let's go to paula reid.e paula reid in florida who can weigh in on this, paula. >> reporter: it is incredibly significant, that special counsel jack smith is conducting two separate investigations into president trump and his associates one is with classified documents. that's why we're in florida today. in court, we expect them to talk about a trial date which is significant because at the core of trump's legal strategy is an effort to delay this trial, at least in after the 2024 election. now, he's also under investigation for efforts to overturn the 2020 election. and it was not clear. it was just not clear if he would be charged. but as he indicates in the statement, which we have not verified independently with the special counsel's office. he's received a target letter which he is correct usually means an indictment is coming soon. he has the opportunity to go before the grand jury. it's unlikely he'll do that. he did not do that after receiving a target letter in the mar-a-lago investigation. but it w

credits for what, paula? >> well, it's called good credit time, and so it's an incentive to get people who are incarcerated to behave well in the institution. so it's a super interesting thing. this is not new. this is standard. as it relates to federal prison, the process is authorized by congress. it's supported by legislation. under federal law, everybody gets 54 days good credit, and there are all these other incentives that they can do. if a person attends a drug program and successfully completes a program, it can take a year to two years off the sentences. under california state law, if theranos had been sentenced in state court, an 11-year sentence for a nonviolent crime with their good time credits and the like, she'd only serve 5 1/2 years. it's one-for-one credit. so really the federal system allows much fewer good time credits than the california state system. >> good explanation there. right now, 11 years has turned into possibly 9 years. could that even be reduced down to 8 or 7 years? >> absolu

cnn's paula reid joins us from fort pierce, florida.s through this rather important court hearing scheduled for tomorrow. >> reporter: it is a really important hearing. this is the first time both side of the case will appear before aileen cannon. the decisions she makes, both big and small, will have an enormous impact on the outcome of this case. now, tomorrow's hearing is supposed to be focused on how classifiied materials will be handled during this trial, but the judge has also said that she wants both sides to come prepared to talk about a trial date as that has been a hot topic in this case. there is a tentative date for next month, but that's not realistically when this is going to go to trial. jake, the special counsel has said that it would be ready to take this case to trial in december, but defense attorneys for former president trump have said it's premature to even set a date. they would like to delay this until after the 2024 election. so all eyes tomorrow will be on judge cannon, if any indication she gives about which w

paula reid and shan wu.do you make of the fact that the trump grand jury here in washington apparently went dark today? >> i think we have to remember that we don't actually know what doj's schedule was. it's certainly true a target letter is be in time pretty close to indictment. for what we know going dark isn't going dark. >> normally the grand jury meets tuesdays and thursdays. >> yes. this apparently does meet tuesdays and thursdays. given they're having a lot of activity is inexplicable why they're not seeing anyone today. i don't know if that necessarily means there is a issue with the schedule of the indictment, because we don't know what that schedule was or is. >> there is some suggestion, as you heard, that maybe the optics of the hunter biden case tomorrow, that they didn't want to do something at the same time involving the grand jury and trump in some sort of indictment. >> that's an interesting perspective. the attorney general seems very sensitive to optics. i can't speak to what he would say

and paula, i started the show with the words "no show." we were expecting on tuesday, on thursday, the grand jury which doesn't necessarily mean it's exactly tied to when news may break of a possible indictment. but what do you know about why the federal grand jury did not appear to meet today when this case appears to be coming to a head? >> reporter: it does appear to be coming to a head. and while this grand jury does usually meet on tuesdays and thursdays, that schedule can be amended to suit the needs of prosecutors. but, as you said, today there was no indication they were in the courthouse. but prosecutors have plenty of other work to do. over the past 48 hours, they have received thousands of documents created by the team of lawyers that then president trump assembled to try to find any evidence of fraud in the 2020 election. erin, late last night, we obtained many of those documents after reviewing them. none of them really seem critical to any possible prosecution of former president trump. and it still remains our reporting that

