norm eisen norm you're here in the studio, at least start with you first what do you think? i mean, obviously, i mean, we're talking about delays with the documents case down in florida. this is a delay in the georgia case, potentially, how do you think this is going to play out? do you think fani willis gets disqualified here? >> jim? >> just based on georgia law, which requires some actual harm to the defendants to have a sufficient conflict for disqualification. and the evidence that has come in here including fanie willis is very strong performance as a witness in rebutting the judge's primary concern was she essentially setting up a secret bonus arrangement for herself where she was incentivized. she said, no, we went dutch. we were a couple. we went dutch the law and the evidence do support disqualification, but the judge has had to preside over a gigantic disqualificatio n. and he is going to be struggling with can he just say, oh, it's all fine moon will move along. that's why i've said there needs to be some compromise. mr. wade should say, hey, i'm willing to volun

we wanna go to norm eisen, who, who's standing by norm, your reaction to the news that this is now officials that nathan wade has stepped aside in the fulton county prosecution boris he's doing the right thing here. this relationship was never smart we've discussed from the start that likely was not a legal or evidentiary basis for disqualification. but, that wade had to go that's been clear for many weeks. now. he's done it. i do think it speaks to his commitment. there have been so many false things said about him that he was not a highly qualified lawyer coming to this case. that's been proven false, that he didn't do a good job on the case that's not true either. he defeated with the team the lead some of the best litigators in the country in a series of pretrial skirmishes he got for guilty pleas. but once this controversy emerged, he had to go it's the right thing to do. it's a strong and good order by the judge i'm glad to see wade and the da's office acting fast, so we can return to getting this trial scheduled, which is what a majority of the american people would like to see happen

let's get some on all of these major developments are legal and political experts are standing by norm eisen, i'll start with you. you were inside the courtroom today. what stood out from the interactions that you saw between judge merchan and trump's attorneys? >> well, the judge was extremely sharp in his words, directed at trump's attorneys he said it was not what he had been led to believe that the presentation was disconcerting. he warned them be careful where you go. he said they were somewhat misleading. he asked why they hadn't brought this up sooner, but his body language and his tone and the things you can only see when you're in court, the way he lifted his eyes and glared at the former president's lawyer, todd blanche, when hammering some of these points home, judge immersion is a very even tempered individual. he's angry and that matters not only for today, but because this is the man who is going to sit as the judge in this trial. and if trump is convicted, who will sentence him so what trump's lawyers burned a lot of capital in this futile effort to delay the trial further, in

i want to bring in our legal and political experts for some analysis right now, norm eisen, what good this suggest to you that prosecutors are asking whether this gag order covers the judges family well, we've seen trapped in a way that appears to be very intentional target judge merchan's daughter, including by name, in a series of social media postings and we know from his prior isolation of individuals in this fashion that that can create an enhanced risk profile. now, the language of the gag order here talks about the family members of council or court staff. there is an ambiguity whether that encompasses the judges daughter, i think the da is right to ask for clarification and let's not let the quibbling about the words of the existing order detract from how incredibly inappropriate and dangerous it is to single out the child adult child of a judge in this fashion >> important point. kristen holmes, you've done a lot of reporting on this. a federal judge, as you know, gave a very rare and extraordinary interview to cnn's kaitlan collins about the threats to judges. and that inter
