i'm pat lawson muse. we begin in virginia where a special grand jury will decide whether a fairfax county police officer should face criminal charges for killing an unarmed man. john gear was shot by officer adam torres who was checking out a domestic dispute in august 2013. earlier this week the county agreed to pay nearly $3 million to the family of gear to selling a wrongful death suit. the civil settlement creates an unusual situation, joe madison, where you have a civil case settled before prosecutors even decide whether to file criminal charges in this case. typically it's the other way around. >> i'm not a lawyer and i've never heard it done that way. i don't know why. the real question here that we obviously have to discuss is does it have any impact on the criminal charges. will the civil charges and what is allowed to be brought into the criminal charges. i really don't know. and it will be interesting to see what happens with that. >> what about the pr nightmare that has created for fairfax pol

pat lawson muse with developments of a case leading to anger and frustration. pat? >> jim, the police commissioner and mayor trying to calm tensions but unable the provide many answers about this case. police did release a detailed time line of gray's arrest all the way up until the time ambulances were called to transport him to shock trauma. we did learn that after the initial arrest he was taken out of the van and placed in leg irons and learned that gray asked for an inhaler several times and at this point no explanation for how his spinal cord wound up severed. >> what we don't know and need to get to is how that injury occurred. >> baltimore's made progress before and we've overcome difficult challenges in our city. and i know that we will do it again. i'm angry that we are here again. that we have had to tell another mother that their child is dead. >> now, baltimore police say their investigation will be complete in a week and then an independent review board will launch its own investigation. back to you in the studio. >> thank you, pat. >>> the man accused

pat lawson on that. we'll start with chris lawrence who has been there all afternoon. back to normal after an exciting afternoon. >> reporter: yes, some scary moments for the people here. the capitol police have hauled that gyrocopter off the lawn and federal law enforcement sources tell me they didn't find any explosives or womens on board. let's get you straight there. the pilot coming in. witnesses say he was flying from the west. coming in about 30 feet over the national mall. the faa has restricted that air space for anyone flying under 18,000 feet. the faa said they were not alerted to this flight. the witnesses say they could see the insignia of the u.s. postal service on the side of it. some of them thought this was an official flight. the plane, gyro copter plomd down on that front lawn of the capitol. witnesses say that the man did not come out immediately. the comment police were right there to arrest him. he did not come out until ordered to do so. some of the reasons why perhaps they did not

pat lawson muse is live with details on this case and what the victim wants out of the lawsuit. pat? >> jim, the suit stems from an incident that happened in 2012. 72-year-old robert jones says a deputy punched kicked and pepper-sprayed him on his own property. jones says the deputy arrived at his home as he was burning leaves after hurricane sandy. the deputy began to question jones about the safety measures he was taking and then asked for jones' i.d. but when jones asked why his white neighbors weren't questioned about burning leaves on their lawn, he says the deputy became irritated punched him and arrested him. a jury found jones not guilty of six charges against him stemming from this incident. i now says he hopes the lawsuit will help him move on. >> i've been downhill ever since that happened. it can't leave my mind, just won't leave. now i feel that i'm going to start to get some justice. >> the charles county sheriff's office just sent us a response that says the incident happened under a different administration and that the deputy involved is no longer with the depart
