the second matter is about the director of occ's report from last week. i made a comment at that time, the director was allowed to respond and i was not given an opportunity to respond. i like to reiterate and show this chart on the overhead here, my figures still work. there were 52 complaint sustained, 15.7%. in 2010, there was one complaint sustained out of 294. that is not as was stated previously, it is .3%. again, if you look at it, 53 total complaints sustained in both years, 640 resolved comes out to the figure that the occ director gave, 8%. that was my comment. maybe the reason people are not participating is because in 2010, of all of the resolve complaints, only one was sustained. so what are we supposed to get from that? 293 citizens decided to go through the process for no reason at all? or is it that the officers involved are so perfect that less than 1% or a total of 99.7% were found to be not at fault. he allowed the occ director to make some comments that refuted what i was trying to express. i had to wait until the pauling week in general public comment to show the statistics and how i came up with them, and to clarify the fact that i believed what i had originally said was true, that in 2010 the cases that were resolved -- there was one sustained. there were a number of others, 53 -- 52 there were actually sustained that were filed in 2009, and we came to the same statistics -- 8.1%, which was the same the director had said for the 2010 year. but we are still stuck with the fact that less than one-third of 1% were actually sustained of complaints filed in 2010 and dissolved in 2010. what i am trying to say generally is that it seems convenient to say, "there are the rules. we do not respond." however, if you're going to respond to someone -- i am not going to say you can't. the sunshine report says members of the commission have every right to do so. what i am saying is what i said at the time. if i am going to get up and make public comment and someone else is going to

i know the occ opposed that and i wonder if you might just expand a little bit on that. and i really appreciate your input. >> well, if i could, if i could review the history of that. this is something where a number of members of the industry came to us late last year in anticipatetion of the new accounting rules. that changed the accounting treatment for securitized assets and made it much tougher to get what we call true saling accounting. since we have had a safe harbor that determined whether we would try to claw assets back that have been securitized if the bank fails and we had relied on achieving true sale accounting to provide for that safe harbor. the concern was that securitizations no longer meet the true sales standards under the new accounting rule, so we provided some temporary safe harbor relief provided for everybody going back. but going forward, we thought given all the problems, the incentives for lax funding, the losseses that had been created for banks, the problems we're seeing with resolution activity with failed banks, that we should impose some
