patti ann brown back with us watching from the newsroom. >> reporter: that's that's right, jon.a was fed up with people breaking into his montana home so last april when he caught a 17-year-old german exchange student in his garage karma shot him to death. his lawyer says karma had every right to use deadly force to defend his home, but prosecutors argued it wasn't as simple as that, and they prevailed. karma was convicted in december of deliberate homicide. he is being sentenced today the hearing going on right now, and he could get a minimum of ten years in prison. key testimony came from a hair dresser who helped convince jurors to killing was premeditated. the woman did karma's hair a day or two before the shooting. >> he had said he's really tired and that he'd been sitting up for three days waiting to shoot some f-ing kids. >> reporter: karma's lawyers have filed a motion seeking a new trial or conviction on a lesser offense such as mitigated deliberate homicide. they say the jury pool was biased by extensive media coverage, and the jury instruction on justifiable force vi

when david waters' ex-girlfriend, patti steffens, read about david fry's murder in the newspaper, she immediately called the fbi. >> at first she wanted to tell us small bits and pieces. you have to understand this was a woman who was terrified. >> she gave investigators an important lead. three years earlier she said that david waters had rented a storage unit around the time the o'hairs disappeared and that waters had once gone there with this spray canister. laboratory tests on the canister revealed it had once contained bleach which is sometimes used to remove blood evidence. armed with a search warrant, police found a tiny red stain beneath a piece of aluminum under the wall. it was so small it was almost in visible. with blood from madalyn's son, bill for comparison, a mitochondrial dna test revealed the stain was a mixture of two people. madalyn murray o'hair and her son, jon murray. next the fbi searched jon's waters' apartment. >> we found documented that belonged to the o'hairs that were dated after david waters had been fired from their organization. >> mr. waters, himself

patty control haines joins us live, patty i think most people including the president will be horrified at the nature of the killing. the president saying this will strengthen the resoldier? >> i think that's what he is hoping. of course, that is a huge concern, the way they have been able to sell this to the american public, is by saying that the u.s. is not necessarily -- is part of a coalition. now obviously if you look at the numbers when it comes to air strikes. the u.s. is doing the vast majority of the bombing but he has been able to tell the people not an arab countries but also western powers are taking part in these air strikes. that it is a global coalition and that is important because remember this is a country that has seen two wars and they are very weary of another and they can look at the polls and see the american people don't want to see the ground forces embroiled in the region. they give the thumbs up because they believe they need this coalition to stick together. this comes to the back drop of more money being pledged set aside to take on isil and train troops. >>
