it will make it more difficult for de oliveira to flip. if they're taking every opportunity a day here, couple days here, a week here, that's going to add up and make it difficult for the doj to get this trial done by may. >> if you're the new defendant and you're now seeing the inside of the federal courtroom, are you thinking of cooperating with the doj, or has that ship already sailed? >> well, the ship hasn't sailed, but they're pulling up the anchor and getting ready to go. it's not optimal to try to cooperate af you've been indicted, but it's also not impossible. what it would require is for mr. de oliveira to decide he's going to part ways with the former president and to negotiate with doj to broker some sort of a deal which would require him to plea to some lesser charge or one of the charges on the indictment. he would have to provide witness testimony and evidence and testify at trial, those sorts of things. now, he's already hurt his opportunity to do that by being caught lying by the fbi. so, one of the charges against him is

de oliveira be in this case? >> well, willie, the appearance yesterday was rather routine, which they often are. we did learn he has not yet secured a lawyer, which means his arraignment will have to be delayed until that can happen. i think that it does build in the possibility of more delay in the ultimate trial date, that may 20th trial date. the longer it takes for him to get a lawyer, i imagine it will cause them to ask for additional time. i don't know whether they'll get it, but i think that is a possibility. how important is he? i think he is very important. he adds to this dimension of obstruction of justice, and that is, after all, what makes this case so different from other cases involving inadvertent retention of classified documents. you know, the case with mike pence, the case with joe biden, where, upon discovery, they alerted the officials and returned the boxes. here, there was an alleged movement of boxes, where donald trump was engaged with the government over the return of the documents. inst

de oliveira has not been arraigned. the rules of criminal procedure would allow de oliveira to wave his appearance as long as he's retained permanent counsel to represent him. so if that form gets done, he will not have to appear on tuesday here in fort pierce. two, that august 25th hearing is critical. under the classified information procedures act, section three, the motion for protective order where we have seen a lot of news reporting, trump saying he wants to make mar-a-lago a skiff to be able to review the discovery in that case, that hear, will take place about the terms of that protective order on august 25th. and so in order to keep with the existing trial deadlines that have been established by judge cannon, everything needs to be done, everybody has to have counsel, it was fascinating though, quickly, when you looked at the courtroom and the seating, you saw walt nauta with his counsel, de oliveira with his current counsel and you did not see donald trump but his counsel was present in the form of todd blanc

carlos de oliveira is one of three defendants, including trump charged from the classified documentsa. walk us through what today will be like. what's the significance of him appearing in court today? >> reporter: well, poppy, good morning. so carlos de oliveira is facing several charges, including one for conspiracy of trying to obstruct justice as well as lying to federal investigators. now, the 56-year-old has yet to enter a plea in his case because he did not have a florida-based attorney. but now that he does, we expect him to plead not guilty at his arraignment later this morning to charges that he skechemed wi former president donald trump to try to delete surveillance video from trump's mar-a-lago property. that's video sought by federal investigators in the trump classified documents case. now, according to prosecutors, de oliveira asked another trump staffer, someone who works in i.t., about purging the video after federal investigators showed up at mar-a-lago to retrieve several classified documents. the indictment alleges that the 56-year-old told this i.t. staffer, quote

there was an attempt by this counsel for de oliveira, mr.ing who's not local, said can we set this over for august 25th, which is the next major hearing in this case, and the magistrate judge said no. judge cannon wants to make sure that counsel is in place as well as de oliveira being arraigned before the 25th of august. >> while i have you, i want to ask about new reporting we just got in about the judge in donald trump's d.c. federal case there, now receiving extra security. in fact, she was seen this morning with three u.s. marshals. is that typical in a high profile case? >> reporter: yeah, so it's not atypical to increase security not only for the judges but for the staff as well. just, for example, ana, here at this small federal courthouse in fort pierce, there was a number of people that appeared, many of whom were supporters of donald trump, and so you can imagine at a larger place like d.c. with the bigger courthouse there's a possibility of there being something. but right now it is not rare to be able to obtain additional securi

