peggy fox has been covering this case from the start and joins us with reaction. peg, what are people saying? >> well, daniel harmon-wright is back in jail and the family of patricia cook is relieved tonight. and there might be a small amount of reloaf from the family of daniel harmon-wright because had he been convicted of the most serious charge of murder one, that carries a maximum life sentence. now just a short time ago, daniel harmon-wright was escorted from the courthouse in handcuffs, escorted from the courthouse to the jail. he seemed to be trying to hide his face as he bowed forward and he also shook his head from side to side and seemed to be in disapproval or shock of the verdict. now a jury of eight women and four men found him guilty of voluntary manslaughter, unlawful shooting into a motor vehicle, and shooting into a motor vehicle resulting in death. a year ago on february 9, he shot and killed patricia cook. she was a 54-year-old unarmed housewife who was trespassing, sitting in her jeep wrangler in a parking lot of a private school. there was a s

as peggy fox reports, they're already required in several states, but the seller and the buyer meet a licensed dealer who runs the tech. >> reporter: virginia tech shooting survivor collin goddard has gone undercover at gun shows across the country to show how easy it is to buy high powered firearms without a background check. >> this is exactly the problem we want to stop. >> we bought this gun last year at a dale city gun show with no background check. >> reporter: omar salaha whose sister was killed believes everybody needs bake ground check. >> if somebody fails a -- a background check. >> if somebody fails a background check, the police are supposed to investigate why there was a failed sale and last year in virginia alone it led to 850 arrests. >> reporter: but still virginia and 32 other states do not require background checks on private sales. some gun stores like sharpshooters here in lorton will do a background check on a private sale. they will charge $40 the seller first has to transfer the gun to the store before the background check can go through. while some gun sellers

our peggy fox has been covering this story. we're going to go to her live for an updated report. >> reporter: her name is judge mary grace o'brien. just moments ago she agreed with justin wolfe's defense team to release him as of tomorrow at 5:00. that will be ten days -- a ten- day limit that federal judge jackson gave last week. he ordered that justin wolfe be released because the commonwealth did not -- the commonwealth did not retry him soon enough, within a 120-day -- 120 days of when they were supposed to retry him. justin wolfe was convicted back in 2001 on murder for hire of the killing of danny petroli. he has spent the last 11 years on death row. then last year, that conviction and death sentence were thrown out. judge jackson found prosecutorial error. he said that the prosecution in the case had withheld very important evidence that would have helped justin wolfe and said that the man needed to be retried. that did not happen within the time frame and last week he ordered his release and today the judge agreed to re

i'm peggy fox reporting live in culpeper. back to you. >> so peggy, was there any comment about the verdict, a come provised verdict between the murder and letting him off all together? >> well yes, we talked to the commonwealth's attorney. the special prosecutor in this case is jim fisher, and he said that he wanted it to be citizen's based. he felt that they needed to decide which level of murder. he is not upset they did not choose murder one, but he felt a crime was committed. that it was an unlawful shooting. he had no right to shoot this woman who was unarmed. his self-defense plea was made up and did not hold up and the jury actually believed that. they did not buy his claim of self-defense. the defense attorney got in his car and drove away. he told us earlier that he would only talk to us, depending on how he felt and i think he was very disappointed. however, as some spectators pointed out, it could have been a lot worse. he could have gotten murder one and that carries a twenty year to life sentence. so you know, i
