in oakland, nick smith, abc7 news. >> nick, thanks very much. san francisco police tried to explain today why officers failed to search a homeless man's car after he admitted to having a rifle and shotgun in it. officers encountered robert johns at least twice in a little more than a month. the first time he surrendered guns. police placed him in psychiatric care but they never searched his car. officers ended up arresting him july 22nd. and they took a sawed-off shotgun, 14 knives and more than 5800 rounds of ammunition in his car. >> i think it's serious enough we are very happy we got all this weaponry off the street. and i know in light of what went on in colorado a few weeks ago that there's a lot of people making that connection. we don't know that we have such a connection. >> the chief said he stands behind the decision not to search johns car in june even though the police had probable cause to do so. investigators believed he planned to sell at least one of those guns. johns remains in custody >> supporters of the chick-fil-a fast-food

we want to check in with nick smith on the latest on the health concerns. >> we're surprised to learn 9,000 people have since reported to health-related services to say we're not feeling well and want to be checked out that. is what we learned today to health official who's gave an oral report to the board of supervisors. take a look. there is that pipe that leaked last week causing a massive blaze sending a thick cloud of smoke pouring over richmond could have been worse. they say the quick response by workers that identified the fire and moved in quickly to fight it. now, speaking to the board today was dr. wendel breuner, the county public health director. he said 9,000 people sought treatment from area hospitals. there are complaints and all being blamed on smoke from the refinery fire, he says the particulate matter is the source of the irritant causing most to seek help for the discomfort they're experiencing. >> important issue to look at is how to prevent it from happening again. it's been a while since i had to go to richmond and explain to people what the health impacts were
