the cuts to the nnsa weapons activities began before the budget control act was negotiated. and it was spearheaded by the republican-led house, not by the administration. house budget committee chairman ryan and chairman rogers proposed to reduce fiscal year 2011 requests for weapons activities by over $300 million in february of 2011. this cut was ultimately reversed in the 2011 spending bill. the final 2012 enacted level was also higher than what the republican-led house appropriations committee approved during the fiscal year 2012 appropriations process. the u.s. can still meet the highest priority goals of the nuclear posture review with less than the 1251 report sanctioned levels of nnsa weapons activities. the 2011 and 2012 appropriations and the 2013 budget request provide more than enough to maintain safe, secure, and effective nuclear warheads. these increases are hollow budget authority, both the senate and the house fiscal year '13 house appropriations committee funded nnsa weapons activities at the fiscal year 2013 requested level. i'll finish by saying that nnsa

as we had indicated nnsa reform is a priority. the department of defense and all of those who have reviewed the matter have indicated that it must be reformed so it can both operate effectively and responsibly and also for the opportunities for cost savings in putting forth our suggestion reforms we're hoping for a valuable exchange with the minority and with the administration on ways in which the reforms that we propose can be improved. these can be in response that would help reform some of or refine some of the reforms we have in the bill. with that i ask for support for this bill, this amendment 43-10. yield back. >> for what purposes does the gentleman from new mexico seek recognition? >> i want to say i support this amendment particularly the restoration of nnsafte's focus on oversight to a more workable level. and i want to thank chairman turner in his work and his cooperation with us. i believe those can be addressed further down the line with other amendments and i want to thank subcommittee chairman turner for his work

the nnsa has had difficulty and struggled with their ability to deliver this facility. in that we're certain by coordinating this work with the defense of defense, we'll be able to accomplish the construction of this facility and delivery of it and have it placed on line. currently, the president is calling on a five year delay in implementation of this facility. we believe with a partnership between the department of defense and doe and nsa, we can accomplish the construction of this facility. we have two amendments. the first one brings the department of defense in with their expertise for that construction. i want to put a footnote on that. this is very much like how the private sector would undertake a construction project and partly why nsa has struggled. they've been trying to undertake this alone. in the private sector you bring a contractor, construction manager, tenant lessee, you bring forth the owner. in this instance, what we're trying to do by legislation, bring all these parties together so we can accomplish the construction of building nsa is failing at.

referring to this delay, nnsa administrator testified again to our house strategic forces subcommittee on april 17th, and he said, the good news by all of this, frankly, there are a number of options, a number of different paths we can proceed. we're not hampered by saying the nation has to have the capability right now to make 50 or 80 pits per year in order to take care of the stockpile. that's great news for this country because we are not forced into making rash decisions on significant investments in a very short period of time. so we have time to evaluate this area. assistant secretary of defense of strategic forces here-in added we need ability to support pits. exactly how many. how many we need in the future. what's the future pit requirement, how big cmr has to be, how much plutonium it has to hold, those are all decisions that may in fact change at the completion of the upf when we once again resume consideration of the funding and design of cmrr. >> neither the house nor the senate appropriations committee funded cmrr and directed money left from cmrr in fiscal 2012 be used

a law has been on the books for a long time that requires the directors of the laboratories, nnsa to annually certify under some real serious penalties for them that the stockpile is safe, secure and reliable. that's already in place. i'm not at all sure why this is necessary. i noticed a serious inconsistency in the bill itself. one of the major ways in which the safe, secure and reliability is to be achieved is with the utilization of the national ignition facility in lawrence livermore laboratories. it is there for that specific purpose and has other purposes, also. that was why it was built. now, in this bill there is a 50% fence built around 50% of the money allocated to the laboratory for the operation of the facility. in other words, they can't use that money until some sort of report or ignition is achieved. now, if the facility was only to be used for ignition, that is fusion, okay. but the facility is specifically there and the reason it was created was to provide the science necessary to understand whether nuclear weapons were safe, secure and reliable. so in one part of t

the administration did live up to the obligations that we agreed on by requesting $7.629 billion for nnsa weapons activities. congress did not appropriate that full amount, instead only appropriating $7.214 billion. that did create a shortfall. in fy-2013 we continued to honor our commitments by requesting $7.6 billion, $363 million, or 5% above the amount appropriated by congress for fy-12. it's one of the very few accounts in the entire government to receive an increase of this size. we would like to work with congress to be able to have everybody on the same page concerning this. >> i'll close with this, if it's okay. i appreciate that. and yet this year, that request was not made and the resolution state said if those funding requirements are not met, it's incumbent upon the the administration to come forth with a report showing how that affects the overall process. that has not happened. and, again, none of that is directed at you. it's directed overall at the administration. but it does create problems as it relates to overall trust issues. i thank you all for your testimony and loo
