good morning to you there, peggy.ficant because it would be one of the first if not first case of violence since the new california law gave transgender individuals to choose which restroom they use. a female who identifies himself as a male says that yesterday morning the three boys forced him into a handicapped stall, locked the door and physically and sexually assaulted him. he was taken to the hospital. there have been no arrests because the victim did not get a good look at his assailants. the school doesn't have security cameras outside the bathroom. that's something the board wants to change. police are counting on that they will talk and gossip and the identities of the three attackers will come out. >> we do know that the attackers made disparaging remarks against the victim which is adding to the sexual assault investigation also being made a hate crime. >> we're horrified by what happened. it's terrible that any student on this campus would have to be subjected to that kind of criminal conduct. >> hercules

good morning, bob. >> good morning to you, peggy. we've spoken with friends of the suspect and they believe that he must have been provoked, that he acted in self-defense when he allegedly stabbed to death this 16-year-old boy who we just learned was a junior of boynton high school here in campbell. this is who campbell police have arrested. you're looking at a california i.d. photo of todd that were. he's a 24-year-old man who police say is a transient, has no permanent address, he hops from one friend's house to another. last night, he befriended a group of teenagers here at john d. morgan park. if you're not familiar, this is campbell's largest park. lots of redwood trees. up against campbell middle school. that were and the teens were hanging out when around 8:30, things went south. during this fight, police say he pulled out a hunting knife and stabbed the 16-year-old boy. >> something had to push him that way. and it's probably because they were jumping him or something. he's actually a good person. he's harmless. >> is tharp c

good morning to you, peggy. those two men that we're about to show you, they are persons of interest according to police. not only in the theft of the suv from this parking lot here and walmart but also in the death of the dog. the dog did end up passing away. this is the surveillance camera image of the two men police are looking for. they appear to be in their 20s or 30s, maybe a little older, hard to tell. both have facial hair, one in the foreground has a goatee, the other a goatee or beard. investigators believe they are connected with the theft of this suv a week and a half ago from this walmart. in the back seat was a 15-year-old dog keiko who was a life long companion to michael mcvey. mike mcvey spent four days looking for the dog thinking that the thieves would have let her go. unfortunately no such luck on the fourth day he received the devastating news from police that the suv, his suv, was found in a walmart parking lot in san jose with keiko still in the back seat, dead from thirst and starvation.

i'm peggy bunker. we begin with new details about a police chase that ended with a suspected drunk driver plowing into a crowd of people at a festival. he went through a barricade at the south by southwest festival in texas. bob redell has more. >> reporter: we just heard from austin's police chief, and he calling last night's events intentional. the man is now facing two counts of capital murder. this is eyewitness video of moments just after the collision. one man says people went down like bowling pins. this happened around 12:30 this morning texas time. they were trying to pull over the suspect for driving drunk, but instead he sped away, going down the wrong way on a one way, and went down a street that was closed for the festival. he almost hit an officer, and he almost hit several people. a woman from austin was killed as well as a man from the netherlands. another 23 people were hurt, eight in the hospital, three in critical condition, two in serious. the suspect ended up crashing. running away

good morning to you, peggy. a man and woman here at this home behind me, this fire started around quarter to 4, you can see this fire is now out thanks to sjfc. they had to call for backup making this a two-alarm fire. when they arrived both those people had been able to get out on their own, the fire department tells us one reason they might have been burned and not get out as fast as you can see there are bars on the house. they had to be cut down. that might have slowed their escape whether they were coming out through a window or the front door which has a gate in front. that part is unknown. fire department tells us that when they arrived it was fully involved, it appears the fire started in the rear of the house. there is an outside structure there that was fully involved. that structure collapsed, might have been a shed or something like that. it's not clear if that's where it started or where it spread to but again, two people seriously burned, captain thompson, even though they were able to get out on t

. >> and i'm peggy bunker. we do begin with breaking news after a suspected drunk driver facing serious charges this morning, police say he plowed into a crowd of people at a popular music festival in texas. two people were killed, more than two dozen hurt. bob redell joins us in studio with the latest on this deadly crash. bob. >> good morning to you. police in austin say the driver faces not charges of vehicular manslaughter but capital murder. two charges of that. a witness videotaped the scene moments after the drunk driver drove through a crowd of people. you can see people in this shot here hunched over the injured trying to help them, in one instance performing chest compressions on an individual trying to bring that person back to life. police say just prior to this they tried to pull this driver over for what was a traffic violation. instead he sped off down a one way, turned on red river street which had been shut down for the festival. it was crowded with people leaving. he plowed through knocking pe

good morning to you, peggy. they have about 13 san francisco firefighters here overnight doing what you were talking about, basically keeping a close eye on this. they have got one firefighter on a ladder truck there. he has a hose, he is looking for any signs that this fire might be flaring up again. they did see a little bit of that but right now they say it's not a problem, things looking good. three engine companies watching round the clock as this once tall building is knocked down to four stories at its highest. demolition crew desire press on this burning building into itself to prevent collapse into the street. overnight the demolition has stopped while investigators continue to look for a cause. they still focus on welding but it's too unsafe to actually go in. >> that would be honestly i think we would have everybody down here, all of the structural engineers to talk about the integrity of the building. right now it's not because everything is -- it's just a piece of scaffolding could fall at any time

