fox 5's paul wagner is live down in charlottesville now with what they had to say. paul. >> reporter: brian, the jury returned just a few minutes ago and returned a sentence for george huguely of 25 years in prison for the second-degree murder charge and one year in prison on the grand larceny charge. they could have given as much as 40 years on the second- degree murder charge. the virginia statute calls for between 5 and 45. they chose 25 years and they could have gone between 1 and 20 years on the grand larceny charge, they just gave him one year. now, this is a recommendation. the judge will take it under advisement and on april 16th, i believe is the date they gave, they will formalize this sentence. there will be a presentence report and then george huguely will be formally sentenced by george edward. he can accept the sentence or he can lower it, but he cannot raise it. now george huguely could have faced 40 years in prison on that second-degree murder charge. the defense then wanted the jury to be polled. the judge then polled each one individually, pointing

the prosecution rested today and paul wagner has the latest. paul? >> reporter: after 3:00 this afternoon when the judge denied the defense to strike all but one of the charges against george huguely, they brought witnesses to the stand. a doctor who said he had a different opinion on how the college senior died in may 2010. he believes that yeardley love suffocated to death. this neuropathologist from chicago told the court in his opinion, yeardley love died from a deprivation of blood flow and oxygen to the brain. with the head face down in the bloody pillow following the assault, the doctor thinks she died of azfixia. the state medical examiner previously testified that she died of cardiac arrhythmia. earlier in the day, five of huguely's teammates told the court that he had been drinking heavily the day of the murder and described him as noticeably drunk. one said that he lived to him about his whereabouts before the police say yeardley love was killed and repeatedly asked him what was wrong with him? and the jury heard from three women who were

paul wagner live in charlottesville paul. >> reporter: well, brian the other surprise today on the witness stand was from the medical examiner who said he found no injury to yeardly love's nose. you will know george hughly said the only injury she had the night he left her apartment was a bloody nose the doctor was asked extensively by the prosecutor about the autopsy he performed, in may 2010. he was questioned extensively about the injuries to yeardly love's body explaining with the help of autopsy photos where he found bruises and injuries to her body. he found bruises on legs, left hand large bruise to her back and right buttock, bruises to her chest damage to her neck medical examiner told the court he found hemorrhaging over the carotid artery, he found evidence of an attempt to smother the doctor pointed to injuries to her face autopsy photos shown to the jury he also said he found hemorrhaging on the right lower portion of her brain before he could explain what all the matily caused love's -- ultimately caused love's death the prosecutor ended his questioning as photos were shown t

paul wagner is live in charlottesville with reaction. >> tell me in my ear. >> hopefully paul can hear us. paul. >> yes, brian, the jury came back a little while ago and recommended that 26 year sentence that you just mentioned. 25 years on the second-degree murder charge and one year for the grand larceny. the jury could have given him as much as 40 years for the second-degree murder charge and as much as twenty years for the grand larceny. there's truth in sentencing here in virginia. he'll have to serve those 26 years. what happens now is there will be a presentence report and the judge will either impose that sentence or he could lower it and huguely will be formally sentenced on april 16. now after the sentence was handed out by this jury, judge edward polled each juror. he looked at each person and said is this your sentence? as huguely stood there, he watched stoically. he had no reaction to any of this. there were no outbursts in the courtroom. there was no reaction from the love family. there was no reaction from the huguely family. as the jury was let go, they were told that

fox 5s paul wagner is live in charlottesville. paul? >> reporter: this is the latest. the 25 people qualified to serve on the jury, 25 potential jurors that the defense and prosecution agree could serve on the jury were sent home by the judge awhile ago and what is going on inside is individual jurors are being questioned by the prosecution and the defense to see if they can qualify three more people. they want to get to 28 and take the jury panel from that 28. 28 people were qualified and each side gets what they call six strikes to get down to 12 jurors and three alternates. trying to get to 28 tonight. if they can do, that they will see the jury tomorrow morning and what this problem is, why that has taken so long, many people have formed an opinion about this case and some people said flat out that they believe he's guilty and others said they formed an opinion and that now they're not sure and they were questioned closely by the prosecution and the defense and that is the problem. and that is where the jury pool is coming from and this is where the murder took pla

paul wagner live in charlottesville. paul. >> reporter: george hughly walked into this courthouse here downtown charlottesville looking notably thinner than his playing days here at university of virginia with a large contingent of his family sitting just to the right of him, george hughly stood up and replied not guilty, to all charges against him. dressed in a sports coast and khakis, he sat with his attorneys and appeared to pay close attention to all of the questions posed to the potential jurors in the case. across the aisle within his view sat yeardly love's mother, sister friends and family as the day went on the prosecution and defense agreed to strike nine potential jurors some for reasons unclear others for saying they had an opinion about his guilt. from a pool of 40 or so, virtually everyone said they had followed the case in the news only two said they had no knowledge of the case. yeardly love was found dead by a roommate inside her off campus apartment in may 2010, the medical examiner says she died of blun

