president chiu: after our last hearing on overtime, given the threshold of 30% overtime trigger for our part of human- resources needs to sign off on this, i proposed we reduce that to 20% so that we know exactly how many folks are working at a higher level of overtime. do you have any idea of how many of your workers would fall into that category? >> i want to make sure i understand your question. in terms of categories, we would have a couple of groups such as service inspectors -- there are employees who manage the service on the street. there are people in the control center where we've run a 24/7 operation that would be in that category. there are some station agents also who have built up a lot of overtime because we want to cover all the stations and have been using overtime to cover overall reductions in the staff. those are three examples and we can provide a very precise lists based on -- because we certainly know where overtime is going and who is using it and for a reason. president chiu: i think there is often a perception with my constituents that there are muni drivers an

the board is receiving monthly overtime reports and their drilling down on these overtime areas. we are also working to schedule -- working to manage unscheduled absences. that increases over time needs. we have significant issues with unscheduled absences for a variety of reasons. we are trying to drill down and look at those areas. as i mentioned, we are looking at our scheduled practice and contractual requirements. for example, we are able to implement part time operators that we would see some reduction in over time because there is over time where we could staff the peak time schedule as well as local 6. when the contract comes up next, we would be looking to break away from the city in terms of our needs there. a lot of the overtime is driven not by contractual requirements and scheduled practices of the transit system. the other question we are trying to get our arms around is what is the sweet spot for overtime? what does -- where does overtime costs outweigh the benefits? in the service model of muni, there's always going to be over time, but what is an acceptable level

what is actually driving the overtime and why does the mta and muni have so much overtime? as we are looking at over time usage, muni has been a number one overtime user in the department. there are multiple reasons, but one of the biggest issues is we use over time as a tool to manage service delivery built into our over time -- supervisor campos: i would simply ask members of the audience -- there is no speaking because we're trying to listen to the presentation. out of respect for the people who are presenting and to the process, you will have an opportunity to speak when the item you are here for comes up. we simply ask you to please make sure we can listen to the presentation. >> john haley can speak to this a little bit more, but the overtime and to the runs -- especially during peak times as our service during peak times -- we use that to mitigate service and to -- as a tool for day-to- day service delivery. the lack of part-time operators presents scheduling challenges and we are looking to include them in the negotiations because of our peak. schedule. we're having

>> in terms of operator overtime on a daily basis, one of the buckets of overtime is what we fill -- runs with we fill with overtime, we put out 1,174 all together. some of that is not having enough operators and part of it is the question raised earlier about part of -- part of that is catching up, the system catching up with the people that left, the attrition rate, stopping of hiring a couple of years ago, to catch up on the hiring and training. the other part of it is work force management. on a typical day right now we're pushing on the range, 15% has gone to 20% of people that are scheduled to work that are unavailable for a range of reasons. the biggest reason is use of fmla across the system but there are some other reasons as well. so part of what we have to do is work with everyone to attack those problems. >> right but narrowly, what percentage on a daily basis of overtime is related to your shortage of operators? just the sheer shortage of operators? >> right now it's, of that 70 runs you have, in the range of 15 to 20 on the rail side that have been related directy to --

staffing, overtime and set asides. why is it that certain departments, whether they're big or small, seem to manage their staffing and anticipate turnover in staff and house traping so they minimize the amount of overtime whereas other departments, fire, police, sheriff and m.t.a. in particular, seem to continue to use overtime even when they know that people are going to retire or trade out and they can anticipate those hiring and training needs? and the other concern was about with set asides. this is in particular to mayor lee and the supervisors. are you willing to consider a charter amendment for november, to look at our set asides, even though we've all voted for those things to cut back at least to some degree on all of those things like libraries, children's fund, city services auditor, there are a lot of funds that we've set aside which, as you talked about, reduce our budget flexibility in these difficult times. are you willing to take those issues on? thank you. >> i'm the mayor's budget director. as you kno

that was not planned in terms of our actual operation and budgeting for overtime. that is just one example. there is clearly a special event that occurs on an annual basis. we know exactly what those are, situations. just as sunday where we dealt with bay to breakers, there was a unique situation because it was the 100-year anniversary, and we expected a great deal more participation. to that end, i think we would much rather overreact in terms of dealing with these particular situations and making sure we have enough personnel to handle them safely so everyone can enjoy those events, rather than managing to an edict or managing to a budget. the overtime situation for this agency from an edict standpoint could be solved tomorrow. we could make a decision not to use overtime and stay within our budget limits, but i think that would be an unsafe situation. it would clearly have negative impact in terms of our operation and had a negative impact in terms of our writers and the public in general -- of inriders and the public in general. we may come in under budget this
