. >> reporter: mike o'neil, a civil attorney in center city is not involved in this lawsuit with state, but has litigated many insurance coverage cases. he explains it's to the unreasonable that an insurance company might have that kind of exclusion in its policies with schools, church, or other institutions, but the fact that this exclusion with penn state only lasted until 1999 raises questions. >> what's interesting and what the court notes is that in 1999, forward, this exclusion did not exist within the policies for penn state. it also coincides with mr. sandusky leaving the employee of penn state university. the judge et writes it is interesting, although a coincidence that the abuse or molestation exclusion ceased to be employed in the company policies the same year that sandusky retired from psu. now, again, we'd be guessing why it happened, but it certainly, as court noted, interesting that from 1999 forward they stopped using the exclusion within their policies. >> reporter: i did reach out to the insurance company covering penn state. they did not want to comment. if the law
