joining me now to discuss, legal analyst, norm eisen, and former trump white house associate counsel, may neil men. glad to have both of you guys here. i want to begin with you, norm, on this, because this is so significant. this was a summary judgment motion. taking a step back, tell us what that means. and why it's significant. >> laura, when you do a civil case, there are various off-ramps that can benefit the plaintive, whoever is bringing the civil case, or the defendant, whoever is being sued. in this case, you have the state of new york representing by the very tough attorney general, tish james. state of new york is the plaintive. donald trump and a variety of his family members and his businesses are the defendants, the allegation, very similar to the allegations we've seen from special counsel jack smith, or from d.a. fani willis in georgia, fraud. not election fraud, alleged, here are the allegations were business fraud. that trump, over and over again, he said his apartment was three times as large as it was, to get loans, and insurance. his residence at seven springs, his

. >>> now to paula reed, evan perez and norm eisen. , big picture here. 39 folks recommended to be indicted by this special grand jury. the d.a. ends with 19, fewer than half. does that show prosecutorial restraint, is that the right word, or that she's trying to build her strongest case against the strongest defendants? >> when you have jack smith with one defendant and fani willis with 19, it's tough to use the word "prosecutorial restraint." i would say it does show prosecutorial discipline. somebody who has practiced criminal law for over 30 years, prosecutors don't always indict everyone that a grand jury may feel evidence exists as to. they have to ask themselves multiple questions, like which of these almost 40 are the strongest cases? if i charge lindsey graham, will i get massive legal objections based on the constitution for a sitting senator? if i charge another name that's got a lot of attention, cleata mitchell, one of the alleged organizers of this conspiracy, but was her conduct more aggressive lawyering, or did it cross

let's dive into all of this with cnn legal analyst norm eisen. i was also the former house judiciary council in trump's first impeachment trial. also with us attorney and former deese d.c. chair aids scott bolden. gentlemen, great to have you with us. we appreciate your time. norm, trump and his lawyers decided they would not move forward to try to move the criminal charges into federal court. does that surprise you? >> it does because they told the state court that they were going to do it. the thing that changed pam is that mark meadows has been a trail blazer and removal and he lost. and it makes sense that he lost, because you only get to go from state to federal court if you are doing official action and attempting to overturn an election as scott well knows, cannot be an official act. fact under the federal law the hatch act, those kinds of federal activities are by -- a fifth unofficial. trump didn't want another big laws like he's facing in d.c. federal court, new york state court, so he pulled the plug. >> it won't work under any circums

legal analyst and house judiciary special counsel and trump's first impeachment trial of course norm eisen is here. look, first of all, again, we are all old enough to remember, and young enough to remember a high crime -- freeze of the day for two impeachment and as many years. now it is about the inquiry trying to get information alone. a lot of people think, isn't that what is the pinot is for? another publicans will say we have tried a lot of ways to get, this and we are going this route, but can you use the impeachment process, norm, to do this? >> number one, you can't unlock those special impeachment superpowers by kevin mccarthy having a press conference and declaring. that is like donald trump's magical declassification authority just by thinking it. just by saying it, kevin mccarthy does not get that. it is black letter law that you have to have -- joe knows this from his time in the house. and, knows it from working in the trump white house. you have to have that vote. we in the impeachment i worked on or forced to do that. number two, the problem is that they have, looked and i

norm eisen, i want to start with you. t that guilty plea not much of a surprise. how do you see him navigating this case. we expect him to ask to move this to a federal court. >> i think he's going to navigate this case as he has with some of his other legal problems with difficulty. the challenge for rudy giuliani is that he played such a central role as donald trump's outside attorney in the alleged scheme. and he touches every different part of that complicated conspiracy that fani willis has charged. we know he's also having financial difficulties, it is very expensive when you're in that kind of a central role in one of these cases. but i think the real problem with rudy giuliani is, and it is shown by what he's allegedly accused of doing in this election overturn scheme, his judgment is poor. and so if you have somebody who is facing these charges, who is not able to think clearly, understand the law, you're going to get into the same kind of trouble. he just got a default judgment in a libel case by the two election workers who we could say, now there is a
