good morning, craig. >> reporter: good morning, pam. everybody knows the more lighting you have the safer you feel and are. a few years ago the legislator passed a bill it's a law that cut down on the amount of light tais used on city streets. it's supposed to save energy. lighting like at this gas station here at west grand and market. no longer on the streets of oakland, more places, see the lighting here, you can see, but it's still a little bit dark and that's what has led to a problem out here. there is a local minister who wants to get an exemption from the law. he says there is too much crime and people can be identified here but not as well. the man who runs the church down here in west oakland at grand avenue and market wants the exception from the law, one reason is the increase in crime. an example a 25% increase in homicides this year over last so far. there are other reasons for the increase. the bad economy is just one, we are getting started this morning, we will try to speak with the minister about what his problem is at

reporter: good morning, pam. yes, information still coming in, police still hesitant to release a lot of this information because it's very sensitive because of the victims. but right now that officer is here at the santa clara county jail. it's 44-year-old patrick d' aribo and he's accused of having sex with two teenaged boys. apparently this investigation started a couple of years ago back in april of 2009 when investigators started getting reports that he was having parties at his home with alcohol and minors. apparently recently a witness came forward and he was arrested yesterday in gilroy after a grand jury indicted him. he is scheduled to be arraigned and police say this investigation is not over. >> we have concerns there may be other victims out there, either in san jose or gil roy. we don't have any specific information to lead us to believe that we are, but anytime you have a crime involving minors, that's a concern. >>> a contra costa county amusement park worker is under investigation this morning, a

reporter: well, good morning, pam. yes, the santa clara county jail has now confirmed for us that san jose police officer patrick d'arrigo is free at this hour. he did post bail from here at the main jail in san jose at 1:42 this morning and was released. d'arrigo was booked yesterday on three charges involving two teenaged boys in an investigation that apparently had been under way for a couple of years. gilroy police heading up that investigation, but because d'arrigo is an officer with san jose, the san jose police department internal affairs division was also involved. now, according to the mercury news, the charges involve a 15- year-old boy and a 17-year-old boy and came after reports of alcohol and minors at the officer's gilroy home. he was arrested yesterday afternoon, but this is not the first time he's been in trouble. >> patrick d'arrigo was a patrol officer from 1994, he was terminated at one point for a botched dui investigation that was in the media. he was reinstated after his decision, his termination

it's 4:30 let's go back to pam. >>> it was a bad night for bart. san francisco police are searching for the vandals that caused major damage to the glen park station. ktvu tara moriarty is at the scene with details on when it happened. good morning, tara. >> reporter: good morning. if you take a look at the wall it appears that vandals started to spray paint the word oscar grant but then rushed off. most of the damage is inside. it happened around just before 10:00 last night when 20-30 people rushed into the glen park station dressed in hoodies and armed with hammers. they smashed two ticket vending machines, all seven clipper card reefers. they were part of a splinter group from that earlier protest. just after 5:00 last night, this was the scene at the powell street station. police eventually closed in on the demonstrators here shutting down the station for two hours and arresting 30 people. bart officials said previously they would allow protests as long as they happened in the free speech area. >> we are doing exactly what they said we could.
