fobs 5's paul wagner has the story -- fox 5's paul wagner has the story. >> reporter: on september 27th 2002 d.c. police arrested as many as 400 people in pershing park, many protesting the policies of the world bank and had vowed to shut down the city. leading up to and after the arrests officers in a command post were documenting everything, recording it all in what's called a running resume. it's standard procedure, but when lawyers like karl messinio started looking into the constitutionality of the arrests and asked for the document, it was nowhere to be found. crucial video and audiotapes were missing as well. after nearly eight years of litigation the federal judge decided to launch an investigation and tapped magistrate judge john facciola. last month after listening to the testimony of more than a dozen witnesses in the case, judge facciola decided he needed to go in a different direction. conflicting statements convinced the judge he needed to look closer into the possibility city attorneys were behind the solicitation, preparation and submission of false testimony affidavits

and paul wagner is here. a lot to think about with the jury. let's talk about the charges being dropped, two of them. >> okay. basically what we understand has happened here is that the prosecutors have decided tactically not to bring one of these witnesses in who was going to talk about an alleged confession by guandique to sexual a -- sexually assaulting levy and killing her. so if they can't bring this witness in, then they'll have to drop the charge. that was a big surprise and it was also a surprise that we didn't see more of these witnesses that we were supposed were told that we would see a parade of witnesses who had spent time with guandique in prison. but we didn't see. that we only saw one person. so if you can't bring that witness in and the jury doesn't hear that evidence then you have to drop those two charges. so the way to look at it is there were six charges, a sexual assault connected to a homicide. kidnapping connected to a homicide and also attempted robbery attempted to a homicide. those are the four charges remaining. kidn

certainly knows her way around the courtroom and from what i understand and my discussions with paul wagner today, she did a dependable job with the facts she has, although for me i just don't think it's enough. they can't even put guandique in the park. the best connection they have is through a jailhouse penitentiary informant who said guandique admitted to killing the woman and are for me that's not proof beyond a reasonable doubt. >> is that this confession that we've heard about? it's not really to the police involved, but to his cellmate? >> right. he had a conversation with his cellmate and then lo and behold years after he successfully gets away with this murder he tells a guy who he virtually barely knew. for me hard to believe, doesn't mean it didn't happen, but for me hard to believe certainly beyond a reasonable doubt. >> that plays into what the defense said today in closing arguments is that the prosecution got tunnel vision by focusing on guandique. does that make sense to you after seeing this trial play out? >> yeah. guandique is really if you look at it from the other side

paul wagner has been following the case and been in the courtroom since the trial started and paul joinsis morning with basically the wrap- up of this trial. the jury now has the case. >> they do have the case, allison. starting at 9:30 this morning and who knows what will happen. the closing arguments were very interesting yesterday. they started at around 11:30 and it went all day. because the prosecution had first bite of the apple, then the defense took about an hour and a half. and then the prosecution got to do a rebuttal close. so it lasted all afternoon. and the jury didn't get charged, as they call it, by the judge and that is the reading of the instructions until late in the afternoon. so they didn't do deliberating yesterday. they'll do it all today. >> they have a lot to consider when they do go into -- behind closed doors. no dna here, no eyewitnesses here. they went through charges being dropped. where do they begin as far as trying to figure out what to charge ingmar guandique with and now they have an option, if not first-degree murder they have an option for second- degr
