north dakota is a perfect example. in 2011, the north dakota legislature overwhelmingly shot down the greater restrictive voter id law because it would be burdensome to voters. the legislature heard testimony that native voters in particular would be harmed by the laws given their lack of addresses. when the native vote was instrumental in the 2012 elections, however, the legislature passed the most restrictive voter id law in the nation in 2013. the law was limited to four forms of id, a state driver's license or id, tribal id or long-term nursing care certificate. the law required voter ids to have a residential address on them. the problem was that many tribal members only had tribal ids with no address or only a p.o. box. the law required something that was often impossible to obtain. elvis nor way who testified before this committee in february 2020 was one of the individuals that was disenfranchised by the law. he, like many native people, have been in and out of homelessness, lacked access to transportation and

it was very, very cold in north dakota that winter. it got below 60 degrees farenheit below zero before their last thermometer broke. and people were getting frostbitten in places you don't want to be frostbitten and having a really hard time trying to keep away from the elements. but they did spend time forging things that they could exchange for the mandan for corn because the mandan corn pretty much was the main food source for them that whole winter. so they would exchange these goods for the corn. they also joined the mandan in pursuing the lakotas who raided the mandan village in a short foray in february of 1805. one of the mandan leaders that they become quite close to is a man named -- known as the big white or the big white coyote. and he is going to be an important figure because on the return journey, he travels back with lewis and clark to meet with thomas jefferson. and we have the documents and records of these interactions between sheheke and the president. they're quite fascinating to study. but then it takes two or th

north dakota oil and gas companies don't support this resolution. it's not because they're interested in polluting. it's because they don't want to be duplicatively regulated from the well-head to the market. states arerd will doing this. we heard this from new mexico. north dakota is regulating this. we have our d.e.q. but the real problem with this e.p.a. regulation and this -- these obama-era policies coming back is not only is it duplicative regulation but it actually stifles innovation. because the one thing state regulators can do better than the federal government is respond quickly, adapt. so when an industry comes to you and say, hey, i have a way to do this better, they'll work with you and get it done. we see it every single day in the oil patch in western north dakota. the problem is -- the problem is federal regulation at its very core is unwieldily, it's burdensome and it gives a tremendous market share advantage to large companies over smaller companies. we need to stop duplicative regulation. we need to allow companies to regulate --

rep armstrong: north dakota is a state that does not allow eminent domain. so, you have different transitions. during the oil boom, we tried to get a lot of pipe and transmission in the ground in north dakota. my friends and colleagues would ask how to do that. i would say, go back in time and give the county easement. when you are talking about conservation easements into litigation as an ongoing issue that delays deployment, this is not unique to electrical transmission. how do we address -- you have any ideas how to address that? ms. fischer: people do not necessarily love living your infrastructure, if and when they benefit from it. i think you have identified appropriate ways of looking at how we site infrastructure to minimize impact. we have seen some of our members do that, for example, while deploying fiber-optic coble -- cable for their own uses, they also deploying that to allow broadband for other customers who may not have access. our infrastructure can be used for different purposes. we share with the telecommunication industry. rep armstrong:
