olson. lots of conservatives are not big fans of morrison v. olson, but that's because long ago it held constitutional the independent counsel statute, which is totally different than the special counsel that we have today. the independent counsel statute that was created in a post-nixon era expired many years ago and structurally it was significantly different from the special counsel, which is wholly a creation of the executive branch today. the independent counsel, on the other hand, had real separation of powers controversies. >> is that the distinction? >> that's right. so once you get into the courts, for example, that's another branch of government. and then you have issues of who exactly is in control of the independent counsel? can you have this creation that lives outside of our three branches of government that has really -- it's responsible or answerable to no one. conservatives have long criticized it and it was effectively overruled, we say quietly in a 1997 case, an opinion authored by justice scalia. so i should caution people,

on morrison versus olson, a couple things at the outset.rst, that case did not involve the special counsel system. i have written repeatedly that the traditional special counsel system which we have now and have had historically is a distinct system, appointed by the attorney general. morrison has nothing to do with that. that dealt with the old statute as you said which is expired in 1999 under overwhelming consensus that statute was inappropriate. secondly, morrison, justice scalia's precedent, does not prevent the supreme court precedent that allows independent agencies to exist. those independent regulatory agencies continue to exist, of course. so both on the independent agency side, those are unaffected. on the special counsel's side, that's unaffected. you mentioned the cfpb case. that -- my decision in that case would have allowed that agency to continue operating and performing its important function for american consumers. the only correction would have been in the structure. it was unlike every other independent agency created pr