. >>> it had been a mess on the roads in northern virginia, peggy fox driving all day evheerywre from tysons to woodbridge. >> she's seen cars stuck in all kinds of places. right now she's live from woodbridge. what's the view from there? >> reporter: actually we're in springfield now at the interchange and first of all, it is very cold out, 20 degrees, but it is so nice not getting pelted by ice or snow in the face and look at this, pavement on i-95, looking pretty good. you can find some slush still on the highways, but cars seem to be going at speed and it's nice if you are riding on the highway and the snow is gone, but on the less traveled roads probably in your neighborhood it looks like this, still very icy and slippery and it's okay if it's flat, but if there's any incline, cars will slip and get stuck. we saw quite a number of examples of that this morning. the risk for motorists with no four wheel drive who ventured out in the snow was this, wheels spinning on an uphill road. luckily four fairfax county police officers came to the rescue here pushing one vehicle after anothe

i'm peggy bunker. >> i'm laura garcia-cannon. nbc bay area was exclusively on the scene when senator yee was arrested at his home in the sunset district in san francisco and taken away in handcuffs. let's bring in diane dwyer, you were there? >> reporter: yes, fbi agents right now are interviewing leland yee here. he was one of about 30 people arrested in what is called a massive fbi sting. i was one of the only journalists on the scene. as you mentioned, they led him out in handcuffs after spending about an hour and a half inside interviewing him. he was arrested for his work and campaign work. yee is a democrat that served in the assembly as a san francisco supervisor and school board back to the 1980s. one of the promises he just received an award for was to increase transparency in government. it was part of a larger operation. here is what the fbi told us a couple hours ago. >> this morning the fbi is currently executing multible search and arrest warrants throughout the bay area. i have no more comments at the time because

. >> and i'm peggy bunker. some people in san jose are waking up this morning to blinking alarm clocks after a fire at a marijuana grow house forced pg&e to shut off power to a block overnight. bob redell is live in san jose near this burned home. i guess the question are the lights back on for the entire block? >> reporter: they are. good morning to you, peggy. the lights are back on, on lanier drive after this house caught fire 10:30 last night. and what the fire department tells us was a marijuana grow. firefighters pulled out around 70 plants from the garage where this operation was based. it started around 10:30, took a while to get under control. two hours, unusual amount of time in a situation like this but the reason it took so long is because of the electrical hazard inside. turns out the residents bypassed the electrical boss to draw electricity to power all of the lights needed to grow marijuana plants. >> we were unable to secure the electrical, disconnect it. with live electric lines it's a hazard

peggy. >> amazing. a lot of dedicated people. new this morning firefighters battling an overnight house fire on stonewall avenue in hayward. less than a mile from longwood elementary school near highway 880. they discovered a room full of pot while there. a marijuana grow operation was found in one room. when the fire broke out before midnight no one was in the home. they are still investigating to see if the electrical system may have been tampered with to avoid detection. police are waiting for a search warrant to start removing plants and also equipment. >> a bay area father remains in jail for allegedly attacking his baby. police say yesterday morning joshua cooper got frustrated because his 1-month-old son was crying. so he bit the child's nose off. moments late ter baby's mother made a frantic call to police. the baby is in stable condition at oakland children's hospital. doctors found the child also suffered a skull fracture and brain hemorrhage in addition to the severed nose. >> police could file criminal charges against

i'm peggy bunker. >> i'm laura garcia-cannon. mountain view leaders will ask for federal money to help ease traffic. christie smith joins us live with details on the proposed pod car transit system. good morning. >> reporter: good morning to you. this is much different than b.a.r.t., different than light rail, things we're used to. we're talking about a two-person pod car system that would basically move above the people on the street to help alleviate traffic congestion in places like the downtown area and other hot spots. skytran is the mountain view-based company that's developing a personal rapid transit system. sort of a small pod car using magnetic levitation. it's looking at the city here in mountain view to help back its demo project at the nasa aims research center that could rink the downtown transit with the google future campus and the ellis street station. the city considering talks with the u.s. transportation secretary and local companies about a possible grant fund for cars safely above the ground. >> they will be

good morning to you, peggy.s home here on aetna way, the area around it has been declared a crime scene by san jose fire, this happening in the past 10, 15 minutes. saying it's possibly a case of arson. they wouldn't go into detail but did tell us that the arson investigator on the way to the fire went to interview the man and woman who escaped from this fire at the hospital now. spoke with them and whatever information they gave the investigator led the investigator to believe there was something suspicious about this fire. this fire now a crime scene. started around 3:45. you can see how intense the flames were. located in the back left portion of the house. there was also a structure fully involved. i don't know if it's a shed or overhang but that structure was destroyed and ended up collapsing. the two people were inside the home, they both escaped but unfortunately they were both seriously burned even though they escaped on their own, walk and talk when they came out they were seriously burned. taken to the

. >> i'm peggy bunker in for laura garcia-cannon this morning. let's take you outside right now for a live look across the bay area at the bay bridge toll plaza. emeryville and san jose. what you need know before you head out the door. let's check in with meteorologist anthony slaughter. good news on the rain. >> we saw decent amounts. we got about a quarter inch adding to the deficit of the drought that we're in but you'll notice right now as we look at the live radar, not a lot happening. a few sprinkles out there and drizzle once you start that morning commute. otherwise skies are going to clear out as we head through the day. so we do have fog, drizzle right now but as we head through the afternoon hours i do think we're going to see a good amount of sunshine. in san francisco visibility starting to improve but that drizzle really hanging on tightly. this afternoon temperatures top out in the mid-60s, so a few degrees cooler from where it was yesterday all because the cold front moving through. tomorrow back in the 70s and same for saturday.
