. >> pete suratos is live to explain how had this could impact all of our view of the bay. pete?porter: good morning to you. the point was to give voters a say on high-rise buildings along a stretch of the city's waterfront. whether or not it can validate proposition b which requires voters to aproven the condition along a stretch of the city's waterfront between aquatic park to hunter's point making sure it doesn't exceed high building limits which vary between 40 to 80 feet. this is in response to a lawsuit filed by the state's land commission which says they actually have the power to have the final say on development along this piece of land. now as far as a time line on how we got to this point 59% of voters approved prop b in june of 2014. after the land commission filed a lawsuit against the city to overturn this, arguing the lands belonged to the state and are managed by the port. so the power shouldn't be with the city and the voters. they attempted to have settlement talks but those failed last year and that's where we're at at this point now, guys. those that are again

nbc bay area's pete suratos is ve at san francisco police headquarters right now. pete, you talked with police right now. what will are they saying about what might have led to this? >> reporter: yeah, good morning to you, kris. yes, i spoke to san francisco police in the past hour, and at this time they cannot confirm if that victim was indeed a tourist, but we can report that they have detained two suspects in connection to this crime. but let's go ahead and show you some scene video from when this all took place this morning in front of the da vinci villa hotel in the 200 block of vanness. according to san francisco police, they say this happened just after 2:00 a.m. the victim described as a male adult in his 30s getting into what they are calling at this time a physical altercation with the suspects. the victim was eventually sent to had a hospital where he died from the injuries. now there are no details from san francisco police as far as what led to this fight or if weapons were involved, but i did get a chance to ask police if this incident should be a caus

. >> that is where we find "today in the bay's" pete suratos to explain how an officer of injured and what may have triggered the whole thing. pete? >> reporter: good morning to you, kris and sam. san francisco police are investigating what may have caused this massive brawl inside of the westfield mall last night. we'll show you that video of what took place. see san francisco police running up the escalator trying to diffuse the fight. they say the brawl started inside the mall roughly around 7:00 p.m. when about two dozen people started fighting in the food court area of the mall. police say some folks tried to run away from the cops with reports of chairs even being thrown at the officers. it took about 30 cops to respond to the. one of those officers suffering minor injuries like you mentioned, but the officer appears to be okay. several people were were detained as a result with one person being arrested. due to this incident you are looking at, the mall had to close up early last night but it's expected to open up during its regular business hours this morning. live in san fran

live in dublin, pete suratos for today in the bay. >> thanks, pete. >>> it's 5:33. happening today, sayyadina thomas will be in court for felony child abuse charges for allegedly placing drugs in the mouth of a toddler playing at people's park on monday. according to court documents, thomas told police it was a tootsie roll but later admitted it was methamphetamine. we've learned thomas is no stranger to police. court records show she's been arrested or cited more than 20 times since 2002. >> scary moments at a north bay supermarket. police say a man is behind bars accused of inappropriately touching a 15-year-old girl inside. police arrested this man, james tr strat stratta, after he allegedly accosted a girl on blithedeal avenue in mill valley about a half mile away from the mill valley elementary school. investigators say stratta who is homeless touched the teenager's arms and proceeded the grope her. the girl fought away, she was able to break free. her father with the help of a witness tried to detain stratta until police officers could arrive but he took off.

. >> today in the bay's pete suratos is live outside the jail in dublin where derek almena is being heldng, pete. >> reporter: good morning, laura and sam. as you mentioned, the master warehouse tenant of the ghost ship warehouse derek almena is behind bars at the santa rita jail in dublin but he's expected to enter a plea during the court hearing in oakland. almena was arrested a few days ago in lake county alongside warehouse tenant max harris who was arrested in los angeles county. both men face criminal charges in connection to the deadly ghost ship warehouse fire that took place in december. following a six month investigation by the alameda county district attorney's office, both men face 36 counts of involuntary manslaughter. 36 people died in the warehouse back in december when the building went up in flames during a party being held at the site. as i mentioned, harris was arrested in los angeles county and remains in custody in los angeles. he will be brought here to the bay area but that court hearing for almena will take place at 9:00 a.m. in oakland. live in dublin, pete sura

pete suratos live at the santa rita jail, where derick almena, the master tenant who lived there, ishe case. victims say theses couldn't come soon enough. >> yeah, good morning to you. as you mentioned, derrick almena, the master tenant is behind bars here at the santa rita jail here in dublin, and max harris, his sidekick of sorts, is also charged and brought up at some point this week. we're going to show you the new mugshot from authorities of almena. both men are facing charges, according to the alameda county d.a., criminal charges in connection to the ghost ship warehouse fire. after an exhaustive six-month investigation, the d.a. announcing yesterday both men will face criminal charges in connection to the fire, which include 36 counts of involuntary manslaughter for the 36 people that died in december during a party at that building when the warehouse went up in flames. also, the d.a. added that the two men knowingly created a fire trap with an inadequate space to eskwap this fire. if convicted, they could face up to 39s in state prison. we did get a chance to speak by phone

nbc bay area's pete suratos has been live at the scene as well. what have you been seeing from your perspective, pete? >> reporter: yeah, good morning to you, laura and sam. and that media briefing with sfp d. wrapping up not too long ago confirm a lot of the information that we've been reporting all morning long here on nbc bay area. we'll go ahead and show you the scene on 17th street and utah. you still see a heavy police presence as well as san francisco fire as they conduct this investigation and here's what we learned during that briefing. we know what was an active shooting situation happened around 855:00 a.m., just before 9:00 a.m. and several shot at ups. that's the call that they got here from sfp d., and they determined at that time that the suspect was in the building. when they got inside, they encountered victims in there, and they took them to a safe place. now, that suspect was located by police at that point, and they tell us that the suspect was armed with a gun and the suspect shot himself in the head taking his hone life. that'

pete suratos, nbc bay area news. >>> a man is hospitalized after being shot. police say shots were fired around 10:00 last night at the off-ramp from northbound 101. the driver in the porsche lost control and then smashed into a power pole and into three other vehicles. the suspect drove away from the scene. the victim was taken to the hospital with a gunshot wound to the chest. police are not sure whether the victim and suspect knew each other. >>> a viral story everyone is talking about, all quiet right now, but that was not the case last night. take a look at this video of the fight breaking out at the mall. about two dozen people started fightinging in the food court migrated up a couple levels. in all, about 30 police officers responding to the scene there running up the escalators, trying to keep shoppers safe. one officer was actually injured, but is expected to be okay. police say some of the people involved tried to run away, which led to more issues. at one point in the video you can even see a chair being thrown at the officers. >> it did complicate

nbc bay area's pete suratos is live in the newsroom with more about the arrests and charges that will be announced in just a couple hours from now. pete? >> reporter: good morning to you, scott and kris. just getting information into the newsroom from the alameda county d.a.'s office and that's deric almena and max harris, the warehouse tenant of that building were arrested this morning outside of alameda county, and they will be the ones facing charges in connection to the deadly ghost ship fire. the d.a.'s office will hold the news conference in a matter of hours to further elaborate on those charges. now the announcement of charges against these two individuals just takes place over six months after that deadly ini didn't took place, that fire resulting in the deaths of 36 people and has put the city of oakland as well as other cities under the microscope when it comes to safety hazards being involved in buildings like this one around town. as i mentioned that charge is going to take place in a matter of hours in oakland hat 1:00 p.m. we have crews in place, and we'll bring you con
