cal osha is deciding post pandemic rules so. joining to us talk about what's being considered what your employer can demand and what your rights are is california attorney angela wright. the meeting is still going on. the thing getting the biggest attention is wearing masks. when can people did maskless and when can't they? >> cal osha will probably say employers can require employees still to mask when they're at work. ultimately employers have a duty to ensure that all employees are safe and that they create a healthy work environment. in fact, if they don't, current worker compensation rules state that if an employee contracts covid, not necessarily while at work but during the time they're physically at work, that that employer can be held responsible and presumed that the employee contracted covid while at work. so masking will be super important and looks like cal osha will extend it at left until the end of the year. >> so we've been used to the message, though, right, if you're fully vaccinated, do what makes you comfort

within the past hour cal osha issuing new guidelines, 30 pages. the agency that oversees workplace safety quietly posting on its website around 6:15 this updated guidance. it appears to match the state's rules meaning workers would have to be vaccinated. if not vaccinated you got to mask up. beginning tuesday, june 15. if you're fully vaccinated there is no more need to wear masks indoors including places like a grocery store, trader joe's, safeway, whatever. a restaurant or your hair salon. if you're not vaccinated you'll still be required to keep your mask on in all of those places. of course there are all sorts of caveats here. there are some places you still have to mask up no matter your vaccination status. if you are vaccinated or not. that includes public transportation, bart, buses, airport, sfo, and health care facilities like hospitals and at schools. these different scenarios are frustrating a lot of business owners. it is going to be up to them so the onus is on the businesses to verify your vaccine status as a worker or customer. a lo

the new cal osha rules for covid-19 call for an end to wearing masks indoors. but only if employers can verify that everyone in the workplace is fully vaccinated. that would make the rules for california workplaces more strict than for the general public wants the state reopens june 15th under the cal osha proposal, if just one person in the work area is unvaccinated, they'd have to be separate from the group or everyone on the job would need to wear a mask. employers should not be compelled to track vaccination status and create two classes of people as the only way to comply with these rules. one of our members is considering placing stickers on id badges to determine who was vaccinated and who is not. many are considering korean separate floors. people might challenge it, but i think the cal osha would. would be on pretty firm grounds. in doing this, legal experts say the strict requirements would protect unvaccinated workers and may encourage people to finally get their vaccine. if you see the tangible benefit. uh that the people can go out and resume their

we're awaiting the decision from cal osha. joining us this evening one of the top covid specialists in the country. as we wait on this cal osha decision indoor workers can only take their mask off if every single person is vaccinated, that seems way too strict and way too hard to legislate. what are your thoughts from the medical point of view? >> i agree with you, raj. right now where we are in the bay area having such a strict rule is probably a little bit too severe. even if one person isn't vaccinated in a closed loop situation like an office situation that person isn't going to really acquire or transmit covid. but in an open loop situation where it's hard to verify individuals like in stores, groceries, that may be a little bit warranted. but, again, it's going to be tough to enforce, and it'll be important to see where things go in terms of cal osha guidance. >> okay, and we're awaiting that decision. let's also bring in one of your esteemed colleagues also from usf. both of you two of the leading covid doctors in the c

osha's standards boards are recognizing everyone be allowed to take off their mask inside of the office as long as everyone is vaccinated and show no symptoms of covid-19. and people who work at outside mega events, with over 10,000 places in attendance, places like theme parks, those people would not have to wear a mask regardless much their vaccination status as long as they're outdoors. indoors they theme park, the matching comes back on for employees if some of the employees are not vaccinated. this means people who work inside at restaurants, retail or other businesses that have direct interaction with the public will still have to keep their masks on, regardless of whether or not they received their shots. >> you don't really know who you're going to encounter in that customer facing business or restaurant or store, which is different from a closed loop office environment, because in that situation, i think, cal osha does say it's okay for people to take off their mask if they're vaccinated in a small group. >> cal osha is also recommending that businesses be allowed to eliminate
