and rex tillerson nominated as the next secretary of state? >> i've talked to a lot of career diplomats. there is a lot of wariness about tillerson's ties to russia and that i think plays into larger fears about what u.s. policy and russia is going to be. more accommodating to russia in serious areas of disagreement, in ukraine in syria, in some of the election meddling they've been doing through eastern europe. there are those concerns and also some of his other business dealings s kur s kyrgyzstan. while there is a wariness, also there's a little excitement about a diplomat coming in with a new approach, hard-nosed negotiator who could have a little bit more success. i think there's willing to be a little bit more of an open mind and giving him a chance. i think there is some excitement among the career foreign service he could have a new approach. >> what about all of these reports out there that perhaps john bolton, a former u.s. ambassador to the united nations, also served in the state department during the bush administration, could be

the rules of a nomination or confirmation are simple majority vote. so, is one question, can a minority of the senate prevent a simple majority from consenting to a judicial nomination? >> sure they can, and particularly given the agenda that the courts have set for themselves with the complicity, the active complicity of the legislature, i think it's important to preserve that. you know, timewise, the confirmation hearings lasted less than an hour. that was a long time ago, to be sure, but i mean, it was considered -- in fact, it was considered insulting to put substantive questions to a nominee. all of that ended when the supreme court, again with the active cooperation of the legislature, started expanding the range of cases and the nature of cases that it would take, to the point where political issues, instead of being resolved within the legislature through compromise and back and forth were handed off to the courts. and the courts of course were, sure, bring us your biggest problems. we sit here to solve everybody's problems, you know. no case

it is rare for cabinet nominations to be defeated. the last time it happened, you have to go back almost 30 years to 1989. george h.w. bush nominated a former republican senator for secretary of defense. the senate voted down that nomination. that's the last time it happened. there is rare and really rare. think about this. in 1989, bush's party didn't control the senate. those were democrats rejecting a republican nominee. the last time the president's party controlled the senate like trump's party is going to control the senate and reject the nominee, you have to go back to 1843. recognize this? john tyler was the president back then. he was a member of the whig party. the whigs controlled the senate and they were at war with their own president. they knocked down six of the cabinet nominees. that's the last time a president's party defeated the nominee for a cabinet spot. those are the stakes. keep in mind the balance of the senate is republican and will be republican in january. 52-48. that means republicans have the numbers to pa
