so how did obamacare end up back at the supreme court? a lower court ruled the law's individual mandate was unconstitutional. the mandate requires you to carry health insurance or pay a fine. but when republicans passed their tax bill in 2017 it repealed the financial penalty but not the mandate itself. so a group of republican attorneys general led by texas and backed by the trump administration used this legal limbo to challenge obamacare altogether. their argument is if the penalty is no longer required,then the mandate should be unconstitutional. and if the mandate is unconstitutional then the entire aca should be unconstitutional. a recent kaiser family foundation poll found popularity for the aca is the highest its ever been since it became the law a decade ago. 55 percent of americans now support it. >> when we return, a job with perks outta this world. breathe freely fast, with vicks sinex. my congestion's gone. i can breathe again! ahhhh! i can breathe again! ughh! vicks sinex. breathe on. where's the truck? he's a systems what?e

. >> all of obamacare, potentially. this is an enormous case. the third time, as people will remember, that the supreme court is dealing with obamacare. as in the previous cases, the court has a lot of options. the lower court here, the district court in texas, said all of obamacare was unconstitutional. as a result of the fact that the way the law had evolved, it had become unconstitutional. it wasn't unconstitutional in its original state because the court upheld it. but as the case has now moved first to the appeals court and the supreme court, the supreme court has a menu of options, but it includes getting rid of everything. you know, protection for pre-existing conditions, keeping your kids on your health insurance through age 25. lifetime caps on how much -- you know, how much insurance will pay for you. the elimination of that. all of that could be eliminated if the administration's argument succeeds. and that's what makes this politically so incendiary given the timing. >> specifically the appeals court said that because the individual

sara, what does this case mean for the future of obamacare?er: the court is going to weigh in and perhaps alleviate some of the uncertainty around the future of this law, but they did it in an interesting way. they declined previous efforts to expedite a ruling, essentially, on the future of this law. they decided to take this one, which is something they would take up next term, which begins in october, and it likely wouldn't be decided until the presidential election is over. but it could actually be a good sign, kate, for defenders of the affordable care act. it was california and democratic-led states that went to the supreme court and were pressing them to expedite this decision making. they wanted it to be done this term. that will not be happening. it will be taken up next term, but it does suggest there are justices on this court who want to deal with the uncertainty around this law, who know how difficult it is to have that uncertainty still out there. kate, this is a law that affects millions of people, and we should be clear, this l