let's get straight to cnn's paula reid, who's been following every development of these investigationsula, this trial date does not seem like a win for either the special counsel, which wanted december, or the trump team, which wanted, you know, never. so why did judge cannon pick may? >> well, the central conflict right now in this case, jake, is timing. defense attorneys have said it's too early to even set a date and they said it would be, quote, unfair to try this case before the 2024 election. prosecutors told the judge they wanted to move this along quickly and suggested december would be the time they could take this before a jury and here the judge, look, she split the difference. but the trump team said today they don't think they'll have any problem pushing this beyond the 2024 election. and it's easy to see how they could possibly do that. jake, if you look at the judge's order, she also included a very detailed schedule with over 30 different deadlines for all the things the lawyers need to do between now and when this would go to trial. and it's easy to see how in this cas

so what did you learn first of all, paula? last hour or so, we've gotten a sense of just how former president trump's legal strategy of trying to delay any prosecution and any criminal prosecution until after the election just how that is is going to play out down here in florida. this is a significant hearing because this is the first time that special council prosecutors and deefense attorneys appeared before judge ilene cannon and we're watching to see how re sentive she would be to trump's efforts to try to delay this and over the last 90 minutes she very open to delaying this. one of the central tensions is the fact that special counsel jack smith wants a speedy trial and they said they would be ready to take this to trial in december. but today if the hearing the judge called that a compressed timeline. she said cases like this take more time. and she really pushed back on the idea that this case is not what you would describe as a complex case. there is something that should take more time. now, defense attorneys were u

paula, what more can you tell us about this february 2020 meeting? we understand it was in the oval office, and how key it may be for jack smith? >> reporter: erin, based on this new reporting, it's clear that the special counsel is really focused on trump's mindset before he started publicly attacking the integrity of the u.s. election system. another thing i think is really interesting in this new reporting from our colleagues is that they also asked multiple witnesses if trump ever retaliated against other officials who contradicted his public criticism of election integrity. this is significant because it all goes to knowledge and intent. so what exactly did trump know, and what was the intent behind so many of these public statements? and now you can expect that investigators are trying to reconcile what he was saying privately, like in this meeting, with these public statements. >> so, paula, it is amazing just to imagine that such a flip-flop could actually exist. i know you're also learning about thousands of documents that the special counse

>> paula, you were back in haiti earlier this month. share with us what you witnessed during your time there? obviously the surgery is the curious. put it in perspective. >> i think as well as the security situation, everyone is aware of on the ground, unfortunately for so many in haiti, this comes on top of the humanitarian situation. whether they are looking for food or water or education or healthcare, anything, on a given day, becomes more difficult. the fact that most of the violence is centered in port-au- prince. those gangs and violent territories are now block all arteries in terms of transportation from one end of the country to the other. this really seems to hamper so much of what's going on in haiti and really does complicate and compromise people's livelihoods. the other thing that people have been talking about, a vigilante. it has inspired by certain people who have decided to take matters in to their own hands. they have tried to combat with mixed results or there is no way that cnn can verify what has been going on, on

cnn's senior legal affairs correspondent paula reid is here. paula, great to have you. so what of the classified documents at the heart of this case was reportedly an attack plan involving iran. what new information do you have? >> reporter: this has been such a big question in this investigation because, of course, cnn broke the news that there was a recording of the former president appearing to show an actual classified document to people who did not have security clearances. but when the last indictment was released, that specific document was not included even though the recording was featured very prominently in the indictment. so in the superseding indictment, it was notable to see that they had added this document suggesting that the government is in possession of it and it's a top-secret document. but, alison, why wasn't this included in the first one? cnn has learned this is one of the documents that was returned to the documents. that is significant because it makes it harder to argue successfully in court that he willfully retained this. now, it could be tha

what was discussed about a possible trial date, paula? >> reporter: it's pretty clear from what i saw inside court today that this case is unlikely to go to trial this year. special counsel prosecutors had told the court they'd be ready to take this to trial in december but today judge eileen cannon made it clear she thinks that's likely premature and called that timeline compressed and said cases like this that involved classified materials take more time. defense attorneys say that's unusual and it would only be fair to delay this case until after the 2024 election. prosecutors punched back at that saying he's not president and it doesn't matter if he's running to be president again. they insist he should be treat $ l treated like any other important, busy american and shouldn't get special consideration. it was interesting. the judge didn't seem interested in litigating these larger constitutional questions about a presidential candidate possibly be put on trial. instead, she wanted to focus on the lawyers and how much time it would ta
