president o'brien: commissioner clyde? commissioner clyde: supervisor, thank you for sponsoring this legislation. it is very dear to my heart. i am a small business owner who would love to have it in the code that i can offer entertainment in my small establishment in the afternoon hours during sunday brunch and that we can do it without, you know, real restriction. this is for live performance, this is for small venues whose place is not principally as a place of entertainment. i mean, my preference would have been to exempt all small venuess with fewer than 50 people just completely as the city of oakland did but, of course, that was not possible, so i think this is a great compromise. i would encourage you to look at the n.c.t. districts, the westportal, i believe, is currently not in the plan. >> that's correct. commissioner dooley: and also, back to the south of market, the small business community, i think with outreach and information may be more supportive of this. there are restaurants and venues that would like t

president o'brien: commissioner riley? president riley: yes, under the circumstances, we do need to come up with a solution. but i do have a question. what kind of outreach efforts will you do and what's the response? >> thanks for the question. i think there are a couple of answers we've had. several meetings internally at the mayor's office as we have been thinking through this, we met with small business network, chamber of commerce, a number of stake holders to get their view on this idea. the mayor has also raised this as he has been going out and doing town hall meetings and merchant walks and been trying to talk to people about this and gauge the opinion. i think the response -- first of all, the second part of the answer to that is i think there is also still a long way to go on this. and that coming here to the small business commission is one of our first steps as we go through this process. so we have introduced this legislation. we're going to go to the board. so we're still in the process of doing more outreac

president o'brien: thank you. next speaker. >> michael williams, union street neighborhood commercial district and others. having been involved in the legislation when union street first did a moratorium to get their lot -- their legislation strict about, i did a use survey. the restaurant business -- these buildups have been really strapped because of this micromanaging of our and cds -- ncd's. i attended one with the supervisor alioto-pier once, and she said we are doing this to the point of insanity. it takes restaurants a lot of money and almost a year to get to opening their doors and it is debilitating to them. anything we can do to streamline the process will help these guys, these small business owners, come in and set up camp. i support this, and so does the ncd. president o'brien: thank you. any more public speakers? public, disclosed. commissioner clyde: i would just like to go back to the two options, the one with the existing use categories and if they are moving into another category. i would like to

president o'brien: commissioner dooley? commissioner dooley: i just want to reemphasize what some of my fellow commissioners said, which is you can't keep going to the same group over and over again. the small businesses in particular. you know, they don't have a strong advocacy behind them except for us, and there are a lot of folks out there that are not paying their fair share, and i feel like while we will support this as an emergency thing, i just cannot emphasize more strongly that these other folks have to share the burden too and, you know, we're kind of tired of them paying no sales taxes. that is just wrong. that then other folks are burdened with a higher tax burden. i really would like to hear from the mayor that those other possibilities are actively being explored, because i think that's extremely important. my other comment is i'm still very uncomfortable with the one-year -- you know, if the state doesn't do it in one year. i would like to hear you go back and extend that for a much longer period of time. if

president o'brien: anybody else? during the outreach, were there any negative comments from any party, in the neighborhood representative? >> by far, most people have been very supportive. there has been some questions about what the change would do two specific neighborhood commercial districts, and i have for -- and they have worked hard to maintain a certain image in their neighborhood. we are trying to reassure them that our intent is not to get rid of those controls, but just to make it -- someone said micromanaging. cannot micromanage how business operates so much. president o'brien: it is not an action item, necessarily. >> it is not an action item. if there is any comment or suggestion you want to direct to the planning commission as they hear it on august 4 -- will the legislation be ready by august 4? >> we present a recommendation to the commission. they take that recommendation or do not. the supervisor can opt to put that into the legislation. that is when it would be officially drafted, after their boat

president o'brien: go ahead. thank you. >> the second way we have been trying to talk about this -- that would be the number of employers who the majority of their expenditures go to reimbursement -- 29% of employers use a reimbursement account in some way, shape, or form. one related point is to say that it is absolutely right that there are a number of variations and varieties of irs-recognized accounts. there are flexible spending accounts, health savings accounts, health reimbursement accounts, and medical savings accounts. that provides a veneer of confusion here. but the percentage of these dollars are toward health and savings accounts. supervisor campos's legislation would not have an impact on that subset that goes to health and savings accounts. by law in definition, they have precisely the features that the legislation is imposing upon or requiring with respect to the health reimbursement accounts. in some respects, that is a way to look at defining the expenditures in a way of changing these accounts

