and paul henderson, is that the right move? what a good defense lawyer would do?ere is really no choice in a case like this. they have got sell this story and make their narrative for the defense, which is essentially arguing that this was either a reasonable mistake or that the use of force, lethal force, was jufrd. and what prosecution will be arguing counter is even if there is a mistake it was reckless or negligent which would lead to criminal culpability. and you will hear about the use of lethal force. the issue from prosecution is to point out and unpack to the jury how this defendant's actions escalated the encounter. and if she created the risk, she's not allowed to use lethal force. and now, as she has about to get on the stand, and she must get on the stand, she's going to have to try and sell an emotional plea i believe in response to prosecution's emotion. and this is something different that we didn't see in a lot of the other cases similar to this. we didn't see a case like this that was emotional from george floyd. but we saw prosecution specifical

last week we were talking to another paul, paul henderson, whether he thought the prosecution was doingsecution is falling short and he expects kim potter will be acquitted. what is your take on how this has gone? >> so katy, to convict ms. potter of manslaughter, prosecutors don't have to prove that she intended to kill daunte wright but only that she was reckless or negligent. and the prosecution has emphasized how different a taser looks from a gun, to make the point that no reasonable officer would make the mistake that potter claims that she made. in its closing argument, the prosecutor really focused on the fact that when ms. potter shot daunte wright, she didn't immediately try to help him as he lay dying. instead she burst into tears and said "i'm going to prison." so that's now in the hands of the jury. the prosecution and the defense agree ms. potter made a mistake. but the defense says a mistake is not a crime. >> so paul, should we read into anything for how long this takes? i know we always wonder, short deliberations mean "a," long deliberations mean "b." what do you expec
