the occ has a 35 member staff. the majority of the occ staff is investigators and the balance of staff consist of attorneys, technical and support staff. what do we do? we conduct investigations to find out what happened. we follow the evidence, we interview individuals. the individual who brought the complaint, the involved police officers and civilian witnesses. we also have subpoena power to compel testimony and obtain evidence. we obtain additional evidence from the police department and we may take photographs of places or persons. we aim to complete our investigations within nine months and with limited exception we must complete our investigation within a year. when we complete an investigation, we make a finding of whether the complaint of officer violated any police department rules or local state or federal laws. the standard of proof used by the occ is the preponderance of the evidence. that means, the probability that the complaint of conduct occurred is more likely than not. that is the probability is

i will comment tonight, this is completely occ centric. it's about this case load and their this and that. i have received four prior years. there is absolutely nothing to tell how citizens who file a complaint with the occ feel they were treated or what they experience. in other words, it's all focused on what the occ things and as far as the people who participate in the using the occ, there is nothing and i can tell you after my experience in 2007 and after talking about numerous times about this year, i would never see a reason to file a complaint with them unless i needed to file a case in court. it's a pointless exercise. nothing but frustration and done in a star chamber atmosphere where you are not allowed to know anything especially the officer can say anything in here talk with the investigator and you are not evenen titled to know what they said. so far i see this as nothing of a village on paper. going forward i will combine the information from this report with others and my own experiences interacting with those at o cc and t

when i first started with the occ in 2007, the occ was receiving over a thousand complaints a year. the number of complaints we received last year, 746, represents a 6 percent reduction in complaints we received in 2011, when we received 784 complaints. last year we received -- 6 percent of the cases we closed. we found proper conduct and 4 percent were unfounded. the largest allegations were received were for unwarranted action and discredit 29 percent. unnecessary force comprised 9 percent of the allegations we received but did not sustain any allegation of unnecessary force last year. approximately 26 percent of the complaint ants were african americans, caucasian 33 percent of the complaints. the others declined to state their race. latinos at 12 percent, native americans and pacific islandser at 1 percent and 3 percent others. the occ is located on the 7th floor of vanes avenue. we are accessible by public transportation and receive walk in complaints on weekdays. we also receive complaints by telephone, e-mail and fax and we have an answering service for after hour complaints.

i would like to thank the department, occ and all of the other parties in crafting this. i know it's a long time coming. i think i asked about this at least a dozen times so i am excited to finally see it and i can see why it took so long. there is a delicate balance protecting pedestrians and protecting the officer and address any public safety concerns especially with the driver of the vehicle that might be wanted for something so i appreciate that. i think it's well done and i notice the way it's written and that word "balance" throughout and a consideration of the different factors that we just listed out and motorists and pedestrians and peace officers and protecting the public and i want to highlight something i think was helpful is the provision of contacting supervisors and keeping supervisors in the loop whenever possible and especially when it am cans to a vehicle pursuit there are many things to balance it's important to have someone with that level of seniority to supervisor and know what is going on with the exception of some rare circumstances it makes a lot

they're not likely to call occ to make a complaint. i think anything that relies purely on occ complaints or some other kind of data will be misleading. we are grateful to have this partnership. it is not often that legal services organizations get to regularly meet with law enforcement and learn about their experience. i really appreciate officer hall who is also in eric chang's position; our organization has been involved with this commission for six years. while we have made lots of progress distilled is appointed that on a regular basis, almost every day, i will talk to someone who said that they did not know that they could have an interpreter. they were not offered an interpreter. they did not even get to speak to the police officer on the scene because there was no interpreter or they have to wait an hour or something along those lines and when you think about for survivor, even if they know they will get to have an interpreter, if they have to wait whether an hour or 45 minutes and during that time the officer is talking probab
