and we are live right now at the intersection of north avenue and pennsylvania avenue here in baltimore city where two different protesting groups are merging together. if you can turn around and face that way, going up pennsylvania avenue, you can see this group that's just coming in. we're in front of the burned out cvs where there were rioters and looters last night that set this cvs ablaze. it seems to be right now that this intersection has become more of a protesting party atmosphere, as we have muse nick the background and two different groups that are merging here right in front of the cvs, coming from different directions on pennsylvania avenue. right over here on the corner is the burned out cvs, and people are literally going in there taking pictures video they're just walking through and touring it. it was a place that the police and fire department were here earlier saying that this property is condemned. you can see the big red sign on the front door but that's not keeping people from going inside

if you know baltimore, north avenue and pennsylvania avenues.the cvs was burned down last night. you have crowds, most of whom are peaceful i've seen myself. and then there are some who toss bottles or bricks at officers and an arrest there. given that, let's get perspective from my colleague at cnn, sunny hostin former federal prosecutor. she was with the city of baltimore for a number of years close with the mayor, entirely transparent on that. there has been some criticism, though in the fact that she perhaps should have said, you know to the governor together declare a state of emergency on saturday. we -- we already saw a melee and criminal activity then. why wait until several days later? >> i think the criticism is unfounded. baltimore is a large city. some of the lessons from ferguson when you preempt the police in communities of color that have these long-time tensions with the police department, that can escalate a situation. i think in a sense this mayor was damned if she didn't and damned if she didn't. >> she was saying -- i think w

what i want to say is that we're very thankful for the large group at north avenue pennsylvania avenue they're peaceful. that's the baltimore we're used to seeing. that's what we want to see the rest of tonight. >> the curfew tonight how [ inaudible ]. >> so we know that the curfew is in effect from 10:00 at night until 5:00 in the morning so unless you're engaged in work or you're on your way to receive medical treatment, you're not allowed to be out. obviously that will be enforced. we have a tremendous number of resources throughout the city. we will enforce that so that our city stays safe. >> if you're coming out of a restaurant at 10:10? >> i don't want to get into very specific situations. i don't want to speculate about what that looks like. we could come up with 100 different situations. i think there's a degree of common sense that our officers will employ but at the same time it's about making sure the city is safe. there's a 10:00 curfew. we've repeatedly put that out. we're telling people to please stay off the streets at 10:00 unless you're going to receive medical treatm

>> we're on pennsylvania avenue, which is the main corridor that leads from north avenue where a lot of the protestify was today and where a lot of the violence was last night. then pennsylvania goes all the way downtown. along this corridor, we saw a lot of the activity that we saw yesterday. we're not seeing it tonight because of this. a very heavy police presence, a curfew in effect, and slowly but surely, they have moved people back. up until about 20 or 30 minutes ago, there were small people happening out where we are, the national guard moving in with humvees. we have the national guard down here with humvees. you can see all the way down pennsylvania avenue, for the most part, it is clear. back in the neighborhoods, i will tell you, there are people roaming about, defying the curfew, playing a little bit of a cat and mouse game with police and you have police cars, then, cruising through the neighborhoods in great numbers. seven, eight, nine, ten police cars sometimes with the lights on, sometimes with them off, trying to get people to go home basically by pure show of force.

so we're at the intersection of north avenue pennsylvania avenue. we want to pan around and show you what's going on. large crowd gathered around here. a lot are media. a lot of people are coming out to see what's going on. it's peaceful. it's loud. folks are talking. take a look over here and you can see that the police are keeping a firm line. a little while ago, they actually closed off the sidewalk in both directions so people could no longer walk across west north avenue. they didn't tell us why they did that. but this intersection of course, is a big part of the story because last night this c.v.s. was really -- the c.v.s. over here was the first place that was really looted and then set on fire. now now, we can show you some of the pictures that took place yesterday. we were there when it started. police had been tipped off that high school students were going to gather and do something they were calling a purge. police were there. students started throwing stones. the police stood their ground. there was a push and a shove. later on in the a

