i'm joined by the person who filed the suit, texas attorney general ken paxton. mr. thanks for coming on. >> i appreciate you having me on. >> let's start with -- make the case for me of why -- what the obama administration did what unconstitutional? they make the constitutional case that sex discrimination also applies to gender identity. you guys say it's unconstitutional. walk me through it. >> so title ix and tigts 7 were adopted in the '60s and '70s. they have specific definitions for sex, and gender identity is not in that definition. congress debated this for years, goat back to the '70s. even in 2015 they debated whether to change this. and they didn't do it. our argument is very simple. congress needs to decide this. it is a statutory change. and the president has no authority under the constitution to make changes in law. so it's not a complicated argument. it's very simple. and we think it's right. >> there are some -- not to get into the total weeds here, but there are some title seven cases though where there has been an interpretation of sex discriminat

joining me is the texas attorney general, ken paxton. thank you for joining me. appreciate your time. >> thank you for having me on. >> you say this is about federal overreach. tell me why you don't see this as a civil rights issue. >> it may be a civil rights issue but the authority vested in congress to change law comes in our constitution. there have been congressmen who is tried to change law to address this issue, it hasn't happened. so the president has come in as the president, he's come in and changed this and he doesn't have the authority to do that under the constitution. that's the argument. we think it's right. >> if you were to believe this was a civil rights issue, would there be a pathway to allowing transgenders to use the bathrooms in your state? >> this is governed by congress. if they want to have that political debate, i'm all for political debate and i'm all for congress making the decision. those are our elected representatives. but one person should not have the ability to come in and change the law. >> why can't states move to either accep

paxton, what do you say to families like theirs? >> we take care of all children., this is dealt with on a case by case analysis. we have a problem with is the obama administration coming out with a broad, sweeping policy that sort of one size fits all and they did it without congressional approval and going outside of what think is the stated law in the statutes. >> but the family needs that protection, government authority to step up and make sure their child is going to be safe. do you want protections for transgender students? >> here's what i'd say, as i said in our state, it's dealt with by each school district on a case by case and they should deal with it as they see fit. if there needs to be a broader policy here, broader statute, it should be done by congress. right now you have a president acting outside constitutional authority and that's fundamentally a problem we can't live with. >> a statement opposing north carolina's bathroom law, discrimination of transgender youth can cause real harm. i have interviewed a lot of families and a lot of people who a

in terms of ken paxton's remarks, he continually is telling lies. first one is somehow the geithner from the obama administration -- guidance from the obama administration gets rid of segregated bathrooms. it doesn't as all. i think it is important to correct the misperception this was a directive. it wasn't. it was guidance from the administration. it is nonbinding. it lets schools know what it means to treat transgender students consistent with title ix. it w w not bindiding and it is t a directive, it is guidance. it is the only interpretation of title ix, but there have been many distortions. nermeen: what about the legislation regarding hb2 in north carolina? what is our response to that? >> north carolina we are also seeing hb2 passed in a special session earlier this year. the governor was given several days by the federal government to bring north carolina law into compliance with very well established federal law and he did not do so in an that filed his own lawsuit against the united states which in turn filed a lawsuit against north carol

joining us now is texas attorney general ken paxton. thank you for being with us this afternoon.what the lawsuit is meant to do. >> it's meant to stop the obama administration from implementing new guidelines that are in direct violation of current law and it's mainly trying to stop him from doing something that he's not authorized to do under the constitution. >> now, texas receives nearly $10 billion in federal education money. the government could pull those funds, at least some of it, if you don't comply with the administration's guidance on treating transgender students. you have said before publicly on another network that this is a solution in search of a problem, that essentially there is no problem of abuse going on in bathrooms with transgendered folks, so why do you put funding for educating the state's children at risk for a problem that doesn't exist? >> we're not putting the education at risk. it's the administration that has threatened to take away funding from our schools. there's 100,000 schools in the united states, millions of children. if this policy goes into

joining us now to talk about this, ken paxton. mr. attorney general, appreciate you being here, sir. i'm sure you had a chance to read president obama's guidance, if you will and i know you've had a chance to read title 9, 1970s part of the civil rights act that the administration is basing all this on. as i read it and i'm not a lawyer but in those words of title 9, nowhere does the words transgender or gender identity appear. how is the administration getting this power or are they just out to lunch on this? >> they're making it up. this is similar to what they did with obamacare and what they do with immigration. there's nothing in the statute in the constitution that gives the authority to the president to make new law and clearly just as you said, title 9 does not give them the authority to redefine what the definition of sex is to include gender identity so we're going to fight this all the way because we don't think that he has the authority to do it. >> you say he doesn't have the authority to do it. josh earnest from the podi

joining us now is texas attorney general ken paxton whose state is one of the 11, leading group on the attorney general thanks for joining me. i am still trying to get my head around what you are trying to gain in the lawsuit? what are you suing for? as i see it federal government wants to pull money from you if you don't follow what they say is the law. what is your lawsuit alleging? >> earlier in your program you talked about the president has to follow the rules something like this, the rules here are the u.s. constitution. the constitution provides that congress makes law and they can change law. in this case these statutes have been in place since the '60s and '70s and congress hasn't made this change. the president has come in and changed the law and expects us to follow it. that is not the way the constitution works. this needs to be congress. >> you are better at this than i am. it's not so much changing the law as i see their position as it is saying what the definition of sex is. i think it all comes down to the definition of sex and that is a protected class. so they would t

