>> talk about the difference or perhaps similarity between tom barrack's case and the cases of paul manafortat we mentioned before. we mentioned that they were prosecuted for violating fara, the foreign agents registration act. how are these different? >> they're very closely related. foreign agents registration act is primarily a disclosure statute. the idea is that if people are lobbying for foreign governments in the u.s. they should be registering with the u.s. government. i think the big difference here is what we were just discussing, josh, the issue of what is the quid pro quo here exactly. it's very clear that in the case of manafort and gates they were being paid millions upon millions of dollars by the government and perhaps by political parties as well in ukraine to do that sort of classic lobbying. this case with barrack is a little more murky. as i say, it's clearly in his financial interest to be working on very close relations between the u.s. and uae. but in terms of money directly changing hands or exactly what barrack did, that isn't discussed in the indictment. it isn't so

michael flynn and paul manafort had their failure to register or lies on their application and documentation. you have this circling around president trump but no connection directly as far as we yet know about this issue. but i want to underscore, you go back to the underlying reason we have this law in the first place. this entire premise, although it has not been admittedly enforced in terms of criminal prosecutions very often over the course of, say, 50 years, it still is a lot to try to insulate institutions from having corrupt or otherwise foreign influence, having transparency here. so this is something that even in recent times we know has been prosecuted. so the willfulness aspect of it. it may not be prosecuted is no excuse for not following and abiding by this particular law. so if there were statements made and a failure to register, remember, it is not a very onerous proceeding. it is a couple hundred dollars for filing on this very issue. so why would you want to conceal it if that's the allegation here? why not have the transparency? that's why you have other additional allega

he pardoned mike flynn, steve bannon, paul manafort, right down to papadopolous in the russian investigation. the list goes on and on, but he only pardoned people charged and convicted while he was president. tom barrack's case was delayed so he is out of luck. no presidential pardon coming for him. his indictment came after trump was out of office, which itself is probably a scandal if the indictment couldn't be brought while trump was in office because trump appointees wouldn't let it happen. but the fact that it was delayed means he doesn't get out of jail free with a pardon card from trump. one of the open questions of the trump presidency and its corruption is how many legal cases didn't go forward to charges, just were not brought because they were squashed or delayed by trump appointees of the justice department. i don't know if we will ever get an answer to that. kathleen rice and ted lieu are trying to make sure that the justice department at least investigates it. but the one silver lining in terms of accountability for any and all cases that were delayed and yet still could be bro
