joining me is the man who wants to bring back the firing squad, paul ray. representative ray what is the genesis of this? when did you have the idea to try to move this legislation forward? >> you know chris, i actually came up with the idea when i found out that utah no longer had the drug cocktail available. this actually happened shortly before the oklahoma issue happened. >> do you believe a firing squad is more humane to the inmate being executed than the drug cocktail? >> you know, i do. i mean the premise of this as the humane part of this we don't have the drug cocktail we have to do something, the humane thing to do is the firing squad because it is death within three to five seconds. >> why not just go to that if you think that's superior? why not push the state to just go to a firing squad? >> we have a lethal injection. like i say, the will i don't think is to move it to the firing squad permanently. the will is to have a backup for the lethal injection. so that's exactly what we did. we decided we don't have the drug cocktail. so it's time to ha

. >> representative paul ray is the man who introduced the bill in the utah legislature. representative ray good to have you with us. most people look at execution by firing squad as something -- people argue that it's humane. >> absolutely. if you understand the physics of the lethal injection vs. the firing squad your body slowly shuts down takes several minutes for that to happen. the firing squad happens within 3 to five seconds. if you want to look a at the most humane way iforts the firing it's the firing squad. >> only supporting this now because of the recent botched executions in obtaining the lethal execution drugs? >> before we had the botched executions, and we were out of the mix needed i started drafting there bill. utah back in 2004 when we changed we actually left the caveat in that if it became unconstitutional we would revert back to the firing squad. that is already in. so we've just added the fact that if we get within 30 days of execution and we don't have that drug available we would revert the to that method at that time also. >> will the governor s

two weeks ago, i spoke with utah state represent paul ray, who sponsored a bill to reintroduce the firing squad as a backup execution method if legal injection drugs aren't available. yesterday, governor jerry herbert signed that bill into law. utah's move follows a string of grisly botched executions in ohio and arizona, many death penalty states are scrambling to maintain lethal injection drug supplies, largely because the drug makers who make those drugs are refusing to supply prisons. but utah seems to hold a particular affection for the firing squad. only three executions have been carried out since firing squad since the supreme court reinstated the death penalty in 1976. all three were in utah. the state only stopped offering the firing squad as an option in 2004. and in light of its return, the associated press has compiled a handy guide explaining how, exactly, it works. the prisoner is seated between stacked sandbags so that the bullets don't ricochet. a target is pinned over the prisoner's heart. the firing squad will aim for the chest, because according to the bill's sponsor,