this is taking place at the intersection of north avenue and pennsylvania avenue in west baltimore. and last night, the images are starkly different to what we are seeing right now. where people community members have come out in advance of the curfew tonight to gather, to have their voices heard. some with bull horns. some just with signs. as gabe was pointing out, we have seen this heavy police presence, and it is combined not just with the local baltimore city police department, but also with regional forces and the national guard that was activated after the governor declared a state of emergency yesterday. you can hear the choppers that are flying overhead and a huge media presence that's descended on this spot. i've been at three different spots today in the neighborhood of freddie gray and over at the southern baptist church location where the senior center was burned. but i haven't seen anything like this. >> the media presence has been huge partly because the crowd was just so large. earlier on this afternoon, it's dispersed a little bit now, but there was sometying that if

store at north avenue and pennsylvania avenue there being looted. that's the only scene that we've seen. this has not been indiscriminate mayhem or violence. this has been directly aimed at the police. alison: let's check in with kevin lewis who has been on the scene since all of this erupted about two hours ago or so. kevin, hopefully you're in a place where you feel safe and can give us an update of what you're seeing. kevin: yeah alison certainly things have cooled down here at the mall. there are still rioters or at least onlookers here. i'd say about 50. mostly youth here. but the police definitely outnumbering the citizens right now. you can see just a line of officers, many with the shields and the batons in their riot gear and there's another whole line of officers just to the right of here. the reason why they are sticking at this location despite the fact that so many of the crowds have moved towards downtown where brad bell is right now in the thick of it is because they do not want the rioters to gain access to this mall. there's a marsh

the wagon operator decided to respond to that location at north avenue and pennsylvania. ner was introduced into the transport wagon. the transport wagon then proceeded to the western district. at the western district freddie gray an ambulance was called rather for freddie gray. mr. gray was placed in an ambulance and he was transported to shock trauma where he died a week later. our investigative team is dedicating every resource at our disposing to each and every one of these sites. it's come flex. it involves a minutia of details. it requires our full talents, our full time. and we're going to get this right. but in order to get it right, we've got to fully investigate our interactions with mr. gray at each and every stop along the way. we have to identify civilian witnesses who may have been present at each and every stop along the way. we have to identify police officers who may have been present at each and every stop of the way. and we're continually combing through video footage to identify additional footage that will help us in the investigation. in fact yesterda

this is the corner of north avenue and pennsylvania avenue. this is near just a few blocks from where freddie gray was arrested. and the police station where he was eventually taken and then moved into an ambulance there. the police here the riot police have moved the crowd down this way on the other side of them is the cvs that was burning for about a half hour before fire trucks were able to get in there. there were two vehicles, one a police vehicle right down the way from it that had burned for an hour with no fire trucks around to service it. the hose that you see there at the end of the police line, to the left of the police line we watched them hook that up in a very fast and professional way. and as soon as the firefighters walked away or turned their backs, somebody walked up with a knife and cut holes, two holes into that fire hose. firefighters were able to come back, shut the water off, remove the link and then reestablish the connection. so they are getting waterton fire now. and i can tell you that the smoke and the fire in that

there's also a small group of people gathered at north avenue and pennsylvania avenue again, that iscontinue to be. we are currently monitoring school dismissal. we have resources staged throughout the city to be able to respond if there should be any incident. again, we're asking everyone to remain peaceful as we have seen over the last 24 hours and we will be watching that. i want to bring you up to date on what has become a story this morning and talk about the arrest charging process and how that's working and where we are at in that process. there were 209 arrests that were made in the initial monday night incidents. when we went into our state of emergency situation we began to effect those arrests, there was a chaotic situation taking place. there were officers being attacked and we had officers being injured and clearly we had destruction of property and other acts of violence taking place throughout the city. our officers as you've heard us say moved quickly to affect arrest and preserve the public peace and make sure everyone could be safe. it was a chaotic situation so whe

