i know there are reports that patty womack won't be b.c. but she has made appearances during this case on networks. she did appear on hln by telephone. she has spoken out in support of jodi arias. why she's not doing it today, if that is indeed the case, i don't know. because she is out there already and her image is out there. >> and, ted, when we get to this point in any trial, a defense has an obligation to do literally everything in its power to try to save a client, even if the client doesn't want to be saved. in that respect, this defense has put forth a motion to the judge that the prosecutor shouldn't be allowed to bring forth any witness to testify in this particular phase? first of all, why? and second of all, is there a shot at this? >> reporter: well, basically, they're saying because juan martinez hasn't identified potential witnesses that he should be barred from bringing on a rebuttal witness if, endodi, he wants to after we hear from jodi's friend, now, from the prosecution's side, they likely don't know who they want to bri

the other witness is supposed to be patty womack, a childhood friend, she can talk about maybe allegedr parents. she does not want to be shown. she does not want her voice to be heard. that signifies she is scared for some reason to testify and so i think one big question is, will she actually take the stand for jodi in defense of her life. >> what i understand, is attorneys are going to show the jurors, jodi arias' artwork. honestly, could that factor into this? >> reporter: that is what we heard. now, i think jodi arias, foundationally, she has to show the artwork. jodi arias we know is going to speak to this jury. what is she going to say? we heard the opening state, she will talk about her life, what she wants her life to be and the artwork. normally, when someone of jodi's stature, a convicted murder, alocutes, speaks before the jury and the court, they beck for their life. they apologize for what they have done. so, the question is, what will she say? will she actually ask for death? which is a possibly. will she be kroexd or cross-examined or make that statement to the court. >>

they claim one of those witnesses, childhood friend, patty womack, backed out of testifying because of expect jodi arias and only jodi arias will address the jury who will then decide if the 32-year-old spends the rest of her life in prison or heads to death roy. for "good morning america," ryan owens, abc news, phoenix. >> joining us now "gma" legal analyst dan abrams. her attorneys tried to remove themselves from the case. they again asked for a mistrial. what's going on here? >> not surprising that the judge said no. but, you know, put yourself in the attorney's position for a moment which is you've got perspective witnesses who are saying, i'm not going to testify in this case because of death threats and other issues, it's not frivolous. now, it's not a winning motion. i mean the judge did the right thing here. but they're in a tough spot. i mean, jodi arias really has become this sort of national pariah, and any witness who testifies on her behalf gets excoriated and threatened, et cetera. so that is sort of the position they find themselves in now as attorneys trying to represen
