i do think it was more thorough ofn we normally see in terms the level of detail in the discussion of the analysis. but i think one point where diana and i certainly agree is this case is about fundamentally the application of those leverage theories. not about their viability in future cases. i do not think there is anything controversial about the theories themselves, but their application here in my view, and i think clearly the judge's view, were not substantiated by the fact that the doj put in front of the judge. there may be cases later, a vertical merger challenge in the future where the government puts forth different evidence. i do think one implication of the decision is clearly the doj or the ftc or whomever is contemplating a vertical merger challenge. they will read this opinion then say, if we plan on arguing the same style of leverage foreclosure theory, or we plan to embed a bargaining model within our economic argument, you are going to be very careful of the inputs we put into the model. much of the judges opinion reject the inputs in the model. they suggest some sl
