"outfront" tonight, paul callan. so do you think there is -- there is something here?ppeal could work for them? >> there is a great chance that the death penalty will not be imposed in this case and it will be reversed. and i say that, because a., his attorneys made a compelling case. 423-page brief outlining prejudice that occurred during the trial. but the bigger issue is, california courts and the federal court out there, are very liberal on death penalty issues. i mean, frankly, the death penalty hasn't been imposed in california since 2006. >> right. and that was -- that brings me to that -- there's 725 inmates on death row in california right now. scott peterson being one of them. so i mean, is there something to be said for would his turn have come up anyway? >> well, i don't know. try to picture the carnage if the california courts say we're now going to start imposing the death penalty. are they really going to put over 700 people to death? the federal court that he's going to wind up in is the ninth circuit court of appeals. >> oh -- >> which -- >> famous or

paul callan is "outfront." paul, safe house, what does this mean? >> good question.ime i've ever heard the use of this word in a criminal case was the casey anthony case after she was released. you don't normally hear it in criminal cases. a safe house is where a spy goes. they have encrypted communications. this makes it sound like george zimmerman thinks he's jason bourne and he needs a safe house. i find it to be an odd selection of terminology to describe security. >> so why would he need to hire personal security? the question is, too, does this terminology have anything to do with who's actually paying for it? >> i think it does. i think that by using a term like safe house, it elevates george zimmerman to the point where he maybe can claim to be representing some national idea or a cause. i don't know what it is, self-defense, if he acted in self-defense, he acted in self-defense. that will be up to a jury someday. but certainly for fund-raising purposes, there's a certain glamour to have your own private security team guarding you in your safe house which is

i want to bring in our legal analyst paul callan, and can you explain to us how he has 24 first-degreer counts when there are only 12 people dead? does that make sense? >> well, it does make sense. i have not seen a copy of the charges, but colorado like most states you have first-degree murder which could consist of intentional murder and you point a gun at somebody with the intent of killing them, and you premeditate that is first-degree murder, but a second type of first-degree murder and that is called depraved an indifference murder and he went in allegedly to the theater and just randomly sprayed shots around the theater maybe not intending to kill a particular individual, and that is a form of what we call depraved indifference murder and it is functionally the same thing. so you would have two counts for each victim therefore. >> okay. his attorneys asked for more time, and what do you make of that? what do you think that is about? >> well, it does not surprise me at all. under normal circumstances, they would be looking at a preliminary hearing in 30 days, and defense attorney

we might expect and how his defense may be argued, cnn legal contributor, the former prosecutor, paul callaniminal defense attorney tom mesereau. tom, how do you defend a guy like this, that the evidence seems to be so powerful, so many eyewitnesss? >> well, in my opinion, you do not try to acquit him of a shooting. what you try to do is save him from execution. and that's going to be a daunting task. right now he's the most hated man in america. you have to focus on his mental health or his lack thereof. he has to be examined bay battery of psychiatrists, psychologists, counselors. you have to go into his entire background, from the time he was born, every medical record, every education record, and you have to paint a portrait of a man who is completely draerange completely insane, not dealing with reality, and not capable of controlling his actions. >> and so paul, if you're the prosecutor in a case like this, how do you avoid exactly what tom just said? how do you get him convicted on murder charges? >> well, believe it or not, even someone who has committed a horrific crime like this, w

cnn legal contributor paul callan joining me live.at the heart of this massacre were the multiple guns found. three were left behind in the theater for authorities to find. in terms of the gun laws in colorado, what are they? i mean, how much of his stockpile was legal for him to possess? >> well, i've been taking a close look at colorado gun laws, and it's really kd of shocking. every weapon that he had appears to be totally legal. not only under colorado law, but under federal law. he had two glock semi-automatic pistols, he purchased them legally in local gun stores. he had an a-15 assault rifle, totally legal for sale in colorado and under federal law. he had high-capacity ammunition that he purchased online, totally legal under both federal and state law. and he was also equipped with this somewhat bizarre equipment that normally you'd see soldiers or police officers wearing, armored equipment, to protect him from being shot himself, online purchase, totally legal, under existing law. >> so is there -- i mean, a question of, how

and from new york, legal contributor paul callan. chambers is out of office in january. how far will this case even get under her watch? >> well, under colorado law, she has to make a decision about whether she's going to seek the death penalty within 60 days of the arraignment in the case. and the arraignment could take place as early as next month. i'm sorry, next week. it's quite possible that she will make the decision. and i would also say, given her prior history and i'm sure we can talk about that in terms of the politics of it, that she probably would be someone who would want to make that decision. she's made death penalty decisions many times in the past. >> alan, since chambers is finishing up her term soon, how much of an effect can she really have on this case? the election will be in november. january, she'll be out. how much on this high-profile case? >> she can certainly lay the groundwork for the case. she's shown the least reluctant to file those kinds of charges. the problem is she will be gone in six months. number two, not all of her cases have been