president o'brien: thank you. supervisor campos: great questions tonight. we certainly will be taking on your comments into consideration. the couple of points that i know are really important to trying to meet the intent of what then- supervisor amiano was trying to accomplish -- we hear from a lot of workers that this loophole is referred to as the "don't get sick in january" loophole. if you get sick in january, the money accumulated is going to be -- you start from scratch. that is one of the unintended consequences of what we have. the second thing, which is for purposes of the legislative process, is to really clarify what was said earlier, which is this notion that when the law said the employer is supposed to make reasonable health expenditures that somehow making those expenditures would not mean actually spending the money, but simply creating an account where the money sets. that was not the intent of healthy san francisco. supervisor amiano will tell you that when he wrote making the expenditures, the

president o'brien: commissioner collide? commissioner clyde: in the hearing, it was stated that one or two are paid below the minimum wage. i believe chinatown was cited as -- in one of the studies, that one out of every two restaurant workers are actually paid below the minimum wage, so i am wondering how note you are handling a statistic like that. it is almost incomprehensible to me that so much -- such a large area or such a large industry in ethnic neighborhoods, that that could be the case. could you elaborate on how you are handling that? >> it is for the most part, played based. unfortunately, we do not have the resources to do a proactive campaign to target any particular industries or community. we do, as hillary said, we do contracts with a collaborative of community-based organizations, and our staff is multilingually and multi- cultural, and we do our own outreach also. >> are you planning to work with the department of public health on an enforcement campaign? is that something that is in discussion right now?

mark o'brien. i'm checking that you can hear me. it's nina dos santos in london. >> i'm sorry. i can't quite hear at the moment. let me try to ask you again, mark. >> breakup on the line here. >> briefly, how realistic is it to expect they'll be given the all-clear in 48 hours? >> this is going to be difficult. there's been 48,000 passengers have been inconvenienced by this. they are watching closely to see if the civil aviation authority will allow the planes back into the air. it comes at the worse time possible. it's school holidays in this country. travel plans have been thrown into chaos. and everybody is waiting to see if the talks will resolve the matter by saturday. at this stage, there's no implication for that deadline to be extended. right now, there's a lot of people very confused. a lot of people very angry that this has happened to them. they've made their plans. now, that option has disappeared. a lot of people are just waiting. the best they can hope for at the moment, is a refund. but there's going to be backlogs. and everybody can get in the sky as quickly as

commissioner o'brien: commissioner kasselman? commissioner kasselman: i have a personal anecdote that is pertinent to this situation. about two weeks ago i had a friend walking in the mission district and attacked in a gang-related incident. a whole group of people that i know are now going to avoid the mission. i thank the mayor for addressing the situation. and having grown up in san francisco, it saddens me that now i know a bunch of people who won't go there. as a business owner, those businesses in that vicinity are going to lose, you know, 50 customers. if that happens elsewhere in the city, that could affect us one way or the other. i just wanted to sort of thank that from that perspective. >> thank you for that. i think that excellent reflects the mayor's thoughts on this as well that he's really interested in making sure that we have the services on the street that make san francisco our commercial districts inviting and welcoming and free of crime and with the services we need for homeless individuals, and all of those

president o'brien: thank you. supervisor campos: if i may call for a very brief presentation -- brendan munos conducted a study for the office of labor standards. he was part of the program of professional education at the goldman school. >> members of the commission, my name is brenda munos. we are a federal agency. but i am not here representing gao today. my testimony is based on a study that i conducted at the goldman school of public policy. they were interested in learning more about how various health reimbursement accounts worked. the difference supreme and health reimbursement account, held savings account, etc. -- the difference between a health reimbursement account, a health savings account, etc. what i learned during the study is that typically sell for reimbursement accounts have been used -- health reimbursement accounts are high-deductible health plans offered in tandem with spending accounts for the most part used as incentives to recruit employees or keep employees, given that health care premium