fox 5's paul wagner has the latest from charlottesville. >> reporter: brian, this jury began deliberating at 9:23 this morning and at 5:00, they were asked by the judge how they were doing. they sent a note back saying basically they wanted to continue to work into the night. they said please check back with us in an hour or two. the judge said wee check at 6:00 -- he would check at 6:00. the question is are they going to continue into the night? are they going to get dinner or go home at some point and shay they -- and say they want to come back tomorrow. so far they've sent three notes to the judge today. one of those note was a question about a letter that they had not gotten in the exhibits sent back to the jury room. it was a letter sent by george huguely to yeardley love after the february choking incident. he apologized to yeardley love and he said to her in this letter, quote, alcohol is ruining my life. a second note had to do with a question about some instructions. the jury said that there was a contradiction between two of them and they wanted to know what to do about that. th

paul wagner learned the city is months away and is live in the newsroom now. the story you will see on the news edge tonight. paul? >> reporter: d.c. police officers who arrest the suspected drunken drivers in the city have been without the use of breathalyzers since last february. that is when the chief of police ordered them out of service and told officers to, instead, rely on fuel sobriety tests and urine samples. d.c. police are months away from getting the machines back in service. maybe by late this summer, according to phil mendelson, the city councilman, who has oversight of public safety in the district. >> we have had several, shall we say, extensions without requesting extensions. it's frustrating because breathalyzers is the most efficient and the least costly way of enforcing drunk driving. every city does it. we ought to be doing it. it ought to be up and running. >> reporter: mendelson said he was told the office of the chief medical examiner is working with the office of the attorney to come up with new protocols. why it's taking so long, he sa

fox 5's paul wagner is live tonight with more on the testimony. paul? >> reporter: shawn, the seven women and seven men on the jury spent hours listening to the highly technical testimony today about neurons and axons and att staining coming from two brain specialists, one from university of v and another -- of virginia and they both found bruising when asked to examine yeardley love's brauller took t stand and told the court she found two contusions on each side of love's brain as well as hemorrhaging to the brain stem, injuries she said could only come from blunt force trauma. when asked to explain what she meant, dr. fuller described it as an acceleration of the head with a rapid stop. during her testimony, dr. fuller used anniversary no tom mcly correct model of the brain to show where she found the damage, passed to the jurors. when asked about the damage to the brain stem, she said it was consistent with the twisting of the head or as she put it, torque. dr. fuller told the court the brain stem controls many vital functions and the damage could ha

opening statements, we learned how he responded to learning she was dead and fox 5s paul wagner has the latest. paul. >> reporter: there are two theories on how she died. the defense believes it one way and the prosecution believes that she died another way. in fact, francis lawrence, the defense attorney for george yugley, told the jury it's going to come down to, quote, a battle of medical science. he said george yugley left love's apartment that night. all show had was a nose bleed. he never intended to harm her. the most the jury should consider is that it's involuntary pant in the opening statement to the jury, the commonwealth attorney said that y ardley love and the man were in a on-and-off relationship. and twice before dieing, they were involved in violent encounters, one in which he was seen choking love and the other involved love hitting yugley with her purse. chapman then told the jury saying he sent her an e-mail the friday before she died where he threatened to kill her n. an hourlong presentation, the commonwealth attorney told the seven men and seven women on the jury t

fox 5's paul wagner joins us live from charlottesville with more on the story. paul. >> laura, that person was called to the stand by the defense. her name was elena. she was in town for a lacrosse game. she was called to the stand to show the jury a video that was recorded that night in an offcampus bar and it was surveillance video that was turned over to the defense. and it shows the couple inside this bar and eleina was there and she was asked to tell the jury exactly what she saw. >> there was no sound on the tape, just the images of george huguely and yeardley love socializing with others at the off campus bar. it's a surveillance tape obtained by police and turned over to the defense. huguely's aunt was there that night with two of her daughters, standing in the well of the court holding a laser pointer, she described who was who and what they were doing. only the jury could see the video as she said there's george holding hands with yeardley. it was around midnight, may 1, 2010. the day after yeardley told love in an angry e-mail, i should have killed you

fox 5's paul wagner has today's testimony from charlottesville. >> reporter: george huguely wiped tears from his eyes and repeatedly sipped from a cup of water on the desk in front of him as the tape was played for the jury. at first a goingy sounding huguely sounded matter of fact -- a groggy sounding huguely sounded matter of fact. that is until he was told yeardley love was dead. just before 8:00 the morning of may 3rd, 2010, george huguely walks into an interview room at police headquarters and begins to tell his story to detective lisa reeves. after waiving his miranda rights huguely tells police he went to love's apartment because i just wanted to talk to her about what happened the week before when love attacked huguely over allegations of infidelity. sounding like he had just woken up huguely said yardley started freaking out when i came in the room and i told her to chill out. i shook her and her head hit the wall. as the interview went on huguely said, "i was holding her arms. we were wrestling a little. the detective asked it you touch her neck area, choke her? huguely replie

