the occ has a 35 member staff. the majority of the occ staff is investigators and the balance of staff consist of attorneys, technical and support staff. what do we do? we conduct investigations to find out what happened. we follow the evidence, we interview individuals. the individual who brought the complaint, the involved police officers and civilian witnesses. we also have subpoena power to compel testimony and obtain evidence. we obtain additional evidence from the police department and we may take photographs of places or persons. we aim to complete our investigations within nine months and with limited exception we must complete our investigation within a year. when we complete an investigation, we make a finding of whether the complaint of officer violated any police department rules or local state or federal laws. the standard of proof used by the occ is the preponderance of the evidence. that means, the probability that the complaint of conduct occurred is more likely than not. that is the probability is

when i first started with the occ in 2007, the occ was receiving over a thousand complaints a year. the number of complaints we received last year, 746, represents a 6 percent reduction in complaints we received in 2011, when we received 784 complaints. last year we received -- 6 percent of the cases we closed. we found proper conduct and 4 percent were unfounded. the largest allegations were received were for unwarranted action and discredit 29 percent. unnecessary force comprised 9 percent of the allegations we received but did not sustain any allegation of unnecessary force last year. approximately 26 percent of the complaint ants were african americans, caucasian 33 percent of the complaints. the others declined to state their race. latinos at 12 percent, native americans and pacific islandser at 1 percent and 3 percent others. the occ is located on the 7th floor of vanes avenue. we are accessible by public transportation and receive walk in complaints on weekdays. we also receive complaints by telephone, e-mail and fax and we have an answering service for after hour complaints.

sandra marion, from occ, to talk about language access. ms. marion? >> good evening. commissioners, director - members of the public and command staff and police officers. i'm excited to be here and have the opportunity to talk about the work that many organizations, departments and commissions in collaboration with the police department on language access. i work for the office of citizen complaints, in agency that provides civilian oversight of the police department. i will start our presentation giving a little history and identify some of the projects working on. there are other members of the group here, cheaf beal, officer chang, language liaison, -- a member of the working group. he will talk some of the challenges that lap, domestic violence victims face and lastly beverly -- will make concluding remarks. she is also another vital member of our organization or our working group. a little bit of the history. six years ago a number of representatives from 22 organizations can together to work with the police department to write language access policy. we came to

they're not likely to call occ to make a complaint. i think anything that relies purely on occ complaints or some other kind of data will be misleading. we are grateful to have this partnership. it is not often that legal services organizations get to regularly meet with law enforcement and learn about their experience. i really appreciate officer hall who is also in eric chang's position; our organization has been involved with this commission for six years. while we have made lots of progress distilled is appointed that on a regular basis, almost every day, i will talk to someone who said that they did not know that they could have an interpreter. they were not offered an interpreter. they did not even get to speak to the police officer on the scene because there was no interpreter or they have to wait an hour or something along those lines and when you think about for survivor, even if they know they will get to have an interpreter, if they have to wait whether an hour or 45 minutes and during that time the officer is talking probab

>> the occ policy. >> thank you. i want to under score a few things because this say document we have all worked on for several years and the commission was asking what are some of the fundamental changes and in ways that i think the department might not emphasize some of those changes because in part ultimately we all feel proud of it being a clearer document and including much more mandatory language and i wanted to highlight on page three the definition of a pursuit or when it's authorized it looks at -- there needs to be -- there is a subspigz of violent felony so it's narrowing the incidents that would give rise to a pursuit so the individual expected of a violent felony and the person apprehended is oppose a risk to the public and if you look at the 1997 policy versus this there is much more clarity to what nature would give rise to a pursuit and i want to under score some of the policies from the 1997 policy we wanted to make sure that the control is placed in the hands of the supervisor who is not at the scen

at the bank blithe masters, but i want to assure you fox business reachedded out and spoken to the occtroller of the currency as well as the federal rereceiver bank of new york. they will not discuss any of the pat matter os record or issue statements as to the dealings with jpmorgan chase, but video at the center of this are the reports in the new york times as well as dow jones news wire that the occ and fed met with managers of the bank and said, essentially, they don't trust management at jp jr. mongan trace with the regulatory commission's wells notice saying managers at the bank including the chief the commodities, blithe masters, misrepresented prices of electricity contracts in california and michigan resulting in over payments, and that other traders with mismasters made false representation under oath. we got a statement at fox business from j pmorgan chase regarding that issue. the bank say, quote, we strongly dispute that blithe masters or any employee lied or acted inappropriately in this matter. we intend to vigorously defend the firm and the employees in this matter, but
