the officer explained he was an off-duty officer. the officer began to open the gate and the male immediately charged the officer forcing opened the gate and hit the officer on the head with a rock. the officer attempted to block the strikes using his left hand which was holding a flashlight. the officer was unable to create time and distance because the male was holding on to his shirt, pulling him closer preventing him from leaving. in order to prevent great bodily injury or death from the rock, the officer discharged his weapon twice at the male. the male ran out of the complex and fell to the ground. medical aid was rendered to the male by the medics and he was transported to the hospital for his injuries. the incident was criminally along with the contra costa county district attorney's office and an administration investigation was determined by the internal affairs commission. a recommendation to the police regarding this officer-involved shooting was in policy. in-custody deaths review board did not have a case presented in t