today, it seems pretty normal here at the intersection of north avenue pennsylvania avenue, the place that they're calling ground zero. this is the place where the looting began. it looks normal here. but as you go around the city things are anything but normal. and we can show you some video. the inner harbor of baltimore, that famous landmark today by national guard soldiers equipped for combat. national guard soldiers at mondawmin mall the place across the street from the high school where stone throwers were at on monday, this is the scene that high school students saw when they were dismissed today. those heavily armed national guard troops. but peace reigns across the city. the only protest we've seen is the one staged by a group of pastors in front of the state's attorney office. they want to get the focus back on the death of freddie gray and their calls for justice. their protests are peaceful. everything we've seen today, peaceful. but everyone knows violence is really just simmering. this is what governor hogan has to say. >> we don't know that things are over with. there's

back here live in baltimore at north avenue and pennsylvania, before we spend too much time talking about the city's present school system we should remember its glorious past, in 1906, an african american man named thurgood marshall graduated from here and became the first african american supreme court justice. antonio. >> you had an opportunity to talk to another very important baltimore leader. >> in fact he is not only a very important leader, he's a graduate of the school system, elijah cummings graduated from baltimore city high school back in 1969. talked to me exclusively about what he wants the world to know about this neighborhood he calls loam. >> i want them to know that there are a lot of great people here. if you wait a little longer, if you were to wait a little bit longer you would see people getting an early bus. 5:00 5:30 they work hard, many of them don't have jobs. and they want jobs. we got a lot of young men who have gotten caught up in a trap of being arrested, and many of them have gone to prison, served their time, and now they can't get a job. they are in pain.

state troopers in their riot gear and armored vehicles at nearly every corner here at pennsylvania and north avenues. we're told it will stay this way to ensure continued calm. just after 10:00 last night, though, police used tear gas to disperse the crowd telling them everyone needed to go home to obey the curfew. ten people were arrested but the day generally peaceful in charm city with prayer rallies and orderly demonstration. we also saw a whole lot of residents thanking the police. >> i get reports from the organization that we do not have a lot of activity or mocht throughout the city as a whole -- or movement throughout the city as a whole so the curfew is in fact working. >> reporter: and here we are right at the cvs that started this violent demonstration that began on monday. the cvs was looted and set on fire. you can see state police and their riot gear prepared for yet another day of enforcement here in the city. we'll have much more on the demonstration coming up at 6:30. back to you in the studio. >>> happening today, a hearing on capitol hill to talk about how a man was able to fly a

we saw it up at north avenue, about two and a half miles north of here, where firefighters at north and pennsylvania avenue couldn't get in there to fight the fires. there were cars on fire for hours. the cvs was burning for half an hour, firefighters could get in there. once they did, protesters were throwing stuff at them. once they hooked up their hoses, shocking, on live national television, they walk up and stab the hoses with knives making it impossible for the firefighters to do their jobs. the police had to move in closer to just protect the hoses. that's a sort of stuff that is happening. the fear is now that this has been lit to pull resources away from other places of the city where other things may be going on. they went after a mall downtown this weekend. they went after several businesses downtown as well. and we haven't seen that yet tonight. but i'll tell you, on the way down here, from north avenue and pennsylvania, there were -- there was a rite-aid and several locations that clearly had had trouble tonight. the rite-aid, they did have riot police outside protecting it so nobody co

there was no real activity and around 10:25 we saw smoke fill the area around pennsylvania avenue and north avenue. scene of yesterday's looting was in that area. some of the people in the crowd appeared to throw objects at the police or were picking up objects that they were throwing back at the police. the baltimore police started to deploy pepper balls and the crowd was ordered to disperse. right now the streets are mostly clear. a fire started near owe local library reportedly from a molotov cocktail. rachel, the real news tonight, one hour into this curfew is that well over 99% of the residents of baltimore have observed this curfew from the start. we saw -- our cameras could show you no more than 100, maybe 200 people on the streets in violation of the curfew and they

