he served under ben bernanke, he worked with secretary paulson. if there is criticism, it goes to all of them. i think it is important that it be independent, that it not be a second thought from the bank regulators, whether one banking regulator or individuals, and i believe that will make a great deal of sense to give the consumer -- the gentleman said let's give them equal status tree you give them an equal entity, subject to others. the bill itself had a common theme. one criticism was that the bill was to create. we probably exceeded the attention span of some members of the congress, but i guess they can wait for the movie. we are dealing with an interconnected system, and we dealt peace mail, and there was a central theme and it was that by sources of liquidity outside the banking system and by increased information technology, people in the industry have figured out a way to engage in lending while appearing to escape the burden of risk. they appeared to be able to afford risk themselves. is that not all white. it exploded on all of us. do

i'm ken paulson, executive director of the first amendment center. holly hughes is a widely respected performance artist who is known both for her thoughtful work and as a member of the n.e.a. four. her fight for free expression took her all the way to the u.s. supreme court. she's here today to share her thoughts about that battle and about free expression in america. welcome, holly. thank you, ken. now, a membership in the n.e.a. four-- that's not exactly like joining the kiwanis club. no, it's not. it was kind of an honor-- dishonor sort of imposed on us by the national council of the arts when they took away our funding that had been recommended. it sort of sounds like a bad band, you know, that-- or we were later referred to as karen finley and the three homosexuals, which sounds like a really bad band. i've seen them play. [laughs] and yet this has been a battle. your status as a member of the n.e.a. four has been a decade long, really. yes, it all started in 1990, when the four of us were recommended for funding by peer panels in the n.e.a. an

whenever secretary paulson -- what ever secretary paulson said a week ago or a year ago, it was hard to keep track of. >> first, the whole idea of using tarp for foreclosure relief and modify loans, that is not an idea that it originated from the treasury department. this is something that congress wrote a section into the statute that actually dealt with how to modify mortgages once we own them. and i think that the fact that the trade changed, while it is certainly an investment -- an indication, it is not a justification. it is not as if they did not have enough headroom because it is not as if they did not have enough funding from the tarp assets. there certainly was the room for it. i know that during the timeframe of transition the bush administration and the paulson treasury department were working on foreclosure ideas. they knew very well that this was still part of the product. and ultimately, after the election they were asked essentially to stand down by the obama administration saying, we do not want to inherit your program. we do -- we want to launch our own program. and

that because members will remember it was in the fall of 2008 that we were summoned by secretary paulson and ben bernanke, two bush appointees and asked to do t.a.r.p.. it was a bipartisan response to that. the gentleman from alabama was critical of t.a.r.p.. he is unfair to the bush administration in that regard but i do appreciate the bipartisan nature of his criticism. the secretary gave preference to the automobiles and foreclosures. he very carefully said it was from the banks. we have not recovered the money from automobiles. what we have is the american automobile industry, would not have happened if we hadn't intervened. ford which was not seeking any funds actively supported that for feared general motors and chrysler were not bankrupt or assisted in the supply chain would have disappeared. at a time we talk about enhancing manufacturing america that was the biggest thing we did. i would have to say the governor of alabama's description of the process doesn't cover what went on at the house. i wasn't privy to them but certainly was not a case when the administration told us to g
