joining our conversation, paula reed and elliot williams. paula, let's start with you. to puncture the tradition of attorney/client privilege. to get a judge to sign off, you have to present evidence, at least probable cause, that the lawyer was involved in a crime. >> that's right. it's not a very high bar and the first time we've seep this from special counsel jack smith. the justice department had to present probable cause of a possible cause to get the warrant to search mar-a-lago. but here you see they want to bring back evan corcoran and ask about the events leading up to the search of mar-a-lago. so they are trying to convince a court to allow them to use one of these few exceptions to attorney/client privilege saying we believe corcoran or his legal advice were used in furtherance of a crime. not a high bar. it's likely they will be successful. look, it's never a good day when one of your lawyers goes before a grand jury and now we're up to three trump attorneys going before the same grand jury. >> part of the argument of the prosecutors is that the lawyers help

cnn's paula newton joins us on the phone. paula, what can you tell us? seem this would be at least a third now high altitude device from norad confirming that military aircraft are currently right now observing that there is a high altitude airborne object over northern canada. norad are specific at this time. you can imagine how worrying it is and whether or not the chain of command, either prime minister justin trudeau or president biden will be making a decision if this can be brought down or must be brought down. they're calling it a high altitude object. they're not saying what it is at this point or if they have been able to get eyes on exactly what it is. jim, just from cnn's reporting in the last few hours, you just discussed, right, the confusion there is in understanding what these objects are, why they are flying through the northern territories of both the united states and canada and what is at work. and remember, again, that although we understand that the first object that was shot down was from china, we still have no confirmation who is

let me go to paula newton to discuss. paula, i mean, it was a little strange.ssing on, and perhaps we just don't have enough information. we obviously don't have enough information to form real conclusions as to what went on. she described this object as being cylindrical in shape but she didn't offer much more information other than it was shot down over central yukon at 40,000 feet. the term cylindrical stands out as strange. >> we don't have a description of the second object that was shot down over alaska. it seems to me that she was giving a clue that it seemed similar tom. she said it was much smaller than the one shot down over north carolina. i have to say what is significant is that they feel like they need to give detail now. a key point, she was saying this is an unprecedented act on the part of norad to scramble these jets and shoot something like this down. in terms whether or not they've seen objects like this before, and have just let them coast through air space. we don't have a clear answer to that. right now, they are not taking any chances. s

paula reid is here with more. paula, what is this expected? >> it was. >> how significant? >> we knew this was likely coming because we know they've been in negotiations for months, the pence team and the justice department and these negotiations began before jack smith was even appointed. we knew that pence had signaled a willingness to at least provide some information and the fact that also a subpoena doesn't necessarily mean that there is an impasse. we've seen a lot of witnesses who would prefer to be subpoenaed so it does not appear that they are voluntarily testifying against the former president. i do expect there will be some limits on what he is willing to provide. there are legitimate questions about executive privilege when it comes to conversations between a vice president and a president. but he did make it a little more difficult because he wrote about a lot of the things they're going to want to ask him about in his memoire, right? conversations he had with trump. the pressure campaign that he was facing leading up to january 6th and the events of january 6t