we are along, as you said, the corner of north and pennsylvania avenue. the police just got reinforcements for this corner. just down a block away from here, there has been a lot of looting in that area. we also just got reports from the baltimore police that some of their units have been attacked along fulton avenue which is about a block that way. fire units have also been attacked responding to fires, car fires on the street. we were told that rioters threw cinder blocks and bricks at them as well. you have police units coming down the street. there's a fire unit now coming down and probably going to make a turn here to respond. there have been a lot of car fires set over the last couple of hours. and the latest that we've heard from the commissioner anthony batts is that at least 15 officers were hurt, six of them seriously. those six taken to shock trauma units in the baltimore area. a group of high school students got out of school on monday afternoon and started to move toward the mondawmin mall in northwest baltimore. that's where they attacked so

north avenue and pennsylvania avenue this is the scene where yesterday we saw worst looting and rioting, where the cvs drug store went up in flames people running in and out of the building. tonight a different scene, a calm protest at the intersection where hundreds are gathered in the streets. and next to them a line of police officers, and helicopters shining lights overhead. it's unclear how the situation will play out with the curfew in effect. one person who raised a lot of concerns over how the city handled the crisis is a former police officer a man by the name of ed-norris. he has an interesting story. he was the police commissioner resigned in disgrace from law enforcement after he was found guilty of a federal crime, and has strong opinions as to what went wrong why the rioting got so out of control in baltimore, and believes the protesters are misguided. he does not believe the main problem is police misconduct, he beliefs it's a bigger problem, problems to do with income and equality and the root of the problem, according to him, the war on drugs. >> reporter: violent rioti

it's not just confined to one area although we heard reports of north avenue and north pennsylvania avenue several businesses being looted and objects being thrown at the police in that general area. so as you can see, police is really doing nothing here other than blocking the roadway, standing guard waiting for something to happen if indeed it does. but from some reports, we're hearing that the crowd moved down this way, took a left and marching now towards the downtown area and the inner harbor area. we were going to try to stay with this and be mobile. it's very difficult to get to baltimore because there's so many road blocks. traffic is basically gridlocked. people are trying to get home from work and are not being sus successful in doing so. >> we're seeing the crowds getting bigger. these are some of the biggest crowds that i've seen since the l.a. riots. we're also seeing police vans pulling up. they are clearly getting some assistance. the law enforcement is gathering and they are putting their strategy in play right now. give us your thoughts. what is your sense there? >>. >> we

near the intersection of pennsylvania avenue and north avenue this massive line of police officers clad in riot gear. i count more than 30 of them going from one end of this block over here and they've got bear cat vehicles very heavily armored vehicles to get police officers in and out of these situations. and again, the police forming an absolutely solid phalanx of officers here across north avenue. we did see preparations earlier for something that could come tonight. we saw one officer actually on top of that roof with binoculars kind of scoping out the scene. so these police officers here have been preparing for this all day and since last night. and interestingly enough don, just 24 hours ago, i'll have our photojournalist, frank, swing our camera down here. you can see how clear it is now, not a soul in sight. 24 hours ago, that intersection there had a burned out car, smoldering in the middle of it. we walked ail around that area. we saw a tavern being looted. we saw a liquor store being looted. we were in the midst of people throwing objects all over the place. it was absolute

there was a long, slow period of putting it into effect at north and pennsylvania just down the way here. this is north avenue and you can see that most of the police presence has pulled out and you have national guardsmen and humvees and some state troopers. you have a sense of the neighborhood here, the building that is abandon there across north avenue. so what happened, essentially, is that the police moved the protesters out, what for most of the day was sort of part political rally, part protest and part street festival, amazingly enough. that portion of town turned into a gathering place and a point of pride for the neighbors in this area. they came here, they formed lines along the police lines, putting their backs to the police. they wanted to show the word that they were in -- they moved this out farther and farther until it was a couple of blocks out. then at one time, they left leaving national guard here to hold this neighborhood and to keep the security here so there wouldn't be the sort of looting that we saw last night. and then police are able to go to other places in the city and patrol. we