attorney general in your state, ken paxton just issued a statement saying that president obama betterre, this is a quote, better prepare for yet another legal fight. what's it going to look like? what will the fight be? >> i was thrown into the middle of this and this tuesday, the fort worth independent school district with a direct connection with a similar policy. without going to the school board or the parents. it was an executive order from the superintendent and this is what the president has done without going to congress, without going to the people, issuing a policy that does nothing to improve schools. nothing to improve math and reading scores. this is about social engineering that is going to be totally disruptive to our school day. parents are not going to accept it. last year, ashleigh, i was involved in an ordinance in the city of houston. a very heavy democratic city. and we fought back and we defeated an ordinance that allowed men in ladies room two to one. so this is not a republican or democratic issue. this is a family issue. when the president threatens the state

ken paxton is ag, press conference at 4:00 later today.share about this challenge? >> can't say specifically what that press conference is about but we have issues with what the president has done. he is not following the law, doesn't have authority to do this. bill: one sex is a biological fact, not a state of mind. explain your case. >> we are resting on the law here, we don't think the president has constitutional authority to do this. i'm in a press conference with hundred parents in fort worth where this policy was adopted and i can tell you this crosses party lines. this is an issue parents are concerned about and an issue texans are concerned about. bill: how can you win this case? >> the law is clear. there's nothing in the law that allows these guidelines, changing definition, congress has to change the law and they haven't done it. we think we have very strong legal argument to be successful. bill: you are making is on voter id law. you were defending the law in texas on what grounds? >> the legislature newly elected adopted vote

joining us with his take, ken paxton.ect in order because they don't explain what transgender mean. why do you think the white house has bothed to explain this term in its order to the states? >> that's a very good question. the entire policy is vague. it's also we believe unconstitutional because they don't have statutory authority or constitutional authority to change the statute. that was done by congress and it needs to be changed by congress. this needs to be a debate in congress, not with the administration just unilaterally changing the law. >> my understanding is the white house believes that your sex is whatever you say it is, obviously ignoring science and common sense and thousands of years of precedent. whatever you say it is, that's what it is. >> that's my understanding and obviously we're concerned -- i'm the chief law enforcement officer in my state. my biggest concern is safety of children and women. if one child is harmed because of this policy, i have a concern. >> their position is that large numbers o

. >> senior deputy paxton reinecker supervises the suicide floor, which houses the most severe mentallyey're new to the seventh floor are given the suicidal gown, and what that does is it's nearly impossible to tear that gown apart to hang themselves, clog the toilets, the stuff that they do on a daily basis, a lot of these guys. >> inmates who are suicidal are put in single cells and are checked on every 15 minutes by a deputy. >> tell me again one more time nice and slow. >> you know, i eat myself because -- >> you eat yourself? >> yes. because two officers lied to me. >> they just lied to you? >> yes, they do. >> what did they lie to you about? >> i'm the chief of the fbi. i'm deputy chief of the fbi. edgar hoover signed a bill that made me chief of the fbi. >> this inmate, who due to his mental condition cannot be identified, has not left his cell for seven months. >> a lot of the writing on the door is human feces, and he also has combined a little mustard on it for coloring. so that's what he's writing with on the actual door. a lot of the stuff inside he's able to get a lead tip

the assistant commandant, general paxton, said he's looking into it. when you look, for example, the january crash of two ch-53's that killed two marines, can you draw a line between budget cuts and that fatal crash? mr. thornberry: i have not been briefed. if they finished the investigation on the exact causes of that crash. but needless to say, there have een a number of mishaps, crashes, some of which have een fatal that caused enormous concern and certainly -- i think it's important to say that military training is inherently dangerous to some extent. but what's disturbing is i look at the 10-year trends or the 10-year averages plus the more recent trends and something is drastically going wrong. and so i do think it's up to the leadership in the pentagon and the military and us to find out what it is and to take action today to fix it. you know, we can't wait on a new president or congress to fix the budget control act to say, ok, we'll go ahead and put these lives at risk until we get our budget act together. i don't think that's a good option. k

texas attorney general ken paxton is leading this and he joins us now. welcome to the program.to make sure we have this right. does the obama administration want to make it so that any child in school can go to any bathroom of their choice at any age and into the showers or the changing rooms? is it like that? >> no. you have it right. including school trips where you might have male and female separated, somebody can decide if they are female for the day and stay in a different room. it is pretty broad policy affecting millions of schoolchildren around the country. stuart: your objection in legal terms is the federal government has no business telling the state how to run bathroom policy in schools. is that the gist of your lawsuit? >> that is part of the just. the other is the president doesn't have the authority to change like, it is up to congress. there has been debate about this for years. some congressman tried to change this. it never happened but it cannot be changed unilaterally by the president. stuart: why is president obama doing this? it would seem to be wildly un