>> and thank you, paul wagner. >>> moment monitoring metro, dramatic video of a deadly collision between a truck and metro bus. this accident was back in december on rockville pike. the operator of the bus was seriously hurt and the video captured the collision and sherri ly is here new with more. sherry? >> reporter: well, laura, that video comes from the drive cam and shows the accident as it happened and how the driver acts. from the video, there is little the bus operator could do to avoid the crash. the video captures two views. one inside the bus and the other on the road. it's just 14 seconds long. and that bus heads north. the truck is headed southbound. can you see it appears to bump the curb and then keep going. it crosses into oncoming traffic and collides with a metro bus. and that bus slams into a tree on the side of the road. look again, you will see that the bus driver has no time to react. it takes less than two seconds from the time the truck hit the curb before the collision. >> that truck driver died. the bus driver who was seriously injuries is still recovering. the p

fox 5's paul wagner reports. >> reporter: the prosecution spent days building a case that suggested george huguely viciously attacked yeardley love the night of may 2nd, 2010. there was the damaged bedroom door, photos of a bloody pillow, the testimony from an officer who said he began snapping pictures of the scene because there was evidence of violent crime that occurred. prosecutors showed the jury autopsy photos of yeardley love's face, the black eye, cut lip and lacerated finger. the jury also heard from police officers who found love's computer in a dumpster across the street. a piece of evidence could cost huguely dearly, especially if they decide the dell laptop was worth more than $200. the difference between grand and petty larceny. defense attorney bernie grimm thinks the theft of the computer which huguely admitted taking may not ultimately harm him in the eyes of the jury. >> for me putting aside what he did to her inside that room, throwing the computer away is evidence to me that he wasn't intending to steal it in the traditional fashion somebody steals things, you steal, so

paul wagner is live with the latest tonight. paul? >> reporter: laura, it's just after 9:00 this morning that the jury sat down and began listening to system about what these two neuropathologists found when they examined yeardley love's brain and they got technical, complex. there were all sorts of medical terms thrown around. it haded to with what the doctors found when they examined her brain. dr. fuller, a neuro pathologist and dr. maria lopez, a if your row pathologist -- neuro pathologist at uva say they found contusions on the brain and hemorrhaging on the brain stem, injuries that could only come from blunt force trauma. when asked to explain what she meant, dr. fuller described is as an acceleration of the head with a rapid stop. during the testimony, she used a model of the brain to show where she found the damage, a model passed to the jurors. when asked about the damage to the brain stem, dr. fuller said it was consistent with a twisting of the head or torque. dr. fuller said the brain stem controls many vital functions an

paul wagner has more on today's testimony. paul? >> reporter: brian, katy whitely took the stand this afternoon to describe finding the body in the early morning of may 3rd, 2010. we have in video of her as she left the courthouse earlier today. whiteley told the court she went to check on her roommate to see if she wanted to go out again. love was drinking most of the day and the last time she had seen love, she was in bed. she described seeing her face down in the pillow with blood evident on the pillow and sheets. as she sat on the edge of the bed and moved love's hair, she noticed injuries to her face. whitely tearfully described how love's body was warm and her feet were cold and she called a friend in from another room. the prosecutor revealed that medical evidence showed love was alive for two after -- hours after hugely left the apartment. the couple had a turbulent relationship and had two physical altercations. love had contubeions at the base of her brain stem and damage to her carotid artery. the defense said that love d

fox 5s paul wagner has more details. paul?reporter: reginald rogers thought he had a deal in place a few months ago, where he would plead guilty to second- degree murder and get a sentence of 20 years and more than that. the prosecutors encouraged the judge to accept the deal. when the judge learned that reginald rogers claimed he was alone at night and there was evidence he was not, he rejected the deal and gave rogers a choice. he said can you give up your partner or go to trial. so, rogers chose the trial. he's been on trial now here in d.c. superior court the last two weeks and, for the time, he and his attorney are trying to convince the jury that rogers acted in self-defense that night when 18-year-old calvin woodland was shot to death on barnaby street in january of 2010, the anguish in that community was palpable. puta, as he was again, was the son of the legend air boxer calvin woodland senior. the family was devastated. two masked men cornered him at gun point and rifled through the pockets. after getting what they w

paul wagner has been following the trial he joins us live from charlottesville with the latest good morning paul. >>> good morning tony this jury sat and listened to evidence from 9:00 a.m. yesterday morning until 7:25 p.m. last night, highly unusual that a judge would force a jury to listen to testimony that long and some of it was highly technical medical evidence about what happened to yeardly love the day she died may 3rd, 2010 there were two mural pathologists took the stand and for hours, went through what they discovered when they examined her brain saying they found contusions to each side hemorrhaging to her brain stem they said it could only have come from blunt force trauma, there were also experts who took the stand on blood spatter analysis there was a dna expert, we also heard again from the medical examiner, who came back to the stand and finally gave his explanation of what he thinks killed yeardly love he said cardiac arrhythmia, brought on by blunt force trauma. this morning we expect testimony of friends from george hughly who saw him that night and early in the morning a