>> at the corner of north avenue and pennsylvania avenue here. and impromptu street protest has developed here. there are people here as ryan pointed out, not far from where ryan was, people arguing among themselves some factions arguing with others an older crowd trying to push the younger protesters back telling them they have to be peaceful some younger saying they have a right to vent their anger. it did get tense a short time ago. i'll take you back here where we're going to move among the protesters still talking, little tight squeeze here but this developed a short time ago when some of the riot police moved in to apprehend someone being vocal in the crowd. when that happened the crowd got agitated and moved up against the police started really becoming tense but it then called down. what's interesting is that a lot of the crowd as we noticed last week in baltimore, some members of the crowd as you saw here are self-policing. they're moving among themselves telling their fellow protesters to calm down. one lady actually grabbed one of thes

take a look at north and pennsylvania avenues.nted maybe about two dozen police officers, baltimore city police officers, a far different scene than what we saw yesterday with rose and rows of state police in their riot gear. we can tell you so far things have been calm here in the city. last night congressman elijah cummings urged protesters on the streets to go home so they could make that 10:00 p.m. curfew. the curfew lifted about an hour ago. several violators were arrested tuesday night. over 200 people were arrested since tuesday night and a hundred released because they were not charged. the prisoner who was in the police van with freddie gray says he believes gray was trying to intentionally hurt himself but remember, the prisoner could not see gray because a metal wall separated them and we know police violated departmental policy and did not secure gray. now, back here live in west baltimore, you can see that cvs which kind of sparked off the looting and fire and rioting that we saw. now marked with freddie gray peace si

we've got another group parading up north and pennsylvania avenue and also over to the left you've got groups. we talked to martin o'malley a short time ago former mayor of baltimore former governor. said he's going to decide sometime next month whether or not to run for president. he should know an awful a lot about the situation between the community and police. here's what he had to say. >> we've got to work it every day. we're a safer city now than we were 15 years ago but we still got a lot of work to do. this is not something that's solved in any one day. it's something that involves a lot of work, a lot of good people more drug treatment intervening in the lives of young kids, doing a better job of policing our own police as we police our corners and it's something we have to do together. >> we should point out that the former mayor former governor also gets criticism in these parts because it was his zero tolerance policies that caused an awful a lot of these people. a lot of people say they were arrested unfairly so police had a lot more leeway as to who to decide to arrest. m

the extent that there were large numbers of people out at this key intersection out at pennsylvania avenue in north and west philly. you are not seeing large numbers of people there now. the large groups that you are seeing are the police themselves and, honestly, the media who is there to cover what might happen in this confrontation. what we've seen over the last 40 minutes does involve some pretty disturbing pictures of that, incendiary objects, whatever they were, and bottles and rocks and what appear to be bricks and glass bottles. a number of things thrown at police which looked initially like police gassing the protesters putting tear gas canisters out to disburse people does not now appear to have been a police tactic. it appears that those devices, including the smoke devices originated with the protesters side, not the police side. so we're seeing the police take up space, but we're not seeing a kinetic confrontation here. >> chris, it seems the police are holding their position at your location. >> yeah. i mean they have -- at this point, they've succeeded tactically. they've taken the i

the nation of islam was up in the north avenue and pennsylvania avenue section, literally grabbing young people by the collar and trying to take them home and keep them off the streets. it is not clear why the police here and the mayor have taken such a -- i don't want to say hands-off, but a soft approach to what they are seeing happening in their city. it was angry, but peaceful protesters for six, seven days here. the police took only a defensive position allowing protesters to go at them even when they marched, unlike new york as you remember when the protesters went out there, the police followed alongside them blocked traffic, that didn't happen here. that's the level of the situation between police that the police didn't feel they could put their own officers out there in the street with the protesters for fear of them being injured. it's just a very bad situation. protesters felt they had the upper hand and it's gone step by step greater and greater. after saturday i think folks thought it would settle down because they had spent a lot of their anger in going at police on saturda
