>> sure, i'll defer pete williams reporting on that. i think the tough call now is for the obama administration. for everything that pete said plus these two facts, one, this case was really well tried by the federal prosecutors. robert higdon pr from d.c., dav harbaugh as well. the key issue here was always john edwards to be the first person prosecuted for this so he couldn't have had criminal intent. the federal election commission was not on board with this prosecution, they couldn't find a violation, so the prosecution could have had a better reason for a conviction, they didn't get it. >> all you have to do is show one purpose of giving this money would be to help his campaign, right? >> that's right. and the statute said anything of value given for the purpose of influencing an election will be considered a contribution. she didn't require that finding of this jury. she said it could be for one of many purposes. there was every opportunity for a conviction here. john edwards, the politician, ended his career on the beach. >> you

williams in our washington newsroom, pete, thanks. also joining us from our washington bureau, michael leiter who served as head of the the national counter tearicism sector under both presidents bush and obama and was in fact in the white house situation room a year ago during the raid that killed bin laden. he's these days a national security analyst for us at nbc news. you have to admit the talk has been about how much al qaeda has been degraded. beyond the fact this was successful, it was intercepted, what do you take from this regarding their strength? what should we take from this? >> brian, this really shows that al qaeda in yemen, in the arabian peninsula as it's known in government circles, remains a very potent threat. as pete noted, 2009, mutallab, 2010, the cartridge bombs. the growing instability in yemen, especially in the south of the country, has left yemen open as a safe avon for terrorism, and this is a group, despite how they have been wounded, is very, very much committed to killing americans. >> what do you take a

insurmountable odds or what, pete?> you look, this is the second half of the year story, right, jon? and they're not convinced that after that it will be that big of an impact. this is a company with 15% of the smartphone market in the last half of 2011, now below 10%. this is a real problem. so now you've got to start looking at research in motion as sum of the parts. you've got a lot of cash, you've got no debt, but the sum of the parts, and what does that really mean as far as pattens and everything else? >> patents and everything else. >> that becomes the issue. >> they've got to do absolutely everything right. >> jon, thanks. i was going to say to any one of the traders, that becomes the issue when you have to make a decision on you see what that chart has done and that big slide down. whether you take a flier and get in on the name simply because you believe something is going to happen from a strategic standpoint, deal or otherwise. >> scotty, you have to look at it like pete says. pick over the carcass and see
