pete, it is a spectacular outfit. simon you said in half time today a good point that a lot of times people come on air and say something differently when they are up on the balcony before they come on set. i was somewhat surprised when i said today it is not about the earnings. of course, earnings have been disappointing. i felt the set up in terms of the market reaction today and really for the next two weeks was much more about the idea that people are beginning to realize whoever wins that election in two weeks that in both scenarios it is negative for the stock market in the short term. it is the realization that people are starting to factor that in. >> what is positive two weeks ago? people are making an argument that maybe the fiscal cliff gets done before the elections or obama stays and punch bowl stays and bernanke stays. there was an argument in the other direction two weeks ago. >> i believe when you were seeing through early october was the early performance catch up. i recently showed that apple was eve

to pete's point the market wants to continue to go higher. obviously it sold off a little bit in the looft few minutes. understood. i still adhere to my comments the market doesn't give me this the long sell the highs which do i believe we have to push towards 1500, 1525 in the s&p and names we've hammered home. home depot at 12 1/2 year high. there are secular stories that continue to work and i believe they will continue network. >> what are you doing with this? >> well, listen, you buy this jobs report. it's astounding to me that some people believe that there's a conspiracy theory out there and to me what i know about human nature is when the facts don't fit people's belief thend to make up stories so they are not wrong. what that says to me in this case is there is fuel for a big, big rally here. the one thing that's not priced in to this market is an improving economy. so all you need to do is get a good couple numbers and we're head back up to that 1500 level. >> dr. j? >> mark twain was quoting other folks from history that said there

nbc news's justice correspondent pete williams joins us now. pete, good afternoon. what did the judge actually say about why he decided to rule this way? >> reporter: well, let's track what's happened here. the state first passed the law and said if you don't have a dlls, you need a government i.d. if you don't have the driver's license, then you could get the nondriver's state issued i.d. and then the state said, wait a minute, that's a secure form of i.d., so if you want that you're going to have to have a certificate, birth certificate with a raised seal and three other forms of identification. well, that was a problem. so then the state said, okay, here is what we're going to do. we'll issue a new form of i.d. that's good only for voting, and they started to do that, but they said you could only get that if you couldn't qualify for the other forms. then they changed their mind on that. so what the judge finally said is, i think the state now has it about right, that it's easy to get this new form of i.d., but the problem, he says, is, number one, i can't be sure

(john bailey) it's fine for the audience because they can see both. and the conceit seemed to work. it wouldn't work today because you'd want close-ups, you'd want to see the actors turn to each other. but it was a common method of shooting sometimes a three- four-minute scene in one shot because they had very short shooting schedules. get the young lady. anybody making a b-picture wanted to make a-pictures. so what we were trying to do was to impress somebody, usually the executives at the studio. and

our justice correspondent, pete williams, has been working on this story from our d.c. news room. he is with us tonight with details, good evening. >> reporter: brian, the fbi says this plot was the idea of a 21-year-old college student from bangladesh. he was arrested after riding in a van that he thought carried a powerful bomb that agents say he assumed was one that would kill women and children. his target, the new york offices say, was a bank building, he was arrested later in federal court charged with attempting to try to set off the powerful bomb. he was identified as quazi nafis, and came to the country on a student visa, but intended to carry out a terror attack. by july, he was trying to recruit people, meeting one man several times in new york central park, but that man turned out to be an fbi informant. and from that moment on, quazi nafis was under surveillance. he wanted to target the new york stock exchange, but later decided to target the federal reserve bank. he wrote an article he hoped would be published by the jihadist website, saying targeting this would be t