. >> if you are the former president, you're suddenly i guess looking at walt nauta and oliveira even closer wondering if they're going to flip as well. >> there's a greater conflict there in that most of these people are employees of trump's. they worked for one of his entities. there's the fear of retaliation that i'm sure is built in but then also wanting to get their attorneys. these can be extremely expensive retainers. we saw this in cassidy hutchinson's case. she was not able to share what she wanted to. >> that happened, we knew that de oliveira, they had gone through his phone, seized it, he had not be charged. it was when the indictment came down, we spoke to sources at the time who said tavares, who was known as employee number four, he's the it worker at the center of this, that he had spoken to investigators. then it was later we learned about woodward and the fact he had changed attorneys there. woodward is someone who represents not just people in this case. he's representing people in other investigations surrounding trump as well. he's very close and involved. i don't

would it be having that private discussion, at minimum, with de oliveira? >> at a minimum.understand that the defense will often make these ex parte requests, saying you know what, judge, if you believe you need more information to at least begin to resolve this issue, let us do it ex parte, without the prosecutors present, because we don't want to compromise any privileged information. that's often a first step, and that's appropriate. i know you say that judge cannon doesn't want to be overturned. well, it does seem like it's something of a sweet spot for her, given what the appellate court has done previously. they found she abused her discretion to the extreme benefit of donald trump, which i think continues to give people a question about whether her impartiality can be questioned, and that is the standard for recusal under the federal law. so we'll see if she begins to shape up and fly right or continues to have these kind of challenges. >> glenn kirschner and bradley moss, thank you very much for joining us tonight. >> thank you. >> coming up, they did it again. the

we assume that calor de oliveira could do the same. will? >> it's definite li their goal. it's always in a defendant's interest to plead guilty. number one, anyone who pleads guilty gets a lower sentence. anyone who cooperates with the government gets their sentence lowered even further. so we have built in a great incentive to do so. now what you have here is the drama of working for the former president, and there isn't a long record of people turning testimony against the former president. >> so this was the latest stage in the first federal indicate. of course, indict in new york, and we are expecting one -- well, one for former president trump also in georgia. all of these overlapping cases, does that help or hurt the various prosecutors? >> i think it probably hurts in a way, only on account of scheduling. any one of these matters has to happen on its own timeline. at a person point a defendant can't show the for a trial in two different jurisdictions on the same day. so at some point the judges will have to get together to discu

obviously we saw the de oliveira arraignment yesterday.veillance video now in the hands of the prosecution of trump's defense lawyers. what's your sense of what that footage actually contains? could that be damning to the former president and his codefendants? >> it could be. but we have to see exactly what is revealed at the trial if these particular charges do end up going to trial as they're charged now. so carlos de oliveira and walt nauta the other codefendant are accused along with donald trump of trying to talk about and get rid of surveillance footage. not that any surveillance footage that the trump organization had of that property was actually deleted, but they're charged with wanting to try and take steps to get rid of it because it very well may have captured them moving boxes that had federal records in them when the justice department was seeking to get those returned. and that surveillance footage, that's only one piece of the evidence. from what we can see in the indictment itself, phil and poppy, there is a description of

does mr. de oliveira have a local lawyer yet? >> as we sit here and have this conversation, the answer is no. so you know, de oliveira took a page out of the walt nauta playbook today. walt nauta, as we know, had his arraignment reset on two occasions for him to secure local counsel. there was a guy who showed up today. he's a criminal defense lawyer out of west palm beach. he represented to the court that they were this close to getting it done and that probably tomorrow he would be able to file a notice of appearance. however, despite the magistrate judge from a week and some change ago saying show up and have local counsel today for your arraignment, no local counsel was there. and to your point, you know, joy, when i practiced law for more than 20-something years in the courtrooms that i was in and i'll specifically focus on miami-dade county, there was a saying on the wall behind where the judge sat. and it said, we who labor here only seek the truth. it didn't say we who labor here only seek donald trump's truth. it didn't

so the arraignment lasted about six minutes. 56-year-old carlos de oliveira pleaded not guilty to fouro obstruct justice and lying to federal investigators. his attorney, his florida-based attorney was with him in court. and they waived the formal reading of the indictment, and they asked for a trial by jury. the 56-year-old ais being accusd of scheming with former president trump to try and delete surveillance video from trump's mar-a-lago property that was sought by investigators in the trump classified documents case. now according to prosecutors, carlos de oliveira asked another trump staffer, someone who works in i.t., about pergeing the video servers after investigators paid a visit to the property back in 2022 to retrieve these classified documents. the indictment, you might recall, alleges that the 56-year-old told i.t. staffer, quote, the boss wants the server deleted. he is facing four charges, including lying to the fbi about helping to move some of these boxes around mar-a-lago that contain these classified documents. he left the federal course courthouse here just a few mi
