one was obamacare that was sent over to the senate and the senate on the promise that obamacare passed and the votes that was necessary to pass obamacare was generated because the senate decided they would do under a reconciliation plan would -- they sent us a reconciliation plan that altered and amended obamacare itself and in that package was a promise from the president of the united states that he would issue an executive order that would take care of the concerns of the pro-life members, pro-life democrats who wouldn't vote for obamacare as long as it funded abortion. and so the audacity of the president of the united states to take the position that he could amend legislation that passed this congress by executive order, which is not a constitutional position, mr. speaker, but that audacity was swallowed by enough people that they voted obamacare out of the house marginally, that a reconciliation package that came from the senate, squeaked out of there because of the promises that were made and came over here and was passed because of the promises that were made and the final cap

obamacare is the law of the land. it is imposed upon everyone in america, a law is to be applied to every individual in an equal fashion. i meat mean, we might sit in different categories, we might have medicare that applies differently to somebody 65 than it does to somebody 60 years old. but waivers to statutes, to entities, individuals and entities that from my standpoint it's unheard of. where that authority came from, i did not see that coming. but this administration has found out that they pushed the law that's so bad, so bad that they are granting waivers to companies, to entities, entire states like the state of maine and now we find out that one of the people who has taken credit for helping to write obamacare, the gentleman from new york, who i believe is a candidate for the mayor of new york city, now is calling for a waiver for the city of new york to obamacare. so maybe if he gets his way that won't be 1,040, it will be 1,041 waivers. that's appalling to think that you would sit in a strategy meeting and

wasn't obamacare funding in the c.r. that passed at the end of december that takes us to march 4, but here's the answer to this, there are at least 21 different components to obamacare that are beneficiaries of funding that goes into the various departments that there's no prohibition of that money from going into for being used to implement or force obamacare. at least 21 different areas. and when you look at the money that's in there, we discovered altogether the automatic appropriation is something like $4.9 billion that went into -- for the balance of this year that were automatically appropriated, that's not prohibited in this c.r. we didn't get it into h.r. 1, actually, either. but the 21 programs are there and the money is there for them. and i can roll those into the record, madam speaker, but there's another component to this that's a blanket component, and that is language in obamacare that gives the authority to the secretary of health and human services, kathleen sebelius to do intradepartmental transfers so

and i focused on this because it is at the core of the argument against obamacare. the doctrine of enumerated powers can be stated no more simply than this. if you want to limit power don't give it in the first place. you see it in the very first sentence of article one, all legislative powers herein granted shall be vested into congress. by application, not all power was herein granted. look at article 1, section 8 and you will see the 18 powers that were given to congress. the power to tax, the power to borrow, the power to regulate interstate and international congress, and so forth. culminating in the 18th power, the necessary and proper clause which afforded congress means to secure those other ends or powers. and then you look at the last document from the founding period, the 10th amendment, and you see this doctrine of enumerated powers made express, the powers not delegated to the united states by the constitution nor prohibited by the states are reserved to the states respectively, or to the people. in other words, the constitution establishes a government

say congressional republicans should take a hard line on government spending and all funding for obamacare this year. would you let the government shut down? would you refuse to increase the debt limit in order to push those two objectives? >> i would try to create a circumstance where the president had a choice. and the president either had to agree to some very substantial changes, or the president would have to bear a fair amount of responsibility. i think people in the city must understand the 1995 shutdown. republicans came out of that and for the first time since 1928 were re-elected. we stood for something. we stood for balancing the budget, reforming welfare and cutting taxes. all i say to republicans today you bet every figure out what you're prepared to do so people believe you are serious or you will end up caving to whatever obama wants. that would be a disaster. >> chris: a government shutdown and refusing the debt limit you'd go to both? >> if the choice is cave in to obama and allow obama to dictate the terms gor to the country and say this is how serious this is, they are f

if you look at the thousands of pages of bills in the obamacare bill, it is one small part that happens to be popular. well, if it is popular then you can pass it to the states. we do not need to do it here and it is not a justification for a government takeover of the health care system. i was just as south carolina and talking to an insurance company down there. they told me that almost 80% of the plans that they would offer would have to be -- the benefits would be increased under obamacare. so driving up costs to everyone. why? because the federal government says that this is the interest policy should have had a minimum. so there is no personalization or customization or individualization. again, as more people in washington think that they can plan better than you can decide for yourself. and that is the wrong approach. but if you do not help health insurance, your emergency room becomes your primary physician and that increases costs. >> will that has not been the case in massachusetts where they instituted an individual mandate. emergency room visits actually went up, not down.

on -- obamacare. on february 14, the i.r.s. submitted to congress its fiscal year 2012 budget request. the health care bill is mentioned by i.r.s. more than 250 times. the agency, that is to say i.r.s., will have to hire thousands of new workers to implement the many new tax provisions. as the request noted, the health care law -- i'm quoting now -- presents a major challenge for the i.r.s. it represents the largest set of tax law changes in 20 years with more than 40 provisions to amend the tax laws. end of quote. mr. president, just to remind my colleagues and our constituents throughout this country, that the health care law has more than 40 provisions, the largest set of tax law changes in 20 years. february 22, of this year, a clinton-appointed federal judge ruled that obamakaye is constitutional because it allows the court to regulate what is called mental activity. so much for keeping your thoughts to yourself. on march 3, 2011, at the request of the obama administration, a federal judge -- the federal judge who had prev

we passed h.r. 2, the bill that repeals obamacare. we defunded obamacare in its entirety, including the 1 -- $105 billion of pre-approved spending. we shouldn't stop until obamacare is completely defunded. the house is working on legislation that will eliminate that mandatory slush fund and i hope we'll vote on that in the upcoming weeks. but it's time for the senate to act. america wants real spending reform so that we can give businesses large and small the confidence they need, the predictability they need and go about the business of creating jobs that will grow our economy. it's time for the white house and the senate to listen. house republicans can only do so much. we only have control of one half of one-third of the government. and so we cannot act by ourselves. it's past time for the senate to act. over the next three weeks, we'll be waiting and we'll be watching to negotiate a long-term solution that will get us out of this mess that they left us in when they concluded last year. thank you, mr. president. and i yield back th
