imma i want to get to omar jiminez also in brooklyn center. i would imagine that brooklyn center, the officers must be from surrounding areas and members of the national guard there, correct? >> reporter: that's right, don. and basically what we're at right now to sort of contextualize this law enforcement response was that before the derek chauvin trial and separate from this even began, the mayor of minneapolis laid out these three phases. phase one would be when the jury selection was happening there, that lowest level of alert all the way to level three. and that would be the highest level, a level they were not prepared to go until we got to verdict deliberations in that trial. we're not there yet, yet we have now been upgraded to that level three, which now informs all of those law enforcement partners that make up what's called operation safety net here in minneapolis, which is, again, a combination of law enforcement and national guard. you're seeing that outside the brooklyn center police department. right now we saw this happening ea

omar jiminez is in the middle of it on the street. omar, the situation? as you can see they're trying to disperse this crowd. these umbrellas have been at the front line of this and represent this group that's been here after the officials here have declared it an unlawful assembly. they've got some pepper spray out that they've been getting people off of the fence with. but they've also been firing these flash bang type projectiles into this crowd, trying to get them to disperse. the numbers are smaller than they were earlier in the day, but of course this is a third night in a row of demonstrations we've seen here in brooklyn center just miles from minneapolis where the trial of derek chauvin is happening. and these tensions have boiled over for a third night in a row. as you see now officers putting more tear gas into this crowd, also more projectiles as people have been coming at this from all different directions. and i should mention this comes in very large contrast to what we saw just hours ago as they marched the precinct to fbi building. and as

cnn's omar jiminez is in minneapolis covering the trial for us. omar, walk us through the medical examiner's testimony today. it was very highly anticipated. what do you take as the big headlines? >> reporter: very high highly anticipated because the crux of the defense's argument comes down to what the actual cause of death is. during cross-examination, he said in court, the chief medical examiner, i believe heart disease and drugs played a role in george floyd's death. now, as we went further on into testimony and prosecutors were able to question him again, he clarified saying he believes those were contributing factors, not necessarily the actual causes. but then another point in this is coming down to the actual amount of drugs that was in george floyd's system. we knew that there were amounts of fentanyl, there were amounts of methamphetamine and based on past testimony, it was a low amount of methamphetamine but for fentanyl, it was 11 per millimeter. the chief medical examiner said he's seen fatal cases of overdoses when the trace amounts i

omar jiminez is "outfront." tell me what this all means. >> reporter: that's right, erin.tart, the justice department plans to ask a grand jury to indict derek chauvin on federal charges of civil rights violations, along with the three other former minneapolis police officers tied to george floyd's death. that's according to local reporting, the star tribune citing a source and the tribune also says that prosecutors intend to include a violent 2017 arrest by chauvin of a 14-year-old, where he -- where chauvin and a partner officer responded to a domestic assault call, and there seemed to be a struggle. chauvin struck this 14-year-old multiple times with his flashlight, and then put his knee on this teenager's neck until he eventually went unconscious. and that's according to documents filed by state prosecutors. now, that teenager eventually had to be taken to the hospital in 2017. but according to those same documents, the teenager said throughout the struggle, "i can't breathe" while that knee was on the neck and the mother was yelling to get off of him. that's one that
