protesters rallied outside the state house today but as pat warren reports, the general assembly has consistently resisted repeal. >> reporter: this demonstration outside the state house in annapolis is a preview of what may be more to come as a september execution of georgia death row inmate troy davis fuels the fire of protesters. his sister kim joined this rally. >> we can't continue to kill innocent people. >>> davis was killed for penalty involving another shooter. >> you need to get up, get up, hold your head up and never give up. even when it gets rough you get tough. stop the death penalty now. >>> governor o'malley has testified in support of repeal and accepted a commissions findings that the death penalty should be -- >> i don't everyone want to call it the death penalty, what i like to call it a capital justice. >> reporter: the general assembly modified the rules to require photographic evidence or taped confessions in order for cases to qualify for the death penalty. it's not clear yet what role the governor might play in this year's death penalty debate. reporting from

reporting from annapolis, i'm pat warren. back to you on tv hill. >> and the government did not talk or elaborate on a potential gas increase, telling reporters he's saving that for another day. >>> good news for governor martin o'malley, a new poll shows republicans are behind him on several issues. >> the gonzalez group polled hundreds of marylanders about some high-profile issues. the poll of likely voters found 49% are in favor of legalizing same-sex marriage. governor o'malley also supports same-sex marriage. now, if the issue was shot down during the general assembly, it could wind up on the november ballot. the poll also find pitch% of marylanders approve of the job president obama is doing. that's up from 49% in september. >>> job approval for governor o'malley is up 53%, up 1 percentage point. the survey finds marylanders still say the economy is the most important issue facing the state. but the percentage is down for the first time in two years. >> the telephone poll of 808 registered voters was conducted between j

reporting from annapolis, i'm pat warren. back to you on tv hill. >> the governor did not provide an increase. >>> included in the governor's budget plan, a new tobacco tax that is expected to bring in millions of dollars. >> well, vic, about $19 million is expected to come from aligning the state cigarette tax with other products. right now, tax on cigars and smokeless tobacco is at 15%. the government would boost that to 66%, making it comparable to the present $2 per pack cigarette tax. the state takes in about $200,000 under the current rate. >> some lawmakers propose raising the tax to $3 a pack. >>> and a brand new poll reveals that maryland voters are split. and there is a strong division along racial lines. >> according to this gonzalez poll, it is strong opposition among african americans that is making this issue so close, the house speaker plans to put it through two different committees to give it a greater chance of getting to the floor. >> reporter: legalizing same- sex marriage will be one of the hottest issues
