paula, what more are we learning tonight? >> we're learning a lot of new details about the kinds of evidence that the ethics committee has gathered in its investigation into former congressman gaetz. we've learned that they've actually mined information gathered in a civil lawsuit down in florida. now, this civil lawsuit was brought by an associates of gaetz against some people who were named in the criminal investigation. but as a result of opening this litigation, they engaged in discovery, which created a whole new deposition with the girl, who was just 17 years old when she allegedly had sex with gaetz. her but the lawyers for those who were sued in this case incorporated some of her sealed testimony into their own questions that are now because of this lawsuit, part of an open record, including a statement where she claims that she had sex with gaetz on an air hockey table. now a lawyer for another woman who is spoken to by the ethics committee, says that she saw gaetz having sex with a minor. let's take a listen to what

i want to go to our chief legal affairs correspondent, paula reid. right now paula, lay out your very exclusive reporting about gates and the timing of your reporting. >> well, wolf, our colleague sarah ferris and i broke the news that the woman who is 17 years old, when she says she had sex with gates, told the house ethics committee that she had a second, previously unreported sexual encounter with gates that also included an adult woman so it was allegedly a threesome the alleged underage victim testified this encounter occurred at the same florida party in 2017, where she also testified she had sex with gates on that was revealed in a civil deposition we reported earlier this week, the justice department investigated allegations that gates had sex with a minor, as well as other alleged crimes, and did not charge him. gates has denied wrongdoing. the adult woman, the witness referenced also denied having sex with the minor. but before we published this story, we contacted gates about this reporting and while we were waiting for his response a few

we talked about this briefly, touched on it with with paula. but the fact that the two co-defendants in the classified documents case, the jack smith, is not dropping the case there. how do you expect that to play out in the early days of the trump administration? what do you expect the trump justice department to do with that well if the case proceeds, i mean, it would seem to me that the jurors would be scratching their heads wondering why. >> i mean, i'm sure they can put two and two together, but they've got to scratch their heads and wonder why the main defendant is not there. i mean, it seems to me that it's a fool's errand to pursue the minnows when, you know, the big fish is with the congressman that you know, whether you like the results of the election or you don't president trump, for the first time in a generation won not only the electoral electoral college, but he won the popular vote. and we really need to to move on. and i think that this decision by mr. smith i think he had to do it. but i think it's it's the right thing to do.

reed, paula, what can you tell us? >> we will wait another week at least for this answer from the judge, who oversaw trump's criminal trial earlier this year where he was convicted on 34 counts of falsifying business records. the judge had given himself until today to decide whether the supreme court's decision earlier this year granting trump immunity for actions he took in office, whether that apply to this conviction, there were pieces of evidence that could be construed as official acts, within conversations that he had with some of his staffers. so the judge said i'm giving myself until today to just decide whether the supreme court's decision means that this conviction should be tossed. while we are waiting for that decision, we learned in fact, they are giving it another week before the judge decides on this issue. sources tell me that prosecutors and defense attorneys have been discussing this over the past few days and they mutually agreed to delay this deadline so that trump's lawyers can have additional time

and we're getting paula some new insight into what is going on in the house ethics committee report. actually through a civil lawsuit in florida. it's kind of like a side door roundabout thing, but it's actually quite illuminating. yeah, it is. this is a lawsuit that was filed by a friend, a former congressman gaetz, against another one of the friends, joel greenberg, who is in jail after pleading guilty to several crimes and the woman who is allegedly 17 years old when she had sex with the former congressman. he sued both of them and as a result, they had to engage in discovery. they created a whole new record of evidence. now the underage victim was deposed but her deposition, as well as other women in this case, they are all under seal. but lawyers got kind of crafty and used some of what is under seal in their questions to the man who filed this lawsuit. so we're getting a little bit of glimmer of what that underage formerly underage woman said. for example, the lawyers asked the asked gaetz's friend and you heard her testimony that she said that you observed her and matt gaetz h
