>> well, there were five other sexual harassment settlements involving bill o'reilly. this is the sixth. it's by far the largest, if you buy the number. o'reilly's camp has not confirmed that number, but if you buy "the new york times" reporting, it's twice as much, more than twice as much than all of the other previous five settlements involving o'reilly. and a complaintant. o'reilly paid three of those settlements, fox news itself paid three of those settlements, but this is far and away the biggest. and that's what got everybody's attention, the size of this. >> yeah, yeah. speaking of bill o'reilly's camp, his lawyer is calling this entire report a smear that ignores evidence that is based on unsubstantiated allegations and anonymous sources, either incomplete, leaked, or stolen documents. i know, paul, you spoke with o'reilly himself after the report came out. what did he tell you? >> first, he said he settled to stop a long, torturous process of going to court, embarrassing his family, putting up with the headlines that would inevitably result by going to court.

what did bill o'reilly do to bill o'reilly? fox news knew about all these sexual harassment settlements and kept him employed for so long. but maybe they were just trying to protect their female employees. if bill's on camera, that's one hour a day they knew he's not groping anybody. ( applause ) yea! no groping! ( piano riff ) and fox defended keeping uncle bill on the payroll, saying that they "regarded the settlement ... as a personal issue." yes, whoever o'reilly harasses and then pays off in his personal time is his own business. it's a matter between one consenting adult... ( laughter ) ( applause ) and then, when fox did fire o'reilly in april, they said it was because they'd included a clause in his contract "that allowed for his dismissal if new allegations or other relevant information arose." yes, it's like the old saying goes: fool me once, shame on you. fool me twice, some more shame. fool me three times, you really got a do a better job of fooling me. four times, we're extending your contract. five times, we wish

o'reilly has denied wrongdoing. joining me now sarah ellison.l correspondent for "vanity fair" who wrote an expose on fox news and she's also an auth are on of woet war at the wall street journal," cnn politics, media and business reporter. okay, sarah. so when you hear this and we learn $32 million payout in january, what does that tell you? >> well, $32 million is an enormous amount of money, it's a stunning figure and people have pointed out that o.j. simpson paid more than that in a civil suit for two lives. so something really terrible had to happen. you were also paying for in this suit, the destruction of documents because as we learned in the times story and from the affidavit that they were going to destroy the terms and settlement were to destroy all sort of tapes or other supporting material, and so i think that the question now that faces the company and bill o'reilly is that this was something -- that was happening when the company was supposed to be cleaning itself up and to me the big question with this investigation that you talk
