perkins. thank you for your story about luke and his travels and journey and all that you and your family have done to bring him to this point in his life. when judge taha -- did i pronounce your name appropriately? when she talked about the standard, she left out one word. merely. merely. i'm trying to draw an analogy. if i said when it comes to hungry children, the law requires you to provide them more than just a little bit of food, that is a lot different than saying, when it comes to hungry children, the law requires you to provide them merely more than just a little bit of food. difference? one word has made a big difference. it has taken de minimis lower. that was the express statement by judge gorsuch, which expanded what was the tenth circuit standard when it came to your son. it was the express phrase merely more than de minimis that the supreme court unanimously struck down yesterday, meaning that means no education at all. when you saw that opinion, what was your reaction that judg

perkins. >> mr. chairman, members of the committee, thank you for the opportunity today to give voice to my son whose access to an appropriate education and thus meaningful and dignified life was threatened by views of judge gorsuch. luke was diagnosed with autism in 1996 at age 22 months. intensive early education program taught him letters, numbers and colors but he struggled with speech. he developed restricted diet and erratic sleep cycle. when overwhelmed he would tantrum and often injure himself. his care became too much. his older siblings and hired caregivers helped. it was clear that his education program was failing and luke began to regress significantly. teachers were reinforcing inappropriate behaviors and he was not participating in meaningful educational activities. his program failed to address profound inability to generalize. he might learn a skill with one teacher but be unable to perform it in any other setting. while such learning might check off box on education plan it provided

jeff perkins, luke's father, is testifying before the judiciary committee today. their story is powerful. judge gorsuch ruled that luke was not entitled to attend a specialized school because he was able to make more than de minimis -- the bare minimum progress, in the normal educational system. just yesterday, mr. president -- just yesterday, the supreme court unanimously -- unanimously -- including justices alito and so many others who were so conservative -- rejected judge gorsuch's interpretation of the idea. the court hold that, quote, when all is said and done, a student offered an educational program providing, quote, merely more than the de minimis progress from year to year can hardly be said to have been offered an education at all. that puts judge gorsuch's interpretation of the idea law to the right of even justice thomas, a very difficult feat. mr. president, who we put on the bench -- their basic judgment matters. while i do not think that the personal views and experiences should bear on the decision of day-to-day cases, there is a reason we don't p

"fox5" caitlin roth has an update on the winter weather. caitlin. >> tony, shawn, another bitter cold night ahead and icy patches out there. so i can understand the delay for northern virginia. for those of you going back to school tomorrow it will be bitter cold. that's what you wake up to. wind chills and temperatures out there. and now it has been incredibly cold day. we reached high temperature of 32 in district and 31 washington and a lot of you north and west didn't make it to 30 and right now it's 27 gaithersburg and 28 frederick. winds gusts came down exceeding 45 and even 50 miles an hour earlier today and right now 28 mile an hour wind gusts in washington that's improvement. it will be at least a little breezy overnight tonight and that's all it takes for those bitter wind chills to show up tomorrow morning. here's what we're looking at now when you step outside feels 15 dulles and 14 gaithersbur

this is serious business but i will tell you about another one, suzanne perkins. she is a 62-year-old living in altamonte springs. suzanne's husband lost his job in 2009 and she lost her employer-provided health plan during the recession. the couple there ira and they ended up selling nearly everything they had. they eventually moved out of the country to save money. but in the 14 they decided to move back why? because the affordable care act passed. the aca made it possible for them to afford health insurance again. this is what susanna said, quote, if they shred the aca like they are threatening to do, we are going to have to hightail it out of here because dealing with the health care costs and insurance complications just makes you sick. we are getting by, but we are getting by on the aca, and if it goes away, if they make these changes the way they are talking about, we will be uninsured again which i was going to show you a picture here, these are the folks that i met with yesterday. i won't point out the individual ones. i am going to talk about some of the
