coming from north dakota, i can tell you firsthand not that many years ago i was the economic development and finance director in the state of north dakota at a time when we were just stabilizing out migration, but part of the reason we were stabilizing it because we lost so many of our young people. our small towns were shrinking. while we were diversifying our economy a little bit here and there, the shale revolution that came along with the technology that combined fracking with horizontal drilling changed our state, dramatically changed our state. probably my favorite antidote of the whole situation while there are many the town kill deer didn't have a football team for over 20 years because they couldn't field a man. now they have a football team. you see in the supply chain in the oil and gas industry, the jobs are not only numerous, they're really good. they pay on average 25% higher than the national average, so it really is a grand opportunity. now, somewhat being lost and certainly its potential is being lost because we are now sort of hemmed in with light sweet crude being produced more we can use in our refine

north dakota. in fact, a lot of the generation that happens in north dakota is generation that is, in fact, generated by rural electric co-ops. these co-ops own and operate about 90% of the state's coal-based generation facilities and provide electricity to rural areas that in the past, other utilities would not serve. not just rural areas in north dakota but rural areas all through the region. the people at the end of the line, as we call them, the very people this rule will most impact, that e.p.a. and this administration have failed to consider when they've made this final rule. north dakota's utilities are heavily invested in coal-based generation for a good and historic reason, and i think this is really an important point to make because a lot of people may think, well, what's the difference, you know? you can fuel switch. but at the time that our electric co-ops built these generation facilities, they used coal because it was against the federal law to use natural gas. the fuel use act made it illegal to use natural gas for power generation, virtually forcing these power companies to make the investment that they made in this fuel source of coal. now after making billions

dakota access, is designed to pump crude oil from north dakoa to illinois, travelling diagnally across the state of iowa. the project is nicknamed the bakken pipeline because it travels from the bakken oil fields in northwest north dakota. in court paperwork filed tuesday, the judge presiding over the suit, dismissed the case, saying the three landowners who brought forth the case needed to go through the proper channels and quote "exhaust the immediate administrative remedies required" before they can sue a state agency. no judgement came on whether dakota access is able to use eminent domain. stay tuned right here on abc9 news for the latest in this case. jessica rae: this morning, opening statements began in washington, into yet another hearing about the deadly attacks in benghazi that claimed the lives of four american soldiers. former secretary of state and current democratic presidential caniddate hillary clinton took a seat before the congressional committee designed to uncover details about the benghazi incident and set future preventative measures to stop an attack from happening again.

state oil pipeline developer. the bakken pipeline would carry crude oil through iowa on its way from north dakota to illinois. the case was argued in cherokee county court earlier this month. three landowners, filed the suit. they say pipeline developer dakota access is not eligible for eminent domain to take land because iowans would not benefit from using the pipeline as a utility. judge carl petersen has ruled the plaintiffs must first try all administrative remedies before they can sue a state agency. the judge did not rule on whether dakota access is eligible for eminent domain. we have a chance of showers coming our way in siouxland. joining us now is chief meteorologist ron demers with the first look at our forecast. weather ad-lib clouds have been thickening today and our rain chances will continue to increase into tonight and we may have some rumbles of thunder as well. many of us could see a half inch to one inch of rain tonight into friday with rain chances lessening the later into the day we get friday. poverty, disease, lack of education. a siouxland group continues its fight to change lives half
