hours ago near story road and janine de la vega was the first reporter on the scene and has been updating this story throughout the morning, janine. >> reporter: pam here and authorities say this area is known for its gang activity and it appears a fight occurred early this morning and investigators are still trying to find all the players involved. it took place 3:15 when neighbors actually called 911 after hearing gunshots and deputies did a search and found bloody clothes and gun casings but no victim. one of the men had a bullet wound behind his ear and he was taken to the hospital and investigators say two other men are being detained. all appear to be gang members which leads investigators too believe another gang is involved. >> we want this neighborhood to feel safe and it is not safe, i don't feel safe. coming out to work, i see the cops out here and i am like, wow. >>> deputies are treating the other two menace witnesses and they are trying to get a clear look at what happened. the men are between their late teens and early 20s and they are from san jose. something else they are looking into, witnesses say they heard a car speeding away

janine de la vega is there at the accident scene now with details on the crash and the victims. janine. >> reporter: pam, we are here on mission boulevard near cherry. this is an unincorporated area of hayward. and you can see there is a heavy police presence here. you are looking now at the alameda county sheriffs deputies vehicle that you can see is damaged there in the front. now what we were just told by the spokesman of the alameda county sheriffs department is that the sheriffs deputy he was traveling nobody here on mission boulevard when he hit two pedestrians. one man is dead. his body is still laying in the street with a yellow tarp covering it. the woman is at the hospital. we were told she was hit too but she is expected to be okay. we are also hearing from law enforcement. they say they believe she was intoxicated. they were apparently crossing somewhere near the crosswalk. it's unknown at this point why that sheriffs deputy if he was speeding we don't know that. the chp is handling that part of the investigation. that deputy is a nine year veteran of the department and he is back at the she

janine de la vega is in san jose to tell us how the city plans to keep them from returning. janine. >> reporter: pam, people who live in this encampment have been told they cannot come back here. we actually spoke to two men a short while ago who said they don't know where they are going. they left in a car. you can see people have been gaining access down here near coyote creek by going through the chain link fence that has been torn apart there. now let's go to video we took earlier. city officials estimate 125-175 homeless people have set up camp near coyote creek close to kelly park. it's a lot of single adults and couples as well as their pets. this is the second time the city has done a clean up here. crews were here last october and removed 50 tons of trash and debris. city officials say they are concerned about the pollution of the creek. people are driving their cars down access roads and leaving them there to reach their camp. the project manager of the cleanup says the city plans on closing off the access roads and hiring private security to prevent the homeless from coming back. work cre

janine de la vega is there in santa cruz to talk about the problems that drove city leaders to take action last night. >> reporter: pamt now it's dark so it's difficult to see all of the beach. but you know they want to stop what is happening underneath the cliffs in the distance. they say what is happening is becoming a public nuisance. now according to the santa cruz centennial the city council unlessly approved putting in a curfew at california -- at cowell beach. he discarded the needles, human waste, and trash collected in the sands and hidden in the caves. the video spurred residents to call on the city counselor to take action. cowell beach is one of the most popular in the city. the new curfew will make the dry sand off limits to the public from midnight to an hour before sunrise. the ocean and wet sand portion of the beach will remain over to the public 24 hours a day. as the morning news goes on we plan on talking to local people who use the beach as well as the nearby businesses to get reaction on this latest resolution by the city council. reporting live from santa cruz janine de la vega ktvu channel 2 mor
