omb watch is among those organizations that i think the government really must depend upon to give us a sense of how we're doing and how we could do it better. the last thing i'm going to just mention is technology. i think we in the federal government are looking always for how we can do disclosure and do it smarter. and doing it in a way that does not depend upon people making requests. that -- i have actually heard people suggest that foia is going to become obsolete. i just don't think that's going to happen. you really must depend upon people coming up with new things to ask for. serious demands about what the government should be disclosing in the way of information and data. we heard some good ideas from sue about that. and -- but technology is our friend, but we're i think -- that's one of our big challenges, is figuring out how to work smarter and how to work better and using technology to make particularly databases more accessible, more easily usable and user friendly. part of the few chush of -- future of foia too is the change that congress made in putting in a position -

and then i would like to know, then, how omb works with you all in paraing down and enhancing precisely how that works. >> sure the way we put the budget together is to ask our senior leadership for what their expectations are for the needs for that particular fiscal year, what legislative changes -- for example, dodd frank obviously influences the budget rather dramatically in 2012 and 2013 because of all the other week we have to do. so we ask our senior management to give us their evaluation of what resources will be necessary to fulfill their obligations, what are the risks that if we don't have sufficient resources, how will we prioritize responsibilities that we have, where can we make cuts, where can we delay certain activities, particularly in the i.t. area, if the funding isn't sufficient. the chairman under something called reorganize plan 10 at the sec has responsibility for the budget. we do share with the commissioners the justification and they -- but they don't -- we don't vote at the sec on the full commission on the budget. and then i think we work with emb much the wav

as chairman of the house budget committee in the 1980s and 1990s and then later as omb director, i had the opportunity to work on budget issues, regarding military and economic assistance to israel. one of my warmest memories is working closely as a member of congress with my dear friends naomi, lauder, she was special to me, she served as the regional director based out of san francisco, i understand her son is here and carries on her great work. as a former chairman of the house budget committee and former omb director, i have a deep appreciation for the very important role that's played by this committee in trying to achieve fiscal discipline and helping set the federal government's overall spending priorities. as you know, i had the honor of working on most of the budget summits and proposals during theary 80s and '90s with both republican and democratic presidents, president reagan, president bush and president clinton. and the work of all of those efforts ultimately produced the balanced federal budget. believe me, i know firsthand what a tough and critical job you had in this committee. particularly given the size of the deficits that you're working with that unfortunately face our country again. it is -- it is no surprise that there is a vigorous debate here in washington about what steps should be taken to confront these challenges. we went through many of the same debates in the '80s and '90s. thankfully both parties were willing to make very difficult decision that's had to be made in order to reduce the deficit. toda

so i know that omb watch has suggested that the department of justice and their next chief foia officers ask agencies to report on the steps they have taken to comply with the best practices. how ever it's done i want to hear more about the evidence about what kind of impact these things are having, but they're great ideas and i would like to see them be more widely adopted. and the third activity that i'll highlight is ogis' role in the foia portal, which is an incredibly important project that is underway now, led by epa and with the commerce department currently participating to build the next generation of technical infrastructure for foia requesters as well as for foia professionals. in a way that scales across the government, has shared services, efficiencies, and improves customer service. we release so much information through the foia process, but in far too many cases it's still on an individual basis. you requested this, you get it and nobody else receives that information. in the 21st century that's silly. we need to scale up the way that information is released. foia is a ha

congratulations, leon, for continuing to exceed expectations of omb directors. i heard your testimony, that it creates risks, the $487 billion. you also said these are acceptable risks. how do you describe those risks that would be entailed should we move forward with this sequester as currently planned? >> they would be devastating, because the cuts would be made, as you know, according to the formula across the board. it would come out of force structure, it would come out of readiness, it would come out of, i assume, compensation would be on the table as well. it would come out of every area of the defense budget. the danger is that when you do it that way, you automatically hollow out the force. what you are doing is you are weakening every area of the defense budget by some kind of blind formula. even though we will have a smaller force structure as a result of those cuts, we will be ill-equiped, ill-trained, and ill-prepared -- >> mr. secretary, when do you need to start making the changes? january 1 next year is when the the sequester goes into effect? wh

as we have consulted with tribes, we have received some targets by omb to craft a budget which helps us figure out what our true priorities are. we had to go through exercises where we looked at 10% reduction and then 7% reduction. even at the level we are now in this proposal where it is 2/10 of 1% reduction it is very painful. we try to make the priority of the tribes. we are streamlining. we're going after management efficiencies. it is painful for the federal government. we have a trust responsibility to fulfil. we have some feeling about how painful it would be to have to undergo additional cuts in the budget. i am just open that things can be worked through the congress so the sequestration does not automatically trigger. we are down to trying to solve problems that are very significant in indian country with a constrained budget already. >> thank you very much. i have further questions that i will submit for the record. are there any further questions? i want to thank you so much for this panel, for your responses. we want to do the best that we can. streamlining, of course, i

of course, there were a lot of folks who said and later as omb director, regan's policies have nothing to do with it. it as matter of fact, the deficit is mushrooming and we made all this terrible cuts that are going to hurt us in the fewure and mondale went out there and said you may think things are good but actually the president's policies are terrible and going to bring disaster and they called us gloom and doom democrats and to some extent they were right. that is the challenge. it is between optimism and pessimism, optimism always works. if people are feeling like the economy is getting better, hope is on the rise, we are moving in the right direction, for romney to come out and say oh, no, it is much worse than you think makes him the bearer of gloom and doom. >> and for the president, though, he can't count on the trends continuing. there are economists out there who expect that the unemployment rate might tick up a little bit over the next couple of months. he can't put all of his eggs in this basket of things looking like they are improving slightly when it comes to the econ
