was under the influence, he could be charged with murder. and that day has now come. >> munoz had started working as a sonoma county juvenile correctional counselor last year. her coworkers shocked and saddened over the news of her death. >> when i got the call from the santa rosa police chief and it took my breath away. >> she loved her daughter more than anything and was her number one priority. >> i spoke with d
