pamela hayes is a former prosecutor with the brooklyn d.a.'s office and former chief of the sex crimes bureau. she currently is in private practice as a criminal defense attorney and she joins from us new york. thanks for joining us. first of all, i want to talk about the specific charges that he is now facing. what do we know about the accusations and how his attorneys are responding? >> i think one of the things that we have to do is we have to wait to hear the exact charges. i would think that there's going to be an attempted rape, there may be a sodomy charge, but there are going to be a lot of attempt. and until we can get the full story of actually what happened in the room or what he did is really speculation. but it could be as serious as a felony where he's looking at, you know, attempted rape which could possibly be a "c" felony. or it could be less serious as some type of sexual contact, which would be a misdemeanor in this case. so we have to see what the d.a. is saying happened in the room. >> how does this work, in terms of which
