a jury convicted paul garcia of first-degree murder but there have been new twists. new attorney who is saying the previous defense attorney -- he wants a retrial. garcia bought two bars back in 2007. the d.a. was able to convince a jury that garcia became obsessed with a bartender. garcia was found guilty of hiring a hit man and a middle man in a plot to kill out of a rage. his new attorney again says that the previous defense attorney failed to interview a key witness, an alleged getaway driver. also, we are expected to learn the status of the defense team's attempts to review security camera footage. we should also learn about a possible sentencing date at 8:30 here at the court house. stephanie chuang, nbc bay area news. >> thank you very much for the report. >> police are investigating berkeley's first homicide of the year. police found a man shot several times near an apartment building. he was taken to the hospital where he died. police say it was not random and talked to people after looking for leads. >> more than a dozen homes are being rebuilt. while there

yes, paul garcia was convicted of first-degree murder last year, he was convicted of the first-degree murder charge on hiring a hit man apparently, in what appeared to be a love triangle situation in the south bay. garcia bought mountain charlie's saloon and the lounge, two popular spots from mark achilles. jeff rosen got the conviction on garcia by convincing a jury he had become obsessed with a bartender who worked for him. it was argued that he was in love with the previous owner which outraged garcia. prosecutors revealed desperate, quote, desperate text messages from garcia to donnelly before the killing. $900 in withdrawals and records showing that garcia downloaded garcia's picture, the same photo found with the hit man who was also convicted along side the middle man. garcia's previous attorney argued he was framed but failed in convincing the jury. he has a new attorney arguing for a new trial saying the previous attorney did a poor job. we'll find out a lot today at the courthouse on wa could happen with this garcia case. stephanie chuang, nbc bay area news. >> thank you ver
